O-75-47ORDINANCE NO. 0 -75- 47 AN ORDINANCE VACATING A CERTAIN ALLEY IN THE VILLAGE OF DEERFIELD WHEREAS, the President and Board of Trustees of the Village of Deerfield, after due investigation and consideration, have determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of the alley hereinafter described. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the portion of the east -west public alley lying ONE: between Central Avenue and Osterman Avenue and east of Pettis Lane, a public alley in the Village of Deerfield, having heretofore been dedicated by a document recorded in the Office of the Recorder of Deeds of Lake County, Illinois, on June 2, 1874, in Book "A" of Plats, page 16, which portion of said alley is legally described as follows: All that part of the East -West 20 foot Alley lying South of the South line of Lots 3, 4 and 5, lying North of the North line of Lots 6, 7 and 8, lying West of the East line of Lot 8 produced North, all in Block 2 in Hall & Osterman's Addition to the Town of Deerfield, in the Northwest quarter of Section 33, Township 43 North, Range 12 East of the Third Principal Meridian, according to the plat thereof recorded June 2, 1874, in Book "A" of Plats, Page 16, in Lake.'County, Illinois. as shown on and designated by the words "Hereby Vacated" on the Plat hereto attached, which Plat for greater certainty is hereby made a part of this Ordinance, be and the same is hereby vacated and closed, inasmuch as same is no longer required for public use and the public interest will be subserved by such vacation. SECTION That upon passage and approval of this Ordinance, the TWO: Village Clerk shall file for record in the Office of the Recorder of Deeds of Lake County, Illinois, a certified copy of this Ordinance, together with the Plat hereto attached. SECTION That all ordinances and parts of ordinances in conflict THREE: herewith are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect FOUR: from and after its passage, approval and filing for record in the manner herein provided and upon the pay- ment of the fee provided for in Section 11.123 of the Municipal Code of Deerfield of 1963, as amended.
