AN ORDINANCE AMENDING THE ZONING MAP AND
AUTHORIZING CERTAIN EXCEPTIONS FOR A
PLANNED SHOPPING CENTER
(First Addition to Deerbrook)
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of Louis J. Werhane,
Olive Werhane, Frieda Werhane, Northwestern National Bank of Chicago
and Joseph E. Valenti for the classification of certain real estate
proposed to be annexed to the Village and hereinafter described, in the
B -1 Neighborhood Business District and the approval and authorization
of certain exceptions and variations from the otherwise applicable reg-
ulations of said District; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made certain findings of fact and
recommended that said real estate be classified in the B -1 Neighborhood
Business District and that certain exceptions and variations from the
otherwise applicable regulations be authorized and permitted subject to
certain conditions and restrictions; and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village will
be served by the classification of said real estate, as requested, and
that certain exceptions and variations from the otherwise applicable
regulations of this Ordinance are warranted subject to certain condi-
tions and restrictions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
AS FOLLOWS:
SECTION That the Zoning Map of the Village of Deerfield
ONE: included and made a part of the Village Zoning
Ordinance, passed May 4, 1953, as amended, is hereby
further amended by zoning and classifying the following described
property in the B -1 Neighborhood Business District:
That part of the North one -half (1/2) of Section
4, Township 42 North, Range 12, East of the Third
Principal Meridian, described as: Commencing
at the Southwest corner of Downey's Cook County
Country Home Addition to Deerfield, being a
subdivision of part of the North one -half (1/2)
of said Section 4, and running thence South 25 degrees
13 minutes, 30 seconds East along the Easterly
right -of -way line of Chicago, Milwaukee, St. Paul
and Pacific Railroad 365.03 feet to its point of
intersection with the Northerly right -of -way line
of the Northern Illinois Toll Highway; thence
South 59 degrees 08 minutes 30 seconds East along
said Toll Highway Northerly right -of -way line 1259.80
feet; thence North 85 degrees 48 minutes 35 seconds
East 855.62 feet to a point of intersection with the
Westerly line of Waukegan Road (said Westerly line
being 33 feet Westerly of, measured perpendicularly
and parallel with the center line of said road, as
occupied); thence North 27 degrees 07 minutes 05
seconds West along said Westerly line 1028.59 feet
to its point of intersection with the South line of
said Downey's Subdivision extended easterly; thence
South 89 degrees 56 minutes 30 seconds West along
said Easterly extension and said South line of said
subdivision, 1621.44 feet to the place of beginning
in Cook County, Illinois.
SECTION That certain exceptions and variations from the
TWO: otherwise applicable regulations of the Deerfield
Zoning Ordinance, as set forth and contained in a
certain Annexation Agreement dated May 16, 1970, by and between
the Village of Deerfield and Louis J. Werhane, Olive Werhane,
Frieda Werhane, Northwestern National Bank of Chicago and
Joseph E. Valenti (a copy of which marked Exhibit "A" is attached
hereto and made a part hereof), be and they are hereby approved,
authorized and granted provided that the exceptions and variations
hereby authorized are all subject to the conditions and restrictions
set -forth in said Annexation Agreement and to the strict compliance
by the Owners, Contract Purchaser and Developer, and their heirs,
successors and assigns with all the terms and provisions of said
Agreement.
SECTION That no building or other permits shall be approved
THREE: or issued with respect to the development of or
construction on the real estate hereinabove described
except as the applications, plans and specifications therefor are in
full compliance with the terms and conditions of said Annexation
Agreement, this Ordinance and all other applicable ordinances of the
Village except as modified or varied by the terms hereof, and no
change, modification or deviation shall be made from the terms and
provisions of this Ordinance and said Annexation Agreement which is
made a part hereof except upon the express approval of the President
and Board of Trustees of the Village of Deerfield; further no permits

for construction or development of the real estate hereinabove
described shall be issued unless at the time of issuance thereof
the Owners, Contract Purchaser and Developer and their heirs, suc-
cessors and assigns have currently complied with all requirements,
obligations and duties imposed upon them under the terms of this
Ordinance and said Agreement.
SECTION That all ordinances or parts of ordinances in conflict
FOUR: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and effect
SIX: from and after its passage, approval and publication,
as provided by law.
