AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT
TO'THE PROPERTY LOCATED AT.1351'BERKLEY'COURT
WHEREAS, PHILIP WORLEY has petitioned for a variation from-the strict pro-
visions of Section VII,C,1 of the Zoning Ordinance of the Village of Deerfield,
passed May 4,. 1953, as amended, to permit a front yard of 25 feet in lieu of
the required 40 feet, with respect to the premises hereinafter described; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by.the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact, but has been unable to arrive
at a recommendation,
NOW, THEREFORE, BE IT ORDAINED, BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That in view of the failure of the Zoning Board of Appeals
ONE: to arrive at a recommendation, and upon review of the testi-
mony presented at the Zoning Board of Appeals hearing and
before the President and Board of Trustees, the following are adopted as
the findings of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hard -
TWO: ship in the way of carrying out the strict letter of the
provisions of the Zoning Ordinance of the Village of Deerfield,
as applied to Petitioner's property, which is legally described as follows:
Lot 6 in Block 8 in Branigar Bros. Woodland Park, a
subdivision of parts of the North 1� of Section 29,
Township 43 North, Range 12, East of the Third Prin-
cipal Meridian, Deerfield, Lake County, Illinois and
commonly known as 1351 Berkley Court.
SECTION That a.variation from the strict provisions of Section VII,C,1
THREE: of the Zoning Ordinance of the Village of Deerfield, passed
May 4, 1953, as amended, with respect to the property herein -
above described, is hereby granted so as to avoid creating the non - conformity
of the structure under construction, thereby permitting a front yard of 25
feet in lieu of the required 40 feet, all in accordance with plans presented
and filed with the Zoning Board of Appeals.
SECTION That the variation hereby granted is subject to compliance by
FOUR: the Petitioner with all other applicable provisions of the
Zoning Ordinance and with all other applicable ordinances of
the Village.

SECTION That this Ordinance shall be in full force and effect from
FIVE: and after its passage and approval as provided by law.
