ORDINANCE NO. 0 -73 =19
AN ORDINANCE AMENDING SECTIONS XVII,C,2 AND XVII,C,4
OF THE ZONING 'OR'DINANCE 'OF DEERFIELD ' ' ' '
WHEREAS, the Plan Commission of the Village of Deerfield,
pursuant to proper notice as provided by statute and ordinance,'
has held public hearings upon the subject matter of certain amend-
ments to the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the said Plan Commission has recommended that the
Corporate Authorities amend said Zoning Ordinance in the manner
hereinafter provided.
.NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS AS FOLLOWS:
SECTION That Section XVII,C,2 of the Zoning Ordinance 'of
ONE the Village of'Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended by striking said
Section in its entirety and substituting 'in lieu thereof the
following:
XVII,C,2 FLOOD BASE ELEVATION:
Flood Base Elevation, as used herein, shall mean
that elevation of the flood plain, as shown for
specific locationson the "Flood Plain Topographical
Map - North.Branch of the Chicago River, Lake and
Cook Counties, Illinois, 1972," prepared by the
United States Department of Agriculture; Soil
Conservation Service and on file 'in the office 'of
the Building Commissioner. The controlling flood
base elevation for any building site shall be'
the same as the flood base elevation, as inter-
polated by the Building Commissioner, -at the
nearest point of the water course as measured on
a line.perpendicular to the direction of the
water course or as otherwise indicated on said
Flood Plain Topographical Map.
SECTION That Section XVII,C.of the Zoning Ordinance of
TWO:. the Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended by adding a new
Subsection XVII,C,4 as follows:
XVII,C,4 FLOOD -WAY
a. No building or structure of any kind shall
be erected or maintained or moved within
that area of a flood plain hereinafter
described and designated as the flood -way,
and no fill, material or substance of any
kind shall be deposited on any premises
within the flood -way without a permit
issued by the Building Commissioner and
then only if an equivalent amount of
material is removed from the premises and
the deposited material is spread or other-
wise deposited in such a manner as not to
cause any greater obstruction to flood
waters than the condition of the premises
prior to such deposit. The provisions of
this paragraph shall not be applicable to
the reconstruction of buildings and
structures which have been destroyed by fire
or other casualty, providing reconstruction
is commenced within one (1) year of the
date of destruction.
b. The term "flood -way; as used in this
Section, shall mean that portion of the
flood plain outlined and identified as
"flood - way" on the Flood Plain Topographical
Map - North Branch of the Chicago River,
Lake and Cook Counties, Illinois, 1972,
prepared by the United States Department
of Agriculture, Soil Conservation Service
and on file in the office of the Building
Commissioner.
SECTION That all ordinances or parts of ordinances in
THREE: conflict herewith are, to the extent of such
conflict, hereby repealed.
'SECTION That the Village Clerk is hereby directed to
FOUR: publish this Ordinance in pamphlet form.
''SECTI'ON That this Ordinance shall be'in full force and
'FIVE: effect from and after its passage; approval and
publication--as-'Provided by law.
