ORDINANCE NO. 0 -74- 62
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
LOCATED AT 839 WAUKEGAN ROAD
WHEREAS, IRL H. MARSHALL has petitioned for a variation from the
strict provisions of Sections XIII,I and XVI,F,10 of the Zoning Ordinance
of the Village of Deerfield, passed May 4, 1953, as amended, to permit parking
of vehicles up to the lot line and within the required yards with respect to
the premises hereinafter described, and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals, has filed with the President and
Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of the Zoning
ONE: Board of Appeals are hereby concurred in and adopted as the
findings of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardship
TWO: in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied
to Petitioner's property, which is legally described as follows:
Lots 18 and 19 in the Owners Homestead Subdivision in the
Southwest quarter of Section 28, Township 43 North, Range 12,
East of the Third Principal Meridian according to the plat
thereof recorded December 11, 1922, as Document z18864 in Book
L of Plats, page 48 in Lake County, Illinois, and commonly
known as 839 Waukegan Road, Deerfield, Illinois
SECTION That a variation from the strict provisions of Sections
THREE: XIII,I and XVI,F,10 of the Zoning Ordinance of the Village
of Deerfield, passed May 4, 1953, as amended, with respect
to the property hereinabove described, is hereby granted so as to permit parking
of vehicles to the lot line and within the required yards, all in accordance with
plans presented and filed with the Zoning Board of Appeals.
SECTION That the variation hereby granted is subject to compliance
FOUR: by the Petitioner with all other applicable provisions of
the Zoning Ordinance and with all other applicable ordinances
of the Village.
SECTION That this Ordinance shall be in full force and effect from
FIVE: and after its passage and approval as provided by law.
