AN ORDINANCE TO PROVIDE FOR A LOCAL IMPROVEMENT
CONSISTING OF THE CONSTRUCTION OF CONCRETE PAVE-
MENT, CURB AND GUTTER, STORM SEWER AND OTHERWISE
IMPROVING KATES ROAD, IN THE VILLAGE OF DEERFIELDr
ILLINOIS.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS:
SECTION A local improvement shall be constructed in the
ONE: Village of Deerfield, Illinois consisting of the
construction of approximately 5,600 square yards
of 8" standard reinforced portland concrete cement pavement on
a 4" granular base, 2,835 linear feet of Illinois Standard Type
B -6.18 curb.and gutter, 730 linear feet of Type.B -6.12 curb and
gutter, 1113 linear feet of 12" reinforced concrete storm sewer,
422 linear feet of 10 ".reinforced concrete storm sewer, related
traffic signal modifications, bituminous driveway repairs, and
other necessary items, along the Kates Road right -of -way from
Waukegan Road west to the right -of -way of the Chicago, Milwaukee,
St. Paul & Pacific Railroad,.an approximate total distance of
1312 feet. All of said roadway is situated in the Village of
Deerfield, Illinois.
SECTION That said improvement shall be constructed, and
TWO: the details concerning•the same shall be in
accordance with the Plans and Special Provisions
and specifications entitled "Village of Deerfield, Deerfield,
Illinois, Kates Road Improvements- Special Assessment No. 114",
attached hereto and made a part hereof.
SECTION That all materials of every kind used in the
THREE: construction of this improvement shall be of
first class quality and suitable for the purpose
for which they are to be used. 'All construction shall. be done
in a workmanlike manner, under the supervision and subject to
the approval of the Board of Local Improvements, and use shall
be made of existing grades for roadway purposes.

SECTION That the Recommendation of the Board of Local
FOUR: Improvements of this Village providing for this
improvement, together with the Estimate of the
cost thereof made by the President of said Board, both attached
hereto, are herein approved.
SECTION That the improvement herein provided to be
FIVE: constructed shall be made, and the whole cost
thereof including $19,538.93, being the amount
included in the Estimate of the President of the Board of Local
Improvements as the cost of making, levying, and collecting the
assessment herein with an additional amount of $19,538.93 included
as reserve for deficiency in interest, shall be paid for by
special assessment in accordance with Article 9, Division 2, of
the Illinois Municipal Code, approved May 29, 1961, and the
amendments thereto; the provisions of which are hereby adopted by
reference as the applicable provisions to be employed by this
Village in regard to such local improvements. The sum of $19,538.93
shall be applied toward the cost of making, levying and collecting
such assessment and an additional $19,538.93 shall be retained
and used as reserve for payment of deficiency in interest. Each
said amount does not itself exceed 6% of the amount of.the Assess-
ment as estimated.
SECTION The aggregate amount herein ordered to be assessed
SIX: against the property, and also the assessment on
each lot and parcel of land therein assessed, shall
be divided into'ten (10) installments in the manner provided by
the Statute aforesaid, and each of said installments shall bear
interest at a rate.not to exceed 6% per annum according to law,
until paid.
SECTION That for the purpose of anticipating the collection
SEVEN: of the second and succeeding installments of said
assessment for said installments, vouchers or
bonds. shall be issued, payable out of said installments bearing
interest at a rate not to exceed 6% per annum, payable annually
and signed by the President of the Village of Deerfield, and
attested by the Village Clerk under the corporate seal of the
Village of Deerfield. Said vouchers or bonds shall be issued in
accordance with and shall in all respects conform to the provisions
of the aforesaid statute.of the State of Illinois entitled,
"Municipal Code" and the amendments thereto.

SECTION That the Village Attorney is directed to file
EIGHT: a Petition in the Circuit Court of Lake County,
Illinois, in the name of the Village of Deerfieldf
praying that steps may be taken to levy a special assessment for
said improvement in accordance with the provisions of this
Ordinance in the manner prescribed by law.
SECTION That all ordinances or part of ordinances
NINE: in conflict herewith are, to the extent of
such conflict, hereby repealed.
SECTION That this Ordinance shall be in full force and
TEN: effect from and after its passage and appzoyal
as provided by law.

RECOMMENDATION
We submit herewith an Ordinance for a local improvement
consisting of the construction of portland cement concrete
pavement, curb and gutter, concrete storm sewer, and otherwise
improving Kates Road in the Village of Deerfield, Lake and Cook
Counties, Illinois, together with the Estimate of the costs of
such improvement, which Ordinance and Estimate are hereto attached
and made a part hereof, and we recommend the passage of said
Ordinance and the making of the improvement contemplated therein.

I submit herewith the extent, nature, description and
estimate of cost of a proposed improvement to be constructed
under the Local Improvement Article of the Illinois Munici-
pal Code of 1961, as amended.. The description of the improve-
ment is as follows:
The proposed work consists of the construction of
approximately 5,600 square yards of 8" standard
reinforced portland concrete cement pavement on a
4. granular base, 2,835 linear feet of Illinois
Standard Type B -6.18 curb and gutter, 730 linear
feet of Type B -6.12 curb and gutter, 1113 linear
feet of 12" reinforced concrete storm sewer, 422
linear feet of 10" reinforced concrete storm
sewer, related traffic signal modifications, bi-
tuminous driveway repairs, and other necessary items,
along.the Kates Road right -of -way from Waukegan
Road west to the right -of -way of the Chicago,
Milwaukee, St. Paul & Pacific Railroad, an approxi-
mate total distance of 1312 feet. All of said road-
way is situated in.the Village of Deerfield, Illinois.
Said.improvement is to be constructed in accordance with Plans

the 3rd day of October, 1977, adopted a Resolution that a local
improvement be made in the Village of Deerfield which Resolution
provided in substance as follows: _
A local improvement is originated in the Village
of Deerfield, Illinois consisting of the construc-

extent, nature, kind, character and the estimated cost of the
proposed improvement may be changed by the Board of Local
Improvements at the public consideration thereof, as provided
by law. All persons so desiring will then be heard as to the
necessity, nature and cost of the proposed improvement, and, if
