AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF THE ZONING ORDINANCE WITH
RESPECT TO THE PROPERTY LOCATED AT
145 BIRCHWOOD AVENUE, DEERFIELD, ILLINOIS
WHEREAS, REGINALD DENLEY has petitioned for certain
variations from the strict provisions of the Zoning Ordinance
of the Village of Deerfield, passed May 4, 1953, as amended; and
WHEREAS, pursuant to notice duly published as required
by statute, a public hearing on said petition was held and con-
ducted by the Zoning Board of Appeals of the Village of Deerfield;
and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board -of Trustees its written findings of fact and
recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK
COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation
ONE: of the Zoning Board of Appeals are hereby con-
curred in and adopted as the findings of fact of the President and
Board of Trustees.
SECTION That there are practical difficulties and
TWO: particular hardship in the way of carrying out
the strict letter of the provisions of the Zoning Ordinance of the
Village of Deerfield, as applied to Petitioner's property, which
is legally.described as follows:
Lot 69 in the Subdivision of J.S. Hovland's 1st
Addition to Deerfield, a Subdivision of the SW
1/4, except the NW 1/4 of the NW 1/4 thereof,
of Section 32, Township 43 North, Range 12 East
of the Third Principal Meridian, in Lake County,
Illinois.
SECTION That variations from the strict provisions of
THREE: Sections VI -B -C -2 and XVIII -E of the Zoning
Ordinance of the Village of Deerfield, passed May 4, 1953, as amended
with respect to the property hereinabove, are granted so as to
permit an interior side yard of 3.46 feet to an existing building
in lieu of the required 10 feet, all in accordance with plans
presented and filed with the Zoning Board of Appeals.
SECTION_ That the variation hereby granted is subject
FOUR: to compliance by Petitioner with all other
applicable provisions of the Zoning Ordinance and all other appli-
cable ordinances of the Village.
SECTION That this Ordinance shall be in full force and
FIVEi effect from and after its passage and approval
as provided by law.
