ORDINANCE NO. 0 -74- 74
AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT
TO THE PROPERTIES LOCATED AT 331, 333 and 343 FAIRVIEW AVENUE
WHEREAS, CHESTERFIELD DEVELOPMENT CORPORATION has petitioned as
agent for and on behalf of the owners of the property described below, for
a variation from the strict provisions of Section VT-- B(C)(1) of the Zoning
Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit
a lot area of 18,000 square feet in lieu of the required 20,000 square feet
with respect to each of the three lots hereinafter described; and
WHEREAS, pursuant to notice duly published, as required by statute,
a public hearing on said petition was held and conducted by the Zoning Board
of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President
and Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED, BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF.DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning
ONE: Board of Appeals are hereby rejected and the President and
Board of Trustees hereby find that there are practical
difficulties and particular hardship in the way of carrying out the strict letter
of the provisions of the Zoning Ordinance of the Village of Deerfield as applied
to the property, which is legally described as follows:
Lots 37, 38 and 39 (except the East 150 feet thereof) in
J. S. Hovland's First Addition to Deerfield, being a sub-
division of the Southwest Quarter of Section 32, Township
43 North, Range 12, East of the Third Principal Meridian
according to the plat thereto, recorded November 7, 1924,
as Document #248380 in Book "N" of plats, page 56, Lake
County, Illinois.
SECTION That a variation from the strict provisions of Section VI= B(C)(1)
TWO: of the Zoning Ordinance of the Village of Deerfield, passed May 4,
1953, as amended, with respect to the property hereinabove
described, is hereby granted so as to authorize a lot area of 18,000 square feet in
lieu of the required 20,000 square feet, with respect to each of the three lots herein -
above described.
SECTION That the variation hereby granted is subject to compliance
THREE: by the Petitioner with all other applicable provisions of
the Zoning Ordinance and with all other applicable ordinances
of the Village.
SECTION That this Ordinance shall be in full force and.'effect from
FOUR: and after its passage and approval as provided by law.
