O-75-57ORDINANCE NO. 0-75-57 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED AT 215 BURR'OAK AVENUE WHEREAS, CHESTERFIELD DEVELOPMENT CORP. has petitioned for a variation from the strict provisions of'Section VII,C,1 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit a front yard of 24.43 feet in lieu of the required 25 feet, with respect to the premises hereinafter described, and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED,,BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations of the Zoning ONE: Board of Appeals -are.hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hard - TWO: ship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield, as applied to Petitioner's property, which is legally described as follows: Lot 11 in Chesterfield's Laurel Hill Unit eleven, being a subdivision in the southwest quarter of Section 32, Township .43 north, Range-.12, East of the Third Principal Meridian, in Deerfield,'Lake County, IL. SECTION That a variation from the strict provisions of Section VII,C,1 THREE: of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property herein - above described, is hereby granted'so as to avoid creating the non- conformity of the structure under construction resulting from a surveyor's prior error, thereby permitting a front yarci-of 24..43.feet'in lieu of the required 25 feet, all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance by FOUR: the Petitioner with.all other applicable provisions of the Zoning Ordinance and with'-all other applicable ordinances of 9 the Village. i SECTION That this Ordinance shall be in full force and effect from FIVE: and after its passage and approval as provided by law.
