AN ORDINANCE APPROVING A PLANNED
DEVELOPMENT (GLORIOSO RESUBDIVISION III
-- HOVLAND LOTS.35, 36, AND PARTS
OF LOTS 37, 39, 2, 31 4, 5 AND 6)
WHEREAS, the Plan Commission of the Village of Deerfield
has heretofore held a public hearing on the application of JOHN
GLORIOSO for the approval of a single family residential planned
development of. .certain' -real estate hereinafter = described located
in the Hovland Subdivision and classified in the R -1 -B District
of the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was -in all respects held according to law; and

WHEREAS,. the Plan Commission of the.Village of Deerfield,
after considering the.evidence adduced, recommended that said
planned development be.-approved subject to certain conditions
and restrictions.
NOW, THEREFORE,-.BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGEOF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That-the proposed single family planned resi-
ONE: dential development of the real estate legally
described as follows:
Lots.35,.36, East half of Lot 37, East half.of Lot
39, South half.of Lot 2, North half of Lot 2, Lot
3, Lot 4, Lot. 5, and Lot 6 in the J. S. Hovland
Subdivision, being the first addition to Deerfield,
in the Southwest'Quarter of Section 32, Township 43
North, Range 12, East of the Third Principal Meridian,
in Lake County, Illinois,
and as set forth and described on the attached plan of development
and preliminary plat of resubdivision, which plan and plat of re-
subdivision are made a.part of this Ordinance, be and it is hereby
approved subject to the conditions and restrictions hereinafter
set forth.

SECTION That the approval of said planned development
TWO is conditioned upon the following:
1. That the developer, John Glorioso, dedicate the West
30 feet of Lot 6 and the East 30 feet of Lot 35 to the Village of
Deerfield as and for street purposes and that prior to the issuance
of a building permit for Lots 6 or 35, or any portion thereof as
the same may be resubdivided, John Glorioso shall deposit sufficient
funds in escrow with the Village or make other provision satisfactory
to the Village to insure the payment of his proportionate share of
the installation of full street improvements, including payment,
curb, gutter, storm sewer, street signs, and street lighting, in
accordance with the applicable provisions of the Village Code for
the proposed street to be constructed on the above - described portions
of Lots 6 and 35.
2. That the developer, John Glorioso, construct and
install full and complete subdivision improvements in accordance
with the applicable provisions of the Municipal Code of the Village
of Deerfield to serve thy lots which will front on the proposed
street to be constructed and installed along the rear of Lots 36,
37, 38, 39, 2, 3, 4 and 5, including the dedication of the right -
of -way of said street and such other improvements as may be required
upon approval of the final plat of subdivision; it being understood
that in the event of the request for the approval of a planned
development and resubdivision by the owner of Lot 38, the proposed
cul -de -sac street as depicted on the attached plan of development
and preliminary plat of resubdivision will be modified in such a
manner as to reduce the length of the proposed cul -de -sac street;
it is further understood that in the event the owner of Lot 38
refuses to dedicate that portion of said lot required for the
proposed cul -de -sac street and the developer, John Glorioso, is
unable to acquire that said portion of Lot 38, the corporate
authorities of the Village of Deerfield will consider the insti-
tution of eminent domain proceedings for the purpose of acquiring
said portion of said lot for street purposes; provided that the
developer shall reimburse the Village in full for all costs and
expenses incurred by the Village by reason of such proceedings.
3. That the developer, John Glorioso, construct and
install and improve Rosewood Avenue from Fairview Avenue to Willow
Avenue (or to that point on Rosewood Avenue west of Willow Avenue
where such improvements presently terminate) in the following
manner:
A. Complete storm sewer improvements, including all
necessary appurtenances and connections.

B. Street pavement, including curb and gutter, street
signs and street lighting.
C. Complete sanitary sewer improvements, including
all necessary appurtenances and connections to the
sanitary sewer proposed to be installed in Fairview
Avenue under Deerfield Special Assessment proceedings
#107.
D. Such other subdivision improvements as may be
required to serve the lots proposed to front or abut
on Rosewood Avenue, in accordance with the applicable
provisions of:the Municipal Code of the Village of
Deerfield, including, without limitation, water mains
and services in the event the latter are not installed
pursuant to Deerfield Special Assessment proceedings
#107,
all of which improvements shall be constructed and installed in
accordance with the applicable provisions of the Municipal Code
of the Village of Deerfield.
4. That the developer, John Glorioso, construct and install
full storm sewer improvements (including all appurtenances and
connections necessary to connect the same to a trunk storm sewer
designated by the Village Engineer), street lighting and street
signs in accordance with the applicable provisions of the Village
Code in the following streets or portions thereof:
That portion ofk< Fairview Avenue upon which Lot
.36 and Lot. 35 front, or
contribute his proportionate share of the cost of such improvements
in the event such improvements are installed by others.
5. That in the event all other owners of property fronting
on;.the street or portions thereof described in Paragraph 4 contri-
bute their proportionate - shares of the cost of street improvements,
then the developer, John Glorioso, shall construct and install full
street improvements, including pavement, curb and gutter in said
streets or portions thereof.
6. That in the event that the Village of Deerfield shall,
through special assessment proceedings, construct and install
improvements in the streets or portions thereof described in
Paragraph 4, the developer, John Glorioso, shall contribute and

pay to the public benefit fund of the Village of Deerfield the
sum of $2,000 as a contribution toward the cost of the construc-
tion and installation of such street improvements in the inter-
section of Rosewood Avenue and Fairview Avenue.
SECTION That the approval of said planned development
THREE: is hereby given with the understanding that in
the event all of the owners of property fronting
on the street or portion thereof described in Paragraph 4 of
Section Two hereof do not contribute their proportionate share
of the cost of street improvements or make other provision with
respect thereto acceptable to the developer, the Village of
Deerfield will undertake to construct and install said street
improvements by special assessment proceedings.
SECTION That the approval of the planned development
FOUR: hereby given is subject to the further con-
dition that the developer, John Glorioso,
submit for approval a final plat of resubdivision of the real
estate described in Section One hereof and except as otherwise
provided in this Ordinance comply with all requirements of the
Village Code of the Village of Deerfield necessary for the
approval of said final plat.
SECTION That this Ordinance shall be in full force and

as provided by law.
