ORDINANCE NO. 2021- 0-21-43
AN ORDINANCE AMENDING SECTIONS 9-24 AND 9-24A OF
"THE DEERFIELD CODE OF ORDINANCES," AS AMENDED, REGARDING
PURCHASING PROCEDURES AND DISPOSAL OF SURPLUS PROPERTY
WHEREAS, the Village is a home rule municipal corporation in accordance with
Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and
WHEREAS, Section 9-24 of the Deerfield Code of Ordinances ("Village Code')
provides the Village Manager authority to make certain purchases and sets forth various
purchasing procedures; and
WHEREAS, the Village Board finds that it is prudent and more efficient to increase the
Village Manager's purchasing authority from $20,000 to $25,000 and to keep the Village Code
consistent with the Village's Purchasing Manual; and
WHEREAS, Section 9-24A of the Village Code sets forth the procedures for disposing
of surplus property; and
WHEREAS, the Village Board finds that it is prudent and more efficient to update
Section 9-24A to keep the Village Code consistent with the Purchasing Manual, which also
governs the disposal of surplus property; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interest of the Village to amend the Village Code pursuant to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LANE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: AMENDMENTS TO SECTION 9-24. Section 9-24, titled
"Manager's Authority for Purchasing and Tort Settlements," of Article 6, titled "Contracts,"
of Chapter 9, titled "Finance and Taxation," of the Village Code is hereby amended and to
further to read as follows:
"Sec. 9-24. Manager's Authority for Purchasing and Tort Settlements:
(a) Purchasing: All contracts for public works or improvements not to be
paid for in part or in whole by special assessment or special taxation

(b) Purchasing Manual: The Wlage Manage = Village Board shall
promulgate rules and procedures providing for the issuance of purchase
orders and awarding of contracts which, by the is Code, are

(c) Tort Settlements: The Village Manager, after first consulting with the
Board of Trustees, is authorized to negotiate, settle and compromise
any tort claims, actions or lawsuits made or asserted against the Village
of Deerfield pursuant to a written settlement agreement approved by
the Village Attorney that provides for or includes monetary payments
of not more than {$100,000.00) of Village
funds."
SECTION THREE: AMENDMENTS TO SECTION 9-24A. Section 9-24A, titled
"Authority to Dispose of Surplus Property," of Article 6, titled "Contracts," of Chapter 9, titled
"Finance and Taxation," of the Village Code is hereby amended and to further to read as
follows:
"Sec. 9-24A. Authority to Dispose of Surplus Property:
The Village Manager is authorized to dispose of all surplus personal property
or equipment of the Village having an estimated value not in excess of ten
thousand dollars ($10,000.00) in accordance with the procedures set forth in
the Purchasing Manual pramulgated by the Manager- adopted pursuant to
Section 9-24(h) of this Code;. provided that the Manager has determined

SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage, approval, and publication in the manner provided by law.
