AN ORDINANCE APPROVING .A PLANNED DEVELOPMENT
(CHESTERFIELD ;UNIT 'NO.: :9;)
WHEREAS, the Plan Commission of the Village of Deerfield
has heretofore held a public hearing on the application of
CHESTERFIELD DEVELOPMENT CORPORATION (Developer) for the approval
of a single - family residential planned development of certain real
estate hereinafter described located in the Hovland Subdivision
and classified in the R -1 -B District of the Zoning Ordinance of
the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS,the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, recommended that said planned
development be approved subject to certain conditions and restrictions.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD.
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS AS FOLLOWS:
SECTION. That the proposed single - family planned
ONE:, residential development of the real estate
legally described as follows:
Lots 2, 3; 4 and 5 (except the East of 150 feet 'of
all), Lot 6 (except the East 135 feet and except
the South 40 feet), Lots 35 and 36, and the East
150 feet of Lots 37, 38 and 39, all in J.S.
Hovland's First Addition to Deerfield, being a
subdivision of the Southwest Quarter of Section
32, Township 43, North, Range 12; East of the
3rd Principal Meridian according to the plat
thereto, recorded November 7, 1924 as Document
#248380 in Book "N" of plats, Page 56, Lake
County, Illinois
and as set forth and described on the attached plan of development
and preliminary plat of resubdivi.sion, which plan and plat of
resubdivision are made'a part of this Ordinance (including, in
particular, the variation.franthe'Code provisions with respect
to the length of the Burr Oak Avenue cul de'sac), be and it is
hereby approved subject to the conditions and restrictions
hereinafter set forth.

SECTION That the approval of said planned development
TWO: is conditioned upon the following:
A. That the Developer dedicate the West 30 feet of Lot 6,
except the South 40 feet of said Lot, and the East 30 feet of Lot
35 to the'Village'of Deerfield as and.for street purposes and that
prior to the issuance'of a building permit for Lots 6 or 35, or any
portion thereof as the same may be resubdivided, the Developer shall
deposit sufficient funds in escrow with'the Village or make other
provision satisfactory to the Village to insure the payment of its
proportionate share of the installation of full street improvements,
including pavement, curb, gutter, storm sewer, street signs, and
street lighting, in accordance with the applicable provisions of
the Village'Code for. the proposed street to be constructed on the
above - described portions of Lots 6 and 35.
B. That the Developer construct and install full and
complete subdivision improvements in accordance with the applicable
provisions of the Municipal Code of the Village of Deerfield to
serve the lots which will front on the proposed street (Burr Oak
Avenue) to be constructed and installed along the rear of Lots 36,
37, 38, 39, 2, 3; 4 and 5, dedicate the right -of -way of said street
and install such other improvements as may be required upon approval
of the final plat of subdivision; that the Developer acquire an
appropriate easement for storm water drainage purposes from the
subject property to Hackberry Road and construct and install storm
water drainage facilities in accordance with plans submitted to and
approved by the Village Engineer.
C. That the Developer construct and install and improve
Rosewood Avenue from Fairview Avenue to Willow Avenue (or to that
point on Rosewood Avenue west of Willow Avenue where'such.impr.ove
ments presently terminate) in the following manner:
1. Complete storm sewer improvements, including
all necessary appurtenances.and connections;
2. Street pavement, including curb and gutter,.
street signs and street lighting;
3: Complete sanitary sewer improvements,
including all necessary appurtenances and
connections to the sanitary sewer installed in
Fairview Avenue;
4. Such other subdivision improvements as may
be required to serve the lots proposed to front or
abut on Rosewood Avenue, in accordance with the
applicable provisions of the Municipal Code of the
Village of Deerfield.
all of which improvements shall be constructed and insta'll'ed in
accordance with the applicable provisions of the Municipal Code
of the Village of Deerfield.

SECTI;ON That the approval of the planned development
THREE: hereby given is subject to the `further
condition that the Developer submit-for approval a final plat of
resubdivision of thereal estate described in Section One hereof
and except as otherwise provided in this Ordinance, comply with
all requirements of the Village Code of the Village of Deerfield
necessary for the approval of said final plat.
SECTION That this Ordinance shall be in full force and
FOUR:- effect from and after its passage and approval
as provided by law.
