AN ORDINANCE APPROVING AN AMENDMENT TO A SPECIAL USE PERMIT
FOR AN INDUSTRIAL PLANNED UNIT DEVELOPMENT AND AN AMENDMENT
TO A FINAL DEVELOPMENT PLAN TO ALLOW THE CONSTRUCTION OF AN
INNOVATION CENTER AT THE WALGREENS CAMPUS IN
THE I-1 OFFICE RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT
(100, 102, 104, 106, 108, 200, 300, 302 and 304 Wilmot Road)
WHEREAS, Walgreens Co., an Illinois corporation ("Applicant'), is the record
owner and occupant of that certain property located at 100, 102, 104, 106, 108, 200, 300, 302
and 304 Wilmot Road, in Deerfield, Illinois, and legally described in Exhibit A attached and,
by this reference, made a part of this Ordinance ("Property'); and
WHEREAS, the Property is located in the I-1 Office, Research, and Restricted
Industrial District ("I-1 District'); and
WHEREAS, on September 18, 2000 the Village Board adopted Ordinance No. 0-00-
33 approving a special use permit ("Special Use') and approving a final development plan
for the development and maintenance of an Industrial Planned Unit Development
("Walgreens PUD') for the Property, which Final Development Plan has been amended
from time to time ("Final Development Plan'); and
WHEREAS, the Applicant desires to construct a 14,240 square foot addition to the
building located at 100 Wilmot Road known as the Central Plant Building, and to make
necessary landscaping, parking, and other site changes on the Property in order to relocate
the Innovation Center from its campus in Northbrook, Illinois, to the Property (collectively,
"Proposed Development'); and
WHEREAS, pursuant to Sections 12.09-G and 13.11 of the Zoning Ordinance, the
Applicant has filed an application with the Village for preliminary and final approval of an
amendment to the Special Use ("PUD Amendment's and Final Development Plan
("Amended Final Development Plan') to permit the Applicant to construct the Proposed
Development ("Requested Relief); and
WHEREAS, a public hearing of the Plan Commission of the Village of Deerfield to
consider the Requested Relief was duly advertised in the Deerfield Review on December 9,
2021, and held on February 10, 2022; and
WHEREAS, on February 10, 2022, the Plan Commission adopted Findings of Fact,
recommending that the Village Board approve the Requested Relief; and
WHEREAS, the Village Board has determined that the Requested Relief complies
with the required standards for amendments of planned unit developments as set forth in
Articles 12 and 13 of the Zoning Ordinance; and

WHEREAS, consistent with the Plan Commission recommendation, the Village
Board has determined that it will serve and be in the best interests of the Village and its
residents to approve the Requested Relief in accordance with, and subject to, the conditions,
restrictions, and provisions of this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as the findings of the Village Board.
SECTION TWO: APPROVAL OF AMENDMENT TO SPECIAL USE
PERMIT. Subject to, and contingent upon, the conditions, set forth in Section Four of this
Ordinance, the Village Board hereby approves the PUD Amendment for the Property, in
accordance with, and pursuant to, Article 12 of the Zoning Code and the home rule powers of
the Village.
SECTION THREE: APPROVAL OF AMENDED FINAL DEVELOPMENT
PLAN.
A. Approval of Amendment. Subject to, and contingent upon, the conditions,
restrictions, and provisions set forth in Section Four of this Ordinance, the
Village Board hereby amends the Final Development Plan for the Walgreens
PUD to include the following documents (collectively, the "Amended Final
Development Plan Documents'):
1. "Site Plan" prepared by Kimley-Horne and Associates, Inc., consisting
of one sheet, with a latest revision date of December 23, 2021, a copy of
which is attached to this Ordinance as Exhibit B;
2. The "South Dock Truck Route" prepared by Kimley-Horne and
Associates, Inc., consisting of one sheet, with a latest revision date of
December 23, 2021, a copy of which is attached to this Ordinance as
Exhibit Q
The "Emergency Vehicle Exhibit" prepared by Kimley-Horne and
Associates, Inc., consisting of one sheet, with a latest revision date of
December 23, 2021, a copy of which is attached to this Ordinance as
Exhibit D;
4. The "Grading Plan," prepared by Kimley-Horne and Associates, Inc.,
consisting of one sheet, with a latest revision date of December 23, 2021,
a copy of which is attached to this Ordinance as Exhibit E; and
The "Landscape Exhibit" prepared by Kimley-Horne and Associates,
Inc., consisting of one sheet, with a latest revision date of December 23,
2021, a copy of which is attached to this Ordinance as Exhibit F;

