ORDINANCE NO. 2022- 0-22-41
AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 7 OF "THE
MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS
AMENDED, REGARDING CONTRACTOR REGISTRATION REQUIREMENTS
WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant
to the provisions of Article VII, Section 6 of the Illinois Constitution; and
WHEREAS, Chapter 7 of "The Municipal Code of the Village of Deerfield, Illinois,
1975," as amended ("Village Code'), requires owners and operators of certain businesses to
obtain a license in order to operate within the Village; and
WHEREAS, under the current regulations, building contractors are required to
obtain a license and electrical contractors are required to register with the Village; and
WHEREAS, after a review of the current licensing and registration requirements for
contractors, Village staff recommends amending the requirements of Chapter 7 to eliminate
the licensing requirement and expand the type of contractors that are required to register
with the Village; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interests of the Village and its residents to amend Chapter 7 of the Village Code pursuant to
this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: ELECTRICAL CONTRACTORS. Pursuant to the Village's
home rule authority, Article 5, titled "Electrical Contractors," of Chapter 7, titled
"Businesses," of the Village Code is hereby amended further to read as follows:

Sec. 7-36. Definition:
As used in this article;
(a) The term "building contractor" or "contractor" shall =an_and

roofing contractor: or as a plumbing contractor: or as an
irrigation contractor: or as an electrical contractor: or engaged
in the construction, alteration or repair of building's or other
structures, or sidewalk or street pavements.
kW The term "electrical contractor" as used in this article shall mean and
be construed to include any person engaged in the business of installing
or altering by contract, equipment and electrical appliances for the
utilization of electricity supplied by light, heat or power not including
radio apparatus or equipment for wireless reception of sounds and
signals, and not including apparatus, conductors and other equipment
installed for or by public utilities, including common carriers, which are
under the jurisdiction of the Illinois commerce commission for use in
their operation as public utilities; but the term "electrical contractor"
does not include employees employed by such contractor to do such
supervised work'.

as a contractor in the village.

Sec. 7-37. Registration Certificate:
(a) Registration Certificate Required: No person may engage in the
business of elee44eal a contractor within the Village without having
first secured a certificate of registration from the Village.

(c) Certificate Issuance: Upon the filing of an application in proper form
and the payment of the registration fee set forth in section 7-38 of this
code, the Director of Community Development, or designee, will issue a
registration certificate to the applicant, which will authorize the
applicant to engage in the business of a eleetr4eal ontractor for the year
in which it is issued.

(d) The Director of Community Development, or designee, will maintain a
list of all contractors registered with the Village.
(e) Any registration issued under this article may be revoked by
the village President by and with the advice and consent of the.
board of trustees for repeated violations of this article.
(f) Any person
doing business,
as a
subcontractor shall be
construed as
engaged in the
business
of a building contractor
for which registration
is retruired
by
this article,
Sec. 7-38. Registration Fee:
The annual fee for registering as anycontractor shall be the amount
set forth in the annual fee resolution adopted by the corporate authorities. The
register year shall correspond to the license year.
Sec. 7-39. Regulations; Compliance:
(a) It shall be the duty of all contractors to comply with this code
and all ordinances relating to the construction of buildings ar
other structure% to the construction of street or sidewalk
pavements, and all laws or ordinances pertaining to or
regulating the activities enlraged in.
(b) No person registered under the provisions of this article shall install
any electrical appliances, wiring or fixtures without strict compliance
with this code and the ordinances relating to such fixtures.
(c) No person shall do any work without having obtained such permits as
may be required.
(d) Homeowners are permitted to__perform plumbingroofing,,
electrical eneral contractor, concrete, and e�Ycavation work
on am, owner -occupied_ residence owned by them without
reistering_ under this Article. Homeowners are not_perinitted

(e) Applications submitted by electrical contractors must be

(f) Applications submitted by plumbing contractors must be
accompanied with proof that the applicant holds a valid 055
IDPH lumber's license and a valid 058 IDPH plumber's license.
(g) Applications submitted by irrigation contractors must be
accompanied with proof that the applicant holds a valid 060
D H umber's license and_ a valid cross -connect license issued

(h) Anpl c.altions, submitte-d by roofing contractors must be
accompanied with proof that the applicant holds a valid roofing
license issued by the State of Illinois.
Sec. 7-40. [Reneyedl Surety Bond Required:
The. application for registration under this article shall _be
accompanied by a surety bond with a corporate surety, in the sum of
twenty thousand dollars ($20,000.00) conditioned to indemnify the
village from any expense, liability, loss or damage resulting from the
issuance of such registration or from the work undertaken pursuant
to said rg i or the manner of doing the same-,,
SECTION THREE: BUILDING CONTRACTORS. Pursuant to the Village's home
rule authority, Section 7-29, titled "Definition," Section 7-30, titled "License Required;
Applications," Section 7-31, titled "License Fees," Section 7-32, titled "Subcontractors;
License Required," Section 7-33, titled "Surety Bond Required," Section 7-34, titled
"Regulations; Compliance," and Section 7-35, titled "Revocation Of License," of Article 4,
titled "Building Contractors," of Chapter 7 titled, "Businesses," of the Village Code are hereby
repealed in their entirety and reserved for future use.
SECTION FOUR: SEVERABILITY. If any provision of this Ordinance or part
thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this
Ordinance shall remain in full force and effect, and shall be interpreted, applied, and enforced
so as to achieve, as near as may be, the purpose and intent of this Ordinance to the greatest
extent permitted by applicable law.
SECTION FIVE: PUBLICATION The Village Clerk is hereby directed to publish
this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION SIX: EFFECTIVE DATE. This Ordinance will be in full force and
effect ten days after its passage., approval, and publication in the manner provided by law or
January 1, 2023, whichever is later.
