AN ORDINANCE AMENDING A SPECIAL USE
(DEERBROOK II RECREATIONAL BUILDING)
WHEREAS, the Plan Commission.of the Village of Deerfield
has heretofore held a public hearing on the application of
JOSEPH E. VALENTI and NORTHWEST NATIONAL BANK OF CHICAGO, as Trustee
under Trust No. 122, to amend an existing special use approved for
certain premises commonly known as the Deerbrook Shopping Center and
hereinafter described,.by amending the Plan of Development so as to
provide for the construction of the proposed Recreational Center
Building apart from the existing mall structure and as a separate
structure located along the westerly property line, which relocation
of said structure would not alter the total buildable area as
originally approved, under and pursuant to the provisions of
Sections XIII,D,3,S; XIII,D14; XIII,D,5; XXIII,B,2 and XXIII,B,3 of
'the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, made written findings of
fact including express affirmative findings of compliance with the
provisions of Sections XIII,D,5 and XXIII,B,3 of the Village Zoning
Ordinance and recommended that said amendment to the special use
approved for said real estate be approved and authorized subject
to the conditions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
'SECTI'ON That the findings and recommendation of the Plan
ONE: Commission are concurred in and adopted as the
findings o? the President and Board of Trustees and the amendment of
the approved special use of the real estate legally described as
follows:
That part of the Northeast 1/4 of Section 4,
Township 42 North, Range 12, East of the Third
P.M., described as follows: beginning at the
intersection of the North line of the Northeast
1/4 of said Section 4, and the centerline of
Waukegan Road; thence West on the North line
of the Northeast 1/4 of said Section 4, 793.80
feet, said point being on the Easterly line
extended Northerly of Downey's Country Home
Addition to Deerfield, a Subdivision of part of
the North 1/2 of Section 4, Township 42 North,
Range 12, East of the Third P.M.; thence Southerly
on the Easterly line of said Downey's Country
Home Addition to Deerfield, 1174.0 feet to the
Southeasterly corner of said subdivision; thence
East parallel to the North.line of the Northeast
1/4 of Said Section 4, 830.09 feet to the center
of Waukegan Road; thence Northerly on the center
of Waukegan. Road 1190.04 feet to the place of
beginning excepting from the above tract of land
the North 50.0 feet and the Easterly 50 feet
thereof dedicated for Public roadway, in Cook
County, Illinois.
That part of the North 1/2 of Section 4, Township
42 North, Range 12, East of the Third P.M.,
described as: Commencing at the Southwest corner
of Downey's Cook County Country Home Addition to
Deerfield, being a subdivision of part of the
North 1/2 of said Section 4, and running thence
South 25�degrees 13 minutes 30 seconds East along
the Easterly right- of- way:line of Chicago, Milwaukee,
St. Paul and Pacific Railroad 365.03 feet to its
point of intersection with the Northerly right -of -way
line of the Northern Illinois Toll Highway thence
South 59 degrees 08 minutes 30 seconds East along
said Toll Highway Northerly right -of -way line
1259.80 feet; thence North 85 degrees 48 minutes
35 seconds East 855.62 feet to the point of inter-
section with the Westerly line of Waukegan Road
(said Westerly line being 33 feet Westerly of,
measured perpendicularly and parallel with the
Centerline of said road, as occupied), thence
North 27 degrees 07 minutes 05 seconds West along
said Westerly line 1028.59 feet to its point of
intersection with the South line of said Downey's
Subdivision extended easterly; thence South 89 degrees
56 minutes 30 seconds West along said Easterly
extension and said South line of said Subdivision
1621.44 feet to the place of beginning in Cook
County, Illinois.
so as to authorize the construction of the proposed Recreational
Center Building apart from the existing mall structure and as a
separate structure located along the westerly property line in
accordance with the Plan of Development marked Exhibit A and attached
hereto and made a part hereof, subject to the conditions hereinafter
set forth, be and the same is hereby approved.
SECTION That the approval and authorization of said

requireme-n-F- that all use, construction and development shall be in
accordance with all plans and representations submitted and made
by Applicant to the Plan Commission and President and Board of
Trustees and is subject to compliance by Applicant with all other
applicable provisions of the Zoning Ordinance and all other appli-
cable ordinances of the Village of Deerfield.
SECTION That the Village Clerk is hereby directed to
THREE: publish this Ordinance in pamphlet form and to
record a certified copy of this Ordinance in the office of the
Recorder of Deeds of the County in which the real estate hereinabove
described is situated.
SECTION That this Ordinance shall be '";in full force and
FOUR: effect from and after its passage, approval and
publication, as provided by law.