6. The "100 Wilmot Road Addition" prepared by Ingenii, LLC, consisting
of twelve sheets, with a latest revision date of December 23, 2021, a
copy of which is attached to this Ordinance as Exhibit G;
7. The "Photometric Plan" prepared by Kimley-Horne and Associates, Inc.,
consisting of one sheet, with a latest revision date of December 23, 2021,
a copy of which is attached to this Ordinance as Exhibit H; and
9. The "Proposed Fixture Floor Plan" prepared by Inginii, LLC, consisting
of one sheet, with a latest revision date of December 23, 2021, a copy of
which is attached to this Ordinance as Exhibit I; and
10. The "Key Plan" prepared by Inginii, LLC, consisting of one sheet, with
a latest revision date of December 23, 2021, a copy of which is attached
to this Ordinance as Exhibit J;
11. The "Dimensional Floor Plan" prepared by Kimley-Horne and
Associates, Inc., consisting of one sheet, with a latest revision date of
December 23, 2021, a copy of which is attached to this Ordinance as
Exhibit K; and
12. The "Utility Plan" prepared by Kimley-Horne and Associates, Inc.,
consisting of one sheet, with a latest revision date of December 23, 2021,
a copy of which is attached to this Ordinance as Exhibit L.
B. Conflicts. In the event that any of the Amended Final Development Plan
Documents conflicts with the Final Development Plan, the Amended Final
Development Plan Documents control.
SECTION FOUR: CONDITIONS. Notwithstanding any use or development
right that may be applicable or available pursuant to the provisions of the Village Code or
the Zoning Ordinance, or any other rights the Applicant may have, the approvals granted in
Sections Two and Three of this Ordinance are hereby expressly subject to and contingent
upon the redevelopment, use, and maintenance of the Property in compliance with each and
all of the following conditions
A. Compliance with Plans. The redevelopment, use, operation, and maintenance
of the Property must comply with the Final Development Plan, as amended by
the Amended Final Development Plan Documents, except for minor changes
approved by the Village Principal Planner in accordance with all applicable
Village standards.
B. Compliance with Regulations. The redevelopment, use, operation, and
maintenance of the Property must comply with all applicable Village codes and
ordinances, as such codes and ordinances have been or may be amended from
time to time.
C. Reimbursement of Village Costs. In addition to any other costs, payments,
fees, charges, contributions, or dedications required under applicable Village

codes, ordinances, resolutions, rules, or regulations, the Applicant must pay to
the Village, promptly upon presentation of a written demand or demands
therefor, all legal fees, costs, and expenses incurred or accrued in connection
with the review, negotiation, preparation, consideration, and review of this
Ordinance. Payment of all such fees, costs, and expenses for which demand
has been made must be made by a certified or cashier's check. Further, the
Applicant will be liable for, and must pay upon demand, all costs incurred by
the Village for publications and recordings required in connection with the
aforesaid matters.
SECTION FIVE: RECORDATION, BINDING EFFECT. A copy of this
Ordinance shall be recorded against the Property in the Office of the Lake County Recorder
of Deeds. This Ordinance and the privileges, obligations, and provisions contained herein
run with the Property and inure to the benefit of, and are binding upon the Applicant and its
heirs, representatives, successors, and assigns.
SECTION SIX: FAILURE TO COMPLY WITH CONDITIONS. Upon the
failure or refusal of the Applicant to comply with any or all of the conditions, restrictions, or
provisions of this Ordinance, in addition to all other remedies available to the Village, the
approval granted in Section Two of this Ordinance ("Approval') may, at the sole discretion
of the Village Board, by ordinance duly adopted, be revoked and become null and void;
provided, however, that the Village Board may not so revoke the Approval unless it first
provides the Applicant with two months advance written notice of the reasons for revocation
and an opportunity to be heard at a regular meeting of the Village Board. In the event of
such revocation, the Village Manager and Village Attorney are hereby authorized and
directed to bring such zoning enforcement action as may be appropriate under the
circumstances. Notwithstanding the foregoing or anything else contained in this Ordinance,
neither the Applicant's failure to comply with this Ordinance, nor anything else contained
herein, shall affect or restrict the Applicant's rights to use the Property as otherwise
permitted by the Zoning Ordinance.
SECTION SEVEN: AMENDMENTS. Any amendment to any provision of this
Ordinance may be granted only pursuant to the procedures, and subject to the standards and
limitations, provided in the Zoning Ordinance for the granting of planned unit development
approvals.
SECTION EIGHT: EFFECTIVE DATE. This Ordinance will be effective only upon
the occurrence of all of the following events:
A. Passage by the Village Board by a majority vote in the manner required by
law;
B. Publication in pamphlet form in the manner required by law; and
C. Recordation of this Ordinance; together with such exhibits as the Village Clerk
deems appropriate for recordation, with the office of the Lake County Recorder.
