AN ORDINANCE APPROVING A SPECIAL USE TO PERMIT
THE ESTABLISHMENT OF A HOBBY LOBBY RETAIL STORE OVER
30,000 SQUARE FEET IN AREA AND AN AMENDMENT TO THE
DEERBROOK SHOPPING CENTER PLANNED UNIT DEVELOPMENT
WHEREAS, Mid -America Asset Management, Inc., and Hobby Lobby Stores, Inc. (the
"Applicants'), being the owner and proposed tenant of the property legally described on Exhibit A
attached hereto (the "Subject Property") have petitioned the Plan Commission of the Village of
Deerfield for a Special Use of the Subject Property authorizing the establishment and operation of
a Hobby Lobby retail store over 30,000 square feet in area in the former Best Buy space in the
Deerbrook and an amendment to the Deerbrook Shopping Center Planned Unit Development in
the C-2 Outlying Commercial, including (i) a sign variation to allow the east wall sign to be
installed and maintained to a height of 4 feet 5 inches above the roof deck of the building, and (ii)
a waiver of the sign criteria for Deerbrook Shopping Center to permit the Hobby Lobby wall signs
to use the color orange; and
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
January 8, 2015 to consider said Special Use and amendment to the Deerbrook Shopping Center
Planned Unit Development, said hearing being held pursuant to public notice and conforming in
all respects, in both manner and form, with the requirements of the statutes of the State of Illinois
and the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the

testimony, documentary evidence and supporting materials offered at said public hearing, filed its
report with the President and Board of Trustees containing its written findings of fact and
recommendation that the requested Special Use and amendment to the Deerfield Shopping Center
Planned Unit Development be authorized pursuant to Section 5.02-C, Paragraph 1, Subparagraph
in, Article 12.09-G and Article 13.11 of the Zoning Ordinance of the Village to allow a Hobby
Lobby retail store over 30,000 square feet in area to be established in the former Best Buy space as
an amendment to the Deerbrook Shopping Center PUD, including (i) a sign variation to allow the
east wall sign to be installed and maintained to a height of 4 feet 5 inches above the roof deck of the
building, and (ii) a waiver of the sign criteria for Deerbrook Shopping Center to permit the Hobby
Lobby wall signs to use the color orange; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by the authorization and granting of
said Special Use and amendment to the Deerbrook Shopping Center Planned Unit Development,
including (i) a sign variation to allow the east wall sign to be installed and maintained to a height of
4 feet 5 inches above the roof deck of the building, and (ii) a waiver of the sign criteria for
Deerbrook Shopping Center to permit the Hobby Lobby wall signs to use the color orange, all in
accordance with the plans, representations and supporting materials submitted by the Applicant
which are incorporated herein and made a part hereof by this reference.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are
hereby incorporated and made a part of this Ordinance as if fully set forth herein.

SECTION 2: That the President and Board of Trustees do hereby affirmatively find the
proposed Hobby Lobby retail store, hereby authorized as a Special Use of the Subject Property and
as an amendment to the Deerbrook Shopping Center Planned Unit Development in the C-2
Outlying Commercial District, fully complies with the requirements and standards for special uses
and planned unit developments set forth in Article 5.02-C, Paragraph 1, Subparagraph in, Article
12.09-G and Article 13-11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 3: That the President and Board of Trustees of the Village of Deerfield do
hereby authorize and approve, subject to the conditions, regulations and restrictions set forth in
Section 4 of this Ordinance, a Special Use permitting the establishment of a Hobby Lobby retail
store over 30,000 square feet in area as a Special Use of the Subject Property in the Deerbrook
Shopping Center Planned Unit Development, and an amendment to the Deerbrook Shopping
Center Planned Unit Development in the C-2 Outlying Commercial District, including (i) a sign
variation to allow the east wall sign for the Hobby Lobby retail store to be installed and maintained
to a height of 4 feet 5 inches above the roof deck of the building, and (ii) a waiver of the sign
criteria for Deerbrook Shopping Center to permit the Hobby Lobby wall signs to use the color
orange.
SECTION 4: That the approval and authorization of a Special Use for a Hobby Lobby
retail store and amendment to the Deerbrook Shopping Center Planned Unit Development is
granted pursuant to Article 5.02-C, 1, in, Article 12.09-G and Article 13.11 of the Zoning
Ordinance of the Village of Deerfield subject to the following conditions, regulations and
restrictions: (i) the establishment, operation, maintenance and use of the Subject Property as a
Hobby Lobby retail store shall be in accordance with the plans and supporting materials attached
hereto and made a part of this Ordinance as Exhibit B hereof; (ii) compliance by the Applicants

with all representations made and submitted by the Applicants to the Plan Commission and to the
President and Board of Trustees of the Village of Deerfield; (iii) compliance with the
recommendations of the Appearance Review Commission; (iv) continued compliance with the
final requirements of the Deerbrook Shopping Center Planned Unit Development, as hereby
amended; and (v) compliance by the Applicants with all other applicable provisions of the Zoning
Ordinance of the Village of Deerfield.
SECTION 5: That the approval of a Hobby Lobby retail store as a Special Use of the
Subject Property and as an amendment to the Deerbrook Shopping Center Planned Unit
Development in the C-2 Outlying Commercial District as hereby authorized shall be binding upon
and inure to the benefit of the Applicants, Applicants' successors, grantees, transferees and
assigns, and any violation of this Ordinance or of the conditions, regulations and restrictions set
forth herein by the Applicants or their successors, grantees, transferees or assigns shall authorize
the revocation of the Special Use as hereby authorized.
SECTION 6: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of
Cook County, Illinois at Petitioner's expense.
SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non -preemptive state law; or, (b) legislate
in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of
the corporate authorities of the Village of Deerfield that to the extent that the terms of this
Ordinance should be inconsistent with any non -preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.

SECTION 8: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.

DESCRIPTION
The patent pending Lumark Crosstour- MAXX LED Wall Pack Series
of luminaries provides low -profile architectural style with super bright,
energy -efficient LEDs. The rugged die-cast aluminum construction,
back box with secure lock hinges, stainless steel hardware along with a
sealed and gasketed optical compartment make Crosstour impervious
to contaminants. The Crosstour MAXX wall luminaire is ideal for wall/
surface, inverted mount for facade/canopy illumination, perimeter and
site lighting. Typical applications include pedestrian walkways, building
entrances, multi -use facilities, industrial facilities, perimeter parking
areas, storage facilities, institutions, schools, and loading docks.

Back box includes four (4) 112" NPT
threaded conduit entry points. The
back box is secured by four (4) lag
bolts (supplied by others). External
fin design extracts heat from the
fixture surface. One-piece silicone
gasket seals door and back box.
Not recommended for car wash
applications.
