AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 22
OF THE MUNICIPAL CODE OF THE
VILLAGE OF DEERFIELD OF 1963, AS AMENDED
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Article I of Chapter 22 of the Municipal Code of the
ONE: Village of Deerfield of 1963, as amended, be and it is
hereby further amended by adding to said Article the follow-
ing Section 22.120:
"22.120 FOUNDATION HEIGHT.)
A. The top of any foundation shall not be less than a minimum of
one foot, nor exceed a maximum of two and one -half feet above the top
of the curb. Elevations shall be measured from a point midway across
the front of the lot. If no curb exists, the finished centerline grade
of the street shall be substituted for the curb as a point of measure-
ment. Variations from these standards will be permitted only upon
satisfaction of both of the following conditions:
1. Developer demonstrates that the proposed foundation
height will be in harmony with the existing nearby structures,
and
2. Physical conditions exist which prevent the developer
from adhering to the requirements.
When a variation is requested, it shall be reviewed and approved or
rejected by the Community Development Group, consisting of the Village
Engineer, Director of Public Works, Director of Planning, and the
Director of Building and Zoning. The corporate authorities hereby
designate and appoint said body to make recommendations to the Board
of Trustees with respect to variation requests. Thereafter, the Board
of Trustees shall either accept or reject said recommendations and
grant or deny the variation request.
B. An inspection shall be made by the Engineering Department in conjunc-
tion with the Building Department inspection after the foundation forms
are set. Concrete shall not be poured for the foundation until approval
following inspection is obtained. An additional inspection will be made
by the Engineering Department in conjunction with the Building Depart-
ment after the site has been finish - graded to determine compliance with
the grading plan, prior to the issuance of a Certificate of Occupancy.
Cost of such additional inspection shall be borne by the developer.
SECTION That all ordinances and parts of ordinances in conflict
TWO: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That the Village Clerk is hereby directed to publish this

SECTION That this Ordinance shall be in full force and effect from
FOUR: and after its passage, approval and publication, as provided
by law.
