AN ORDINANCE AUTHORIZING A SPECIAL USE
TO PERMIT THE ESTABLISHMENT OF A RELIGIOUS
COUNSELING, INSTRUCTION AND EDUCATION OFFICE
AT 747 LAKE COOK ROAD IN THE I-1 OFFICE, RESEARCH
AND RESTRICTED INDUSTRIAL DISTRICT

WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
January 23, 2014 on the application of L'Chaim Center for Inspired Living, Inc. (the
"Applicant") for approval of: (A) a special use pursuant to Article 6.01-C, Paragraph 18, and
Article 13.11 of the Zoning Ordinance of the Village of Deerfield to permit the establishment and
operation of an approximately 2,650 square foot religious counseling, instruction and education
office on property located at 747 Lake Cook Road in the I-1 Office, Research and Restricted
Industrial District, said property being described on Exhibit A attached hereto (the "Subject
Property"); and (B) a variation to permit the provision of 54 total parking spaces for the uses on
the Subject Property in lieu of the 59 spaces otherwise required for the Subject Property; and
WHEREAS, said public hearing was held pursuant to public notice duly given and
published as required by statute and conforming in all respects, in both manner and form, with
the Zoning Ordinance of the Village Deerfield; and
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
evidence, testimony and supporting materials offered at said public hearing, filed its report with
the President and Board of Trustees containing its written findings of fact and recommendations
that: (A) the requested special use be authorized pursuant to Article 6.01-C, Paragraph 18, and
Article 13.11 of the Zoning Ordinance of the Village of Deerfield to allow an approximately
2,650 square foot religious counseling, instruction and education office for L'Chaim Center for
Inspired Living to be located, established and operated by Applicant as a Special Use of the
Subject Property in the I-1 Office, Research and Restricted Industrial District, and (B) a variation
be authorized as a condition of said Special Use to permit the provision of 54 total parking
spaces for the uses on the Subject Property in lieu of the 59 spaces otherwise required for the
Subject Property; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the proposed Special Use for the Subject Property fully complies with the
requirements and standards set forth in Article 6.01-C, Paragraph 18, and Article 13.11 of the
Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be
served by the authorization and granting of said Special Use and parking variation as provided
herein and in accordance with the plans and supporting materials submitted by the Applicant
which are incorporated herein and made a part hereof by this reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby affirmatively find that
the Special Use and parking variation as hereby authorized fully comply with the requirements
and standards set forth in Article 6.01-C, Paragraph 18, and Article 13.11 of the Zoning
Ordinance of the Village of Deerfield.

SECTION 2: That the President and Board of Trustees do hereby authorize and approve
the establishment of an approximately 2,650 square foot religious counseling, instruction and
education office at 747 Lake Cook Road as a Special Use of the Subject Property in the I-1
Office, Research and Restricted Industrial District, including approval of a variation to permit the
provision of 54 parking spaces for the uses on the Subject Property in lieu of the 59 spaces
otherwise required for the Subject Property, all subject to the conditions, regulations and
restrictions set forth in Section 3 of this Ordinance.
SECTION 3: That the approval and authorization of said Special Use is granted subject
to the following conditions, regulations and restrictions:
(a) the establishment, development, maintenance and use of the Subject Property for
said Special Use shall be accordance with the plans and supporting materials attached
hereto and made a part of this Ordinance as Exhibit B hereof, and with all representations
made and submitted by the Applicant to the Plan Commission and to the President and
Board of Trustees of the Village of Deerfield;
(b) compliance by the Applicant with all requirements of the Zoning Ordinance of the
Village of Deerfield.
SECTION 4: That the Special Use as hereby authorized shall be binding upon and inure
to the benefit of Applicant and Applicant's successors, grantees, transferees and assigns, and any
violation of this Ordinance or the conditions, regulations and restrictions set forth herein by the
Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the
Special Use as hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds
of Cook County, Illinois at applicants' expense.

SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non -preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non -preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.

