AN ORDINANCE AUTHORIZING A SPECIAL USE
FOR THE CONSTRUCTION OF PUBLIC PARKING FACILITIES
'AT 807 PARK AVENUE AND 859 DEERFIELD ROAD
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of the Village
of Deerfield to authorize the use and occupancy of, certain real
estate commonly known as 807 Park Avenue and 859 Deerfield Road,
Deerfield, Illinois, and hereinafter described, for construction
of Public Parking facilities, being a special-use under and
pursuant to the provisions of Section XXIII,B of the Zoning
Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, the,Plan Commission of the Village of Deerfield,
after considering the evidence adduced, .made written findings
of fact and recommended that said special use of said,-real estate
be approved and authorized'subject to .certain conditions and
restrictions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings and recommendations of the
ONE: Plan Commission are concurred in and adopted
as the findings of the President and Board of
Trustees and the special use of the real estate legally des-
cribed as follows:
PARCEL 1:
A tract.of land described as follows, to wit: Beginning
at a point bn the North line of Section 32, Township 43
North, Range 12 East of the Third Principal Meridian said
point being 610 1/2 feet West of the Northeast corner of
said Section 32, running thence South 362.01 feet; thence
East parallel with the North line of said Section 32
135.3 feet to the Westerly line of the Chicago, Milwaukee,
St. Paul & Pacific Railroad; thence Northwesterly along
said right -of -way to the North line of said Section 32
thence West 33.8 feet to the place of beginning in the
Village of Deerfield, Lake County, Illinois.
PARCEL 2:
That portion of property commencing at a point 285 feet
West of and 233 feet North of the Southeast corner of the
Southeast Quarter of the Southeast Quarter of Section 29,
Township 43 North, Range 12, East of the Third Principal
Meridian; the true point of beginning thence West 50 feet;
thence South. 50 feet; thence East 50 feet; thence North
50 feet; to the point of beginning, and
That part of the Southeast Quarter of Section 29, Town-
ship 43 North, Range 12, East of the Third Principal
Meridian described as follows, to wit: Beginning at the
Southeast corner of said Section 29; thence North along
the Section line, 233 feet; thence West 335 feet to the
place of beginning and the Northeast corner of premises
intended to be described; thence West 133 feet 4 inches;
thence South on an angle of 74 degrees 48 minutes South
51 feet 10 inches; thence East 119 feet 9 inches, and
thence North 50 feet to the place of beginning all in
the Village of Deerfield, Lake County, Illinois.
as and for Public Parking facilities, be and the same is hereby
authorized and approved.
'SECTION That the approval and authorization of said
TWO: special use hereby given is subject to the
requirements that all use, construction and
development shall be in accordance with all representations made
by Applicant to the Plan Commission and President and Board of
Trustees.
SECTION That the approval and authorization of said
THREE: special use hereby given is subject to the
requirement that (a) the Public Parking facility
at 859 Deerfield Road shall be screened from adjoining residen-
tial property by a solid fence of suitable type and style, and
(b) this Ordinance shall be recorded in the Office of the Re-
corder of-Deeds of Lake County, Illinois, and all fees for such
recordation and expenses incurred therefor shall be paid by the
Applicant and (c) that a Preliminary Site Plan be presented to the
Board of Trustees for review and approval.
SECTION That the Village Clerk is hereby directed to
FOUR: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
FIVE: effect from and after its passage, approval and
publication as provided by law.
