AN ORDINANCE GRANTING A VARIATION FROM
THE PROVISIONS OF THE ZONING ORDINANCE
WLTH RESPECT TO THE PROPERTY LOCATED AT
2 WAUKEGAN ROAD, DEERFIELD, ILLINOIS
WHEREAS, SHELL OIL COMPANY has petitioned for a
variation from the strict provisions of the Zoning Ordinance
of the Village of Deerfield, passed May 4, 1953, as amended;
and
WHEREAS, pursuant to notice duly published as required
by statute, a public hearing on said petition was held and
conducted by the Zoning Board of Appeals of the Village of
Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with
the President and Board of Trustees its written findings of
fact and recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK
COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation
ONE: of the Zoning Board of Appeals is hereby
concurred in and adopted as the findings
of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and
TWO: particular hardship in the way of carrying
out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as
applied to Petitioner's property which is legally described
as follows:
That part of the South West quarter of the
South East quarter, Section 33, Township 43 North,
Range 12 East of the Third Principal Meridian
described as follows: Beginning at a point on the
South line of the South West quarter of the
South East quarter of said Section 33 199.68
feet (as measured along said South line) West
of center line of Waukegan Road and 50 feet
North and perpendicular to said South line;
thence East 134 feet to a point; thence North-
westerly parallel to center line of Waukegan
Road 210 feet to a point; thence Southwesterly
perpendicular to center line of Waukegan Road
78 feet to a point; thence Southeasterly to
a point 88.28 feet North of and perpendicular
to the South line of the South West quarter of
the South East quarter of Section 33 the place
of beginning all in Lake County, Illinois.
SECTION That a variation from the strict
THREE: provisions of Section XIII,D -1, D -2 -b,
D -2 -d of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended
with respect to the property hereinabove described, is
hereby granted so as to permit a front yard of 33 feet
in lieu of the required 50 feet, a corner side yard on
Waukegan Road of 49 feet 9 inches in lieu of the required
50 feet and and an interior side yard of 2 feet 6 inches
in lieu of the required 5 feet in accordance with the.
building plan presented and filed with the Zoning Board
of Appeals.
SECTION That the variation hereby granted is
FOUR: subject to compliance by Petitioner
with all other applicable provisions
of the Zoning Ordinance and all other applicable
ordinances of the Village and provided further that
Petitioner constructs and installs sidewalks along the
County Line Road and Waukegan Road frontages in accord-
ance with the plan to be approved by the Village Engineer.
SECTION That-this Ordinance shall be in full
FIVE: force and effect from and after its
passage and approval, as provided by law.
