AN ORDINANCE GRANTING A VARIATION FROM
THE PROVISIONS OF THE ZONING ORDINANCE
WITH RESPECT TO THE PROPERTY LOCATED AT
8.49 OSTERMAN AVENUE, DEERFIELD, ILLINOIS
WHEREAS,.HENRY J. SACK has petitioned for certain
variations from the strict provisions of the Zoning Ordinance
of the Village of Deerfield, passed May 4, 1953, as amended;
and
WHEREAS, pursuant to notice duly published as required
by statute, a public hearing on said petition was held and
conducted by the Zoning Board of Appeals of the Village of
Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board of Trustees its written findings of fact
and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of
ONE: the Zoning Board of Appeals are hereby concurred
in and adopted as the findings of fact of the
President and Board of Trustees.
SECTION That there are practical difficulties and
TWO: particular hardship in the way'of carrying out
the strict letter of the provisions of the
Zoning Ordinance of the Village of Deerfield as applied to
Petitioner's property which is legally described as follows:
The West 48 feet of.Lot fl'in Truesdell's second
addition to Deerfield in the Northeast quarter
of Section 32, Township 43 North, Range 12 East
of the Third Principal Meridian in Lake County,
Illinois
SECTION That a variation from the strict provisions
THREE: of Section XVIII -E of the Zoning Ordinance of
the Village of Deerfield, passed May 4,1953,
as amended with respect to the property hereinabove described
is hereby granted so as to permit the construction of an addi-
tion to the residence located on said property which will
result in one side -yard of four feet six and one -half inches
in lieu of the required five feet and combined side -yards of
eleven feet, seven and seven - eighths inches in lieu of the
required thirteen feet and all.in accordance with plans pre-
sented and filed with the Zoning Board of Appeals.
SECTION That the variation hereby granted is subject
FOUR: to compliance by Petitioner with all other
applicable provisions of the Zoning Ordinance
and all other applicable ordinances of the Village.
SECTION That this Ordinance shall be in full force and
FIVE: effect from and after its passage and approval,
as provided by law.
