O-75-36I ORDINANCE NO. 0 -75 -36 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED AT 254 FAIRVIEW AVENUE WHEREAS, SIGNORA EAMES has petitioned for a variation from the strict provisions of Section VI=_B __)of the Zoning Ordinance of the Village of Deer- field, passed May 4, 1953, as amended, to permit a front yard of 22 feet in lieu of the required 25 feet; with respect to the premises hereinafter described; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations of the Zoning ONE: Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hard - TWO: ship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 46 in the subdivision of J. S. Hovland's First Addition to Deerfield, a subdivision of the Southwest Quarter (except the Northwest Quarter of the Northwest Quarter thereof) of Section 32, Township 43 North, Range 12 East of the Third Principal Meridian, as shown on the Plat of said Subdivision recorded November 7, 1924, as Document 248380 in Lake County, Illinois. SECTION That a variation from the strict provisions of Section Vh =B ^J1 THREE: of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property herein - above described, is hereby granted so as to eliminate the non - conformity of of the existing structure created by the granting of a Planned Development for the property resulting in two additional lots, thereby permitting a front yard of 22 feet in lieu of the required 25 feet, all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance FOUR: by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village. SECTION That this Ordinance shall be in full force and effect from FIVE: and after its passage and approval as provided by law.
