AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE
PROPERTY LOCATED'AT 225 FAIRVIEW AVENUE "
WHEREAS, MR. and MRS. HOWARD KODYM, have petitioned for a variation
from the strict provisions of Section VI,B,D,2,a of the Zoning Ordinance of
the Village of Deerfield, passed May 4, 1953, as amended, to permit a rear yard
of 13.26 feet in lieu of the required 25 feet, with respect to the premises
hereinafter described; and
WHEREAS, pursuant to notice duly published, as required by statute,
a public hearing on said petition was held and conducted by the Zoning Board
of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President
and Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the
ONE: Zoning Board of Appeals are hereby concurred-in and
adopted as the findings of fact of the President and
Board of Trustees.
SECTION That there are practical difficulties and particular hardship
TWO: in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied
to Petitioners' property, which is legally described as follows:
The West 150 feet of Lots 32 and 33 in the Subdivision of
J. S. Hovland's First Addition to Deerfield, being a Subdivision
of the Southwest Quarter (except the Northwest Quarter of the
Northwest Quarter thereof).of Section 32, Township 43 North,
Range 12 East of the Third Principal Meridian, in Deerfield,
Lake County, Illinois, and commonly known as 225 Fairview Avenue,
Deerfield, Illinois.
SECTION That a variation from the strict provisions of Section
THREE: VI,B,D,2,a of the Zoning Ordinance of the Village of Deerfield,
passed May 4, 1953, as amended, with respect to the property
hereinabove described, is hereby granted so as to authorize in conjunction with the sub-
division of the subject property a rear yard of 13.26 feet in lieu of the required
25 feet, all in accordance with plans presented and filed with the Zoning Board of
Appeals.
SECTION That the variation hereby granted is subject to compliance
FOUR: by the Petitioners with all other'applicable provisions of
the Zoning Ordinance and with all other applicable ordinances
of the Village.
SECTION That this Ordinance shall be in full force and effect
FIVE: from and after its passage and approval as provided by law.
