O-20-20VILLAGE OF DEERFIELD ORDINANCE NO. 2020- 0-20-20 AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR MASSAGE SERVICES WITH AESTHETICIAN SERVICES (151 Pfingsten Road, Suite S — BW Spa) WHEREAS, Bizar Entertainment, Inc., an Illinois Corporation d/b/a BW Spa ("Applicant"), is the lessee of that certain parcel of real property located at 151 Pfingsten Road, Suite S, Deerfield, Illinois, and legally described in Exhibit A attached and, by this reference, made a part of this Ordinance ("Property's; and WHEREAS, 151 Pfingsten Road LLC, an Illinois, limited liability company ("Owner's, is the record owner of the Property; and WHEREAS, the Property is located entirely within the 1-2 Limited Industrial District of the Village ("1-2 District's; and WHEREAS, the Applicant currently uses the Property for physical fitness classes, and desires to also offer massage services with aesthetician services. ("Proposed Use's; and WHEREAS, on Wo6 r 5,2oZo, the Village Board adopted Ordinance No. 0-y 11 approving an amendment to Section 6.02-C of the "Deerfield Zoning Ordinance 1978," as amended ("Zoning Ordinance's to allow the Proposed Use in the I-2 District upon the issuance of a special use permit; and WHEREAS, pursuant to Section 13.11 of the Zoning Ordinance, the Applicant, with the consent of the Owner, has filed an application with the Village for a special use permit to operate the Proposed Use on the Property ("Special Use Permit'; and WHEREAS, a public hearing of the Plan Commission of the Village of Deerfield to consider the Special Use Permit was duly advertised in the Deerfield Review on July 2, 2020 and held on July 23, 2020; and WHEREAS, on July 23, 2020, the Plan Commission considered the Special Use Permit at its meeting and adopted findings, recommending approval of the Special Use Permit; and WHEREAS, the Village Board has determined that the Special Use Permit complies with the required standards for special use permits as set forth in Article 13 of the Zoning Ordinance; and WHEREAS, consistent with the Plan Commission recommendation, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to approve the Special Use Permit, in accordance with, and subject to, the conditions, restrictions, and provisions of this Ordinance; (00116635.4} 13 9 SIGNAGE There will be a simple door decal approximately 12inches by 12inches which is within the Zoning Ordinance’s 16 square foot allowance.
