ORDINANCE NO. 0 -71 -58
AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF THE ZONING ORDINANCE WITH
RESPECT TO THE PROPERTY LOCATED AT
725 WAUKEGAN ROAD, DEERFIELD, ILLINOIS
(First National Bank)
WHEREAS, THE FIRST NATIONAL BANK OF DEERFIELD, has petitioned
for a certain variation from the strict provisions of the Zoning
Ordinance of the Village of Deerfield, passed May 4, 1953, as amended;
and
WHEREAS, pursuant to notice duly published, as required by
statute, a public hearing on said petition was held and conducted
by the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President
and Board of Trustees its written findings of fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
AS FOLLOWS:
SECTION That the findings of fact and recommendation of the
ONE: Zoning Board of Appeals are hereby concurred in and
adopted as the findings of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular
TWO: hardship in the way of carrying out the strict letter
of the provisions of the-Zoning Ordinance of the Village of Deerfield,
as applied to Petitioner's property, which is legally described as
follows:
That part of Lot 8 in the "Owner's First Addition to
Deerfield ",.being a subdivision of part of the North
half of Section 33, Township 43, North, Range 12 East
of the Third Principal Meridian according to the plat
thereof recorded September 25, 1915, as Document
161061 in Book "J" of plats, pages 46 & 47, described
as follows, to -wit: commencing at the Northeast corner
of said Lot 8 and running thence South three degrees
East on the East line oftsaid Lot, 88.5 feet; thence
South sixty nine degrees West 364.67 feet to the center,
of Lincoln Avenue; thence North thirty one degrees ten
minutes West along the center line of said Avenue
129.62 feet to the Northwesterly corner of said Lot
8 and thence Northeasterly to the place of beginning
(excepting therefrom that part thereof falling within
the limits of Lot 1 of "Lynn's Whittier Avenue
Subdivision ") Also Lot 9 (Except therefrom
the Easterly 50 feet thereof measured along a line
drawn at right angles to the East line of said
Lot 9) in aforementioned "Owner's First Addition,"
all being in Lake County, Illinois.
SECTION That a variation from the strict provisions of
THREE: Section XVII,B -3 -d of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended with respect
to the property hereinabove, is hereby granted so as to permit the
construction and maintenance of a free - standing sign in addition to
thatpermitted by ordinance, which sign may be double faced and shall
be located not nearer than two feet to the north property line and have
an area not to exceed 23 square feet per face, all in accordance with
plans persented and filed with the Zoning Board of Appeals.
SECTION That the variation hereby granted is subject to
FOUR: compliance by Petitioner with all other applicable
provisions of the Zoning Ordinance and all other applicable ordinances
of the Village.
SECTION That this Ordinance shall be in full force and effect
FIVE: from and after its passage and approval as provided
by law.
