AN ORDINANCE GRANTING A VARIATION FROM
THE PROVISIONS OF CHAPTER 9 OF THE MUNICIPAL CODE
OF THE VILLAGE OF DEERFIELD
WHEREAS, Chesterfield Development Corporation has made application to
the Plan Commission of the Village of Deerfield for approval of a preliminary
plat of subdivision of certain real estate hereinafter described and located
in the 500 block of Elm Street and classified in the "R -5" District of the
Zoning Ordinance of the Village of Deerfield; and
WHEREAS, said application was considered at a public meeting of the
Plan Commission and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Deerfield, after considering the
evidence adduced, recommended that said preliminary plat of subdivision be
approved subject to certain conditions and restrictions,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the proposed single - family residential development
ONE: of the real estate legally described as follows:
That part of the north 709.5 feet of the south one -half
of the northeast quarter of Section 32, Township 43 North,
Range 12, East of the Third Principal Meridian, bounded by
a line described as follows: Beginning at a point in the
west line of Grand Avenue (now known as Elm) in the Village
of Deerfield, which is 285.0 feet due south of the north
line of the south half of the northeast quarter of said
Section, thence west along a line parallel to said north
line a distance of 201.60 feet, thence north parallel to
the west line of Grand Avenue a distance of 91.20 feet,
thence south parallel to the west line of Grand Avenue a
distance of 304.50 feet to a point which is 559.5 feet
south of said north line, thence east 292.8 feet to a
point in the west line of Grand Avenue which is 274.5 feet
north along the west line of Grand Avenue a distance of
274.5 feet to the point of beginning in the Village of
Deerfield, Lake County, Illinois.
and as set forth and described on the attached preliminary plat of sub-
division which preliminary plat of resubdivision is made a part of this
Ordinance, be and is hereby approved, subject to the conditions and restric-
tions hereinafter set forth.
SECTION That the Cul -de -sac depicted on said preliminary plat of
TWO: subdivision as Brookside Lane shall be permitted to have
a forty foot radius in lieu of the required fifty foot
radius as required by Chapter 9 of the Municipal Code of the Village of
Deerfield.
' SECTION The approval of said preliminary plat of subdivision is
THREE: conditioned upon the applicant locating the driveway on
that portion of the property depicted as Lot 1 on the
preliminary plat of subdivision at least ten feet from the westerly line
of the subject property.
SECTION That the approval of said preliminary plat of subdivision
FOUR: is subject to the further condition that, except as other-
wise provided in this Ordinance, the developer shall comply
with all requirements of the Zoning Ordinance and all other applicable
ordinances of the Village of Deerfield.
SECTION This ordinance shall be in full force and effect from
FIVE: and after its passage as provided by law.
