AN ORDINANCE AMENDING ARTICLE VII
OF CHAPTER 17 OF THE MUNICIPAL
CODE OF THE VILLAGE OF DEERFIELD
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE.AND 000K COUNTIESy ILLINOIS, AS FOLLOWS:
SECTION That Article VII of Chapter 17 of the Municipal
ONE: Cole of Deerfield of 1963, as amended, be and
it is hereby further amended by striking said
Article VII in its entirety and substituting in lieu thereof the
following:
"Article VII. Scavengers
1117.701 License required.) It shall be unlawful for any
person, firm or corporation to engage in the business of collecting,
removing or disposing of garbage, refuse, garden waste or miscellaneous
waste in the Village of Deerfield without first having secured a license
therefor. (The terms garbage, refuse, garden waste and miscellaneous
waste shall be construed and have the same meaning as set forth in
Article II of Chapter 18 of the Code.)
1117.702 Applications.) Applications for such license
shall be made to the village manager and shall be referred by him
to the president and board of trustees; no such license shall be
issued except on order of the president and board of trustees. No
more than two such licenses shall be in force at any time in the
village. Each application shall be accompanied by the following:
a) a list of communities presently served by the
applicant
b) satisfactory evidence of the availability to the
applicant for the full license period of a sanitary
landfill site at which all refuse collected in and
removed from the village may be disposed of
and evidence that such landfill is operating in
accordance with all applicable state, county and
local regulations
c) a list of the equipment to be used to render the
service in the event a license is issued
indicating the make, year, size and condition$
of each vehicle
"17.703 Fees.) The fee for such license or permit shall be
twenty -five dollars per year per truck.
"17.704 Insurance required.) No license shall be issued
under the provisions of this article unless -the applicant for such
license has first submitted proof of insurance in the form of a
certificate of insurance issued by an insurer duly authorized to
issue such policies in the State of Illinois. Such certificates
shall show that the applicant for a license has public liability
insurance covering his operation within the village and Workmen's
Compensation coverage of applicant's employees, shall show the dates
of expiration of such insurance and shall certify that the same shall
not be cancelled without -at least two days' notice to the village
manager. Upon the cancellation or expiration without renewal of such
insurance, the license or permit issued hereunder to the insured shall
be void. Such public liability insurance shall be in the amount of
not less than $300,000 per person insured,.not less than $500,000 for
all personal injuries in any one accident, and not less than $50,000
for property damage in any one accident; Workmen's Compensation
insurance shall be in accordance with state law.
''17.705 Bond.) No scavenger license shall be issued unless
the applicant therefor shall file a performance bond with sureties
approved by the board of trustees, in the sum of two hundred thousand
dollars, with the village as beneficiary, conditioned upon the
licensee's compliance with all applicable laws, ordinances, rules and
regulations and in particular without limiting the generality of the
foregoing, the following terms and conditions of the services to be
rendered:
(a) The licensee will have at least one vehicle in operation
in collecting garbage, refuse and waste a minimum of five days each
week except.for holidays.
(b) Collection will be made of all garbage, refuse and
garden waste properly placed in approved containers and located on the
premises served in accordance with the provisions of Article II of
Chapter 18 of this Municipal Code, provided the person so served is
not delinquent in paying proper bills rendered for such service;
provided further, that after collection, the licensee shall return
all garbage and refuse containers to the proper1location on the
premises as provided in Article II of Chapter 18 of this Code.
(c) The licensee shall collect all garbage, refuse and
garden waste from each residence and each commercial and industrial
establishment subscribing for such service and paying the established
fee therefor on a regular schedule but not less than twice each week;
provided, that where not more than three persons permanently reside
in a dwelling unit, the owner or occupant of such unit may contract
for and the licensee shall provide collection service once each
week at an established fee therefor, provided further, that in the
case of dwelling units subscribing for such once - per -week service
the licensee shall not be required to collect and dispose of more
than two containers (each 32 gallons maximum) of garbage and refuse
and two bags of garden waste per week from such dwelling units.

(d) The licensee shall maintain an office with telephone
service in the village to which service complaints by subscribers
may be directed. Such office shall be open and telephone calls
received during the hours from 8 A.M. to 4:30 P.M., Monday through
Friday of each week. All complaints shall be given prompt and
courteous attention. Any complaint as to failure of collection shall
be investigated immediately and, if verified, then a special collection
shall be made within 24 hours of the receipt of the complaint.
(e) The licensee shall collect all -garbage and refuse and
garden waste placed in approved containers in accordance with the
provisions of Article II of Chapter 18 of this Municipal Code without
limit as to the number of such containers and at the established fees
therefor; provided, that the licensee may charge a special fee for
the collection and removal of miscellaneous waste.
(f) The licensee shall comply with all ordinances,
applicable laws, rules and regulations relating to the business,
and will properly dispose of all garbage and refuse collected.at
a duly licensed and operating sanitary landfill.
(g) The fees established by the licensee at the commencement
of the license year for garbage, refuse and garden.waste collection
from residential units shall not exceed the fees approved by the
Board of Trustees and shall not be increased during the license year
without the approval.of the Board of Trustees. The.licensee shall
negotiate and contract directly with owners or tenants of commercial
and industrial establishments for scavenger service to such
establishments.
(h). The licensee shall prepare and file with the Village
Manager for his approval a proposed collection route and schedule
of collections. When. approved, the licensee shall follow such route
and schedule unless the Village Manager shall approve deviations
therefrom. In'the event collection -is not completed in accordance
with the schedule then it shall be resumed and completed on the
following day. The licensee shall provide such additional labor
and equipment as maybe necessary to maintain such schedule of
collections', with due allowance for mechanical failures of equipment
and other acts or occurrences- beyond the control of the licensee.
(i) The licensee shall replace without cost to the
subscriber, any container or-container lid substantially damaged
or lost through the negligence of the licensee,or its employees.
"17.706 Revocation of License.) The Board of Trustees
may, in the event of repeated violation of the terms and conditions
of the services to be rendered by the licensee, as set forth in
Section 17.705 hereof,.:and after notice to the licensee, revoke
such license.
"17.707 Vehicles.) The licensee shall use only modern,
enclosed, leak - proof, packer- type,disposal truck bodies for all
residential refuse disposal service and for all commercial and
industrial disposal service involving food waste. All equipment
used for the transportation of waste of any kind shall be watertight
and equipped with covers.
"17.708 Disposal.) All garbage, refuse, garden waste
and miscellaneous waste collected in the village shall be removed
and disposed of outside the corporate limits of the village before
the close of business on the day collected.
"17.709 Penalty.) Any person, firm or corporation
violating any provision of this article shall be fined not to exceed
$500 for each offense; a separate offense shall be deemed committed
on each day during which or on which a violation occurs or continues."
SECTION That the Village Clerk is hereby directed to
TWO: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