Special Use Criteria
[!Chaim Center for Inspired Living, Inc.
747 lake Cook Rd, Units 209, 211 and 219
1. Compatible with Existing Development
L'Chaim Center for Inspired Living, Inc. is seeking to open a center in the office building located
at 747 Lake Cook Rd. in units 219 as well as either unit 201 or 209/211, all of which are
currently unoccupied. Please refer to the attached graphic illustration of the location. No
alteration to the structure (exterior) shall be sought. UChaim Center offers evening classes on
topics of Jewish interest to adults. UChaim Center offers religious counseling, instruction, and
educational activities. The great majority of the usage will be in the evenings, from 7:30 to 9:15
pm. The building is completely vacant during these hours and for that reason our goals will not
interfere in anyway with the current usage of the building. In addition, we have a monthly
program which includes a Friday night gathering as well as a Saturday gathering during the day.
The building is otherwise empty during these times as well and will therefore not impede any
current usage of the building. Our programs are generally attended by 20 to 40 people. The use
Is not intensive by nature and is in keeping with surrounding uses. No unusual noises, odors or
other "compatibility" issues are expected with the proposed use. The proposed use will, in no
way, impede the normal and orderly development and improvement of surrounding property,
Details of activity:
On Tuesday nights we have a class, given.by Rabbi David Begoun, on topics of Jewish interest.
This class begins at 7:45 pm. People begin arriving at 7:30. The class ends at 9:00 pm and
people leave no later than 9:15. This class is usually attended by 40 people, primarily couples
who arrive in one car. The total number of cars never exceeds 30. During this time, the building,
as well as the parking lot, are empty.
On Wednesday mornings we offer a class taught by Rabbi David Begoun and, in an alternating
fashion, by Mrs. Ali Begoun. This class is attended by 8 to 10 women who usually arrive in no
more than 6 cars. The class begins at 10:30 and is over by noon.
On Wednesday evenings Rabbi David teaches a class attended by 9 to 10 men who usually
arrive in no more than 9 cars. This class is from 7:30 pm until 9:00 pm. The building and lot are
otherwise empty during this time.
In addition to these classes, VChaim Center also offers personal coaching and one-on-one study
opportunities during the daytime hours.
Once a month, L'Chaim Center offers a program called Friday Night Live. It is a Sabbath program
for adults and families. It includes a _program on Friday night usually attended by SO people as
well as on Saturday, usually attended by 40 people. Guests attending the program rent rooms
in the Marriot Courtyard which is across the street from this location and they will mostly be
leaving their cars at the hotel and walking across the street. Driving is discouraged on the
Jewish Sabbath and very few cars will be arriving during that time. There is a possibility that we
may not conduct this Friday Night Live program at the new location but would have it remain in
its current,location which is a hotel in the area.
As time goes on there is a possibility that we may add more classes or programs but they will be
on similar "off hours" and will always be consistent with our goal of providing religious
counseling, instruction, and educational activities.
The Northbrook fire department has told us that we are allowed to have 1 person per square
foot in a classroom setting. This is the way all our programs are set up. That means that we
could have up to 90 people in the either suites 201 or 209/211 and up to 40 In suite 219.Our
programs will not exceed these numbers.
These are the proposed uses for the center. It is our strong conviction that this programming
will be completely compatible with the current use of the building and will not cause any
"compatibility" issues.
2. Lot of Sufficient Size
The allotted space is plenty for our needs as well as all the collective needs of all the tenants in
the building and no changes to the lot or exterior suite dimensions are being sought.
3. Traffic
Our programs and usage will not have any significant impact or effect on surrounding
properties or traffic flow. No modifications are being sought. I do not believe it is necessary to
conduct a traffic study as the flow of traffic will be quite minimal.
4. Parking and Access
No changes to the parking lot are being sought. Parking is ample and more than adequate for
our needs as well as all the collective needs of all the tenants in the building. The times of our
heavier usage are times when the building and lot are otherwise empty. There is a side
entrance to the building next to the parking. lot which is located just a few feet away from the
entrance to the unit that we are seeking to rent. The result is excellent, easy access from the
parking lot directly to our desired location in the building. No changes to access are being
sought as the current situation already maximizes flow and safety.
S. Effect on Neighborhood
The proposed use by L'Chaim Center will have no significant impact or effect on the
neighborhood in any way. There will be no visual issues nor will there be an issues of sound,
odor, or any other forms of obstruction.
6. Adequate facilities
Adequate utilities, access roads, drainage and other facilities are being provided and no
changes are being sought.
7. Adequate Buffering
Adequate fencing and/or screening is currently provided to ensure the enjoyment of
surrounding properties, provide for public safety and screen parking areas.

The L'Chaim Center would like to respectfully request that the second reading of the
ordinance be waived so that the final approval for our project be approved upon the first
reading on March 3, 2014. This accommodation would allow us to begin the necessary
minor renovations in our location so that we can be open for business on our projected
date of April 1, 2014. This is the day that our lease officially begins and we would like to
begin our operations as close to that date as possible. Waving the second reading
would significantly increase our likelihood of achieving that goal. We can then begin ser-
vicing the cor?munit (.-in the many ways that we have enumerated at previous meetings.
