AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED
AT 1 856 ROSEMARY TERRACE
WHEREAS, MR. CYRIL WAGNER has petitioned for a variation from the strict
provisions of Section VII,C,1 of the Zoning Ordinance of the Village of Deerfield,
passed May 4, 1953, as amended, to permit a front yard of 21 feet in lieu of the
required 25 feet; with respect to the premises hereinafter described; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning
ONE: Board of Appeals are hereby concurred in and adopted as the
findings of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hard -
TWO: ship in the way of carrying out the strict letter of the
provisions of the Zoning Ordinance of the Village of
Deerfield as applied to Petitioner's property, which is legally described
as follows:
0. B. Linde's subdivision being a subdivision of Lots 8,
9, 10, 11 and 12 (except the east 40 feet of said Lot 12)
in Block 1 in the original town of Deerfield according
to the Plat thereof recorded in Book 27, page 167 in the
Recorder's Office of Lake County, Illinois: Also that
part of the west one -half of the southwest quarter of
Section 28, Township 43 North, Range 12, East of the
Third Principal Meridian. Described as follows:
Beginning at the northeast corner of aforesaid Lot 12,
thence west on the north line of aforesaid Block 1, 20
rods more or less to the northwest corner of aforesaid
Lot B, thence north 79.4 rods, thence east, parallel to
the south line of said Section 28, 20 rods to the east
line of the west half of aforesaid southwest quarter
Section; thence south on said east line 79.4 rods to
place of beginning, all in the Village of Deerfield,
Lake County, Illinois.
SECTION That a variation from the strict provisions of Section VII,C,1
THREE: of the Zoning Ordinance of the Village of Deerfield, passed
May 4, 1953, as amended, with respect to the property herein -
above described, is hereby granted so as to authorize the construction of an
addition to the existing structure, thereby permitting a front yard of 21
feet in lieu of the required 25 feet, all in accordance with plans presented
and filed with the Zoning Board of Appeals.
SECTION That the variation hereby granted is subject to compliance
FOUR: by the Petitioner with all other applicable provisions of
the Zoning Ordinance and with all other applicable ordinances
of the Village.
SECTION That this Ordinance shall be in full force and effect from
FIVE: and after its passage and approval as provided by law.
