O-75-63ORDINANCE NO. 0 -75- 63 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE 1967 NATIONAL BUILDING CODE AS ADOPTED BY THE VILLAGE OF DEERFIELD WHEREAS, Fiat -Allis Construction Machinery, Inc., Petitioner, has taken an appeal to the Board of Building Appeals of the Village of Deerfield from a decision of the Director of Building and Zoning seeking a variation from the provisions of Section 603 thereof requiring an egress distance of no more than 150 feet, as opposed to the 225 feet egress distance proposed by Petitioner; and WHEREAS, said variation was considered at a public meeting of the Board of Building Appeals and was, in all respects, held according to law; and WHEREAS, the Board of Building Appeals of Deerfield, after considering the evidence.adduced, recommended that said Building Code variation be approved subject to certain conditions and restrictions, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the proposed 64,000 square foot addition to the ONE: existing development on the real estate legally described as follows: That part of the SW1 /4 of Section 33, Township 43 North, Range 12, East of the Third Principal Meridian, described as follows: Beginning at a point on the South line of said SW1 /4 476.18 feet West of the Southeast corner of said SW1 /4; thence North along a line 476.18 feet West of and parallel with the East line of said SW1 /4 to a point on the North line of the South 12 Rods of the North 1/2 of the SW1 /4 of said Section 33; thence Northwesterly 542.61 feet along a line parallel to and 430.56 feet from the center line of Waukegan Road to the North line of the South 242.2 feet of the North 877.6 feet of the SW1 /4 of Section 33, Township 43 North, Range 12; thence West along said North line 1111.86 feet to line of the Chicago, Milwaukee & St. Paul Railroad; thence Southwesterly 2216.08 feet along the Northwesterly line of the Chicago, Milwaukee & St. Paul Railroad to the South line of the SW1 /4; thence east along the South line of the SW1 /4 400 feet to place of beginning, all in Lake County, Illinois. and as set forth and described on the Plans submitted to the Board of Building Appeals, be and is hereby permitted to contain an egress distance of 225 feet in lieu of the 150 foot egress distance permitted by the 1967 National Building Code, subject to the conditions and restrictions hereinafter set forth. SECTION That the approval of said variation is subject to the further TWO: condition that, except as otherwise provided in this Ordinance, the Petitioner shall comply with all requirements of the Building Code and all other applicable ordinances of the Village of Deerfield.
