AN ORDINANCE AUTHORIZING ISSUANCE OF LIQUOR LICENSES
IN THE VILLAGE OF DEERFIELD
WHEREAS, the Village of Deerfield is a Home Rule Unit by virtue
of a referendum passed April 15, 1975, pursuant to and in accordance
with the provisions of the Constitution of the State of Illinois of
1970; and
WHEREAS, the Village of Deerfield, as a Home Rule Unit, may
exercise any power and perform any function pertaining to its
government and affairs; and
WHEREAS, by virtue of a prior referendum, the sale of alco-
holic liquor within certain areas within the corporate limits of
the Village of Deerfield had been prohibited; and
WHEREAS, Chapter 43, Section 174 of the Illinois Revised Sta-
tutes provides and establishes procedures for the conduct of a
referendum with respect to continuing the prohibition on the sale
of alcoholic liquor within political subdivisions which have pre-
viously prohibited the sale of alcoholic liquor; and
WHEREAS, the President and Board of Trustees do hereby
determine that the Village of Deerfield is empowered by the Con-
stitution of the State of Illinois of 1970 to eliminate the prior
prohibition on the sale of alcoholic liquor within those areas
within the corporate limits of the Village of Deerfield previously
prohibiting said sale of alcoholic liquor without adhering to the
procedures set forth in Chapter 43, Section 174, Illinois Revised
Statutes, and further do determine that it is advisable and
necessary and for the best interests of the Village of Deerfield
to end said prohibition,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the prior prohibition on the sale of alco-
ONE: holic liquor within certain areas within the
corporate limits of the Village of Deerfield is
hereby set aside and the Local Liquor Commissioner of the
Village of Deerfield pursuant to and in accordance with applicable
ordinances of the Village of Deerfield, is empowered to issue
liquor licenses of all classes in the manner provided in said
ordinances of the Village of Deerfield to Applicants therefor
without regard to said prior prohibition as to issuance of various
classes of liquor licenses within certain areas within the corporate
limits of the Village of Deerfield.
SECTION That Chapter 43, Section 174 of the Illinois
TWO: Revised Statutes requiring the holding of a
referendum and an affirmative vote of the
electorate to eliminate the prior prohibition on the sale of
alcoholic liquor shall not apply to the Village of Deerfield.
SECTION That this Ordinance shall be in full force and

as provided by law.
