ORDINANCE NO. 0 -73 -56
AN ORDINANCE APPROVING A PLANNED
DEVELOPMENT (HOVL'AND LOT '51) '
WHEREAS, the Plan Commission of the Village of Deerfield
has heretofore held a public hearing on the application of
Chesterfield Development Corp. for the approval of a single- family
residential planned development of certain real estate hereinafter
described, located in the Hovland Subdivision and classified in the
R -1 -B District of the Zoning Ordinance of the Village of Deerfield;
and
WHEREAS, the said hearing was held pursuant to duly
published notice thereof and was, in all respects, held according
to law; and-
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, recommended that said
planned development be approved subject to certain conditions and
restrictions.
NOW, THEREFORE, BE IT ORDATNED RV TUR PRH_gTJIF'MT zAMfl unAL'n
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the proposed single - family planned residential
ONE: development of the real estate legally described
as. follows:
Lot 51 in J.S. Hovland's First Addition to
Deerfield in the Southwest 1/4 of Section 32,
Township 43 North, Range'12, East of the Third
Principal Meridian in Lake County, Illinois.
as set forth and described on the attached plan of development and
preliminary plat of resubdivision, which plan and plat of resubdivi-
sion are made a part of this Ordinance, be and it is hereby approved
subject to the conditions and restrictions hereinafter set forth.
SECTION That the approval of said planned development
TWO: is conditioned upon the following:
A. That the Owner dedicate the West 30 feet of Lot 51
to the Village of Deerfield as and for street purposes, and that,
prior-to the issuance of a building permit for any portion of
Lot 51, as the same may be resubdivided, the Owner shall deposit
sufficient funds in escrow with the Village or make other
provisions satisfactory to the Village to insure the payment of
their proportionate share of -the installation of full street
improvements in accordance with the applicable provisions of the
Village Code for the proposed street to be constructed on the
West 30 feet of said> Lot 51.
'SECTION That the approval of the planned development
TI.T REE:, hereby given is subject to the further condi-
tion that the Owner submit for approval a final plat of resubdivi-
sion of the real estate described in Section One hereof and, except
as otherwise provided in this Ordinance, comply with all require-
ments of the Village Code of the Village of Deerfield necessary for
the approval of said final plat.
SECTION That all ordinances or parts of ordinances in
FOUR:. conflict herewith are, to the extent of such
conflict, hereby repealed.
SECTION That the Village Clerk is hereby directed to
FIVE: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
SIX: Effect from and after ii:s passage, approval
and publication as provided by law.
