AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED
AT 520 ELM STREET
WHEREAS, Chesterfield Development Corporation has petitioned for a variation
from the strict provisions of Section VII,C,1 of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended, to permit a front yard of
23 feet in lieu of the required 25 feet; with respect to the premises hereinafter
described; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning
ONE: Board of Appeals are hereby concurred in and adopted as the
findings of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hard -
TWO: ship in the way of carrying out the strict letter of the
provisions of the Zoning Ordinance of the Village of
Deerfield as applied to Petitioner's property, which is legally described
as follows:
That part of the north 709.5 feet of the south one -half
of the northeast quarter of Section 32, Township 43 North,
Range 12, East of the Third Principal Meridian, bounded by
a line described as follows: Beginning at a point in the
west line of Grand Avenue (now known as Elm) in the Village
of Deerfield, which is 285.0 feet due south of the north
line of the south half of the northeast quarter of said
Section, thence west along a line parallel to said north
line a distance of 201.60 feet, thence north parallel to
the west line of Grand Avenue a distance of 91.20 feet,
thence south parallel to the west line of Grand Avenue a
distance of 304.50 feet to a point which is 559.5 feet
south of said north line, thence east 292.8 feet to a
point in the west line of Grand Avenue which is 274.5 feet
north along the west line of Grand Avenue a distance of
274.5 feet to the point of beginning in the Village of
Deerfield, Lake County, Illinois.
SECTION That a variation from the strict provisions of Section VII,C,1
THREE: of the Zoning Ordinance of the Village of Deerfield, passed
May 4, 1953, as amended, with respect to the property herein -
above described, is hereby granted so as to eliminate the non - conformity of
of the existing structure created by the additional Elm Street dedication,
thereby permitting a front yard of .23 feet in lieu of the required 25 feet,
all in accordance with plans presented and filed with the Zoning Board of
Appeals.
SECTION That the variation hereby granted is subject to compliance
FOUR: by the Petitioner with all other applicable provisions of
the Zoning Ordinance and with all other applicable ordinances
of the Village.
SECTION ._That this Ordinance shall be in full force and effect from
FIVE: and after its passage and approval as provided by law.
