AN ORDINANCE APPROVING A PLANNED
DEVELOPMENT ( GLORIOSO RESUBDIVISION II)
WHEREAS, the Plan Commission of the Village of Deerfield
has heretofore held a public hearing on the application of JOHN
GLORIOSO for the approval cif a single family residential planned
development of certain real estate hereinafter described located
in the Hovland Subdivision and classified in the R -1 -B District
of the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the eviddnce adduced, recommended that said
planned development be approved subject to certain conditions
and restrictions.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the proposed single family planne.d residen-
ONE: tial development of the real estate legally
described as follows;
Lots 10, 11, 12,. 13, 28, 29, 30, 31, 125 and 126 in
J. S. Hovland's First Addition to Deerfield in the
Southwest Quarter of Section 32, Township 43 North,
Range 12, East of the Third Principal Meridian, in Lake
County, Illinois,
and as set forth and described on the attached plan of development
and preliminary plat of resubdivision, which plan and plat of re-
subdivision are made a part of this Ordinance, be and it is hereby

approved subject to the conditions and restrictions hereinafter
set forth.
SECTION That the approval,of said planned
TWO: development is conditioned upon the
following:
1. That the developer, John Glorioso, dedicate the
West 30 feet of Lots 125 and 126 to the Village of Deerfield
as and for street purposes and that prior to the issuance of
a building permit for Lots 125 and 126, or any portion thereof
as the same may be resubdivided, John Glorioso shall deposit
sufficient funds in escrow with the Village or make other provision
satisfactory to.the Village to insure the payment of his propor-
tionate share of the installation of full street improvements,
including pavement, curb, gutter, storm sewer, street signs, and
street lighting, in accordance with. the applicable provisions of
the Village Code.
2. That the developer, John Glorioso, construct
and install full and complete subdivision improvements in
accordance with the applicable provisions of the Municipal Code
of the Village of Deerfield to serve the lots which will front
on the proposed street to be constructed and installed along the
rear of Lots 11, 12, 13, 28, 29, and 30, including the dedication
of the right -of -way of said street and such other improvements as may
be required upon approval of the final plat, it being understood that
changes therein may occur dependent upon the possible resubdivision
of Lots 14 and 27.
3. That the developer, John Glorioso, construct and
install full and complete subdivision improvements in accordance
with the applicable provisions of the Municipal Code of the
Village of Deerfield to serve the lots which will front or abutt
on the proposed street to be constructed and installed along the
rear of Lots 10 and 31, including the dedication of the right -
of -way of said street.
4. That the developer, John Glorioso, construct and
install full storm sewer improvements (including all appurtenances
and connections necessary to connect the same to a trunk storm
sewer to be installed in Laurel Avenue), street lighting and

street signs in accordance with the applicable provisions of the
Village Code in the following street or portions thereof:
That portion of Fairview Avenue from Laurel
Avenue southward for a distance of 360.25
feet.
5. That in the event all other owners of property
fronting on the street or portions thereof described in Para-
graph 4 contribute their proportionate shares of the cost of
street improvements, then the developer, John Glorioso, shall
construct and install full street improvements, including pave-
ment, curb and gutter in said street or portions thereof.
6. That in the event that the Village of Deerfield
shall, through special assessment proceedings, construct and
install street improvements in the street or portions thereof
described in Paragraph 4, the developer, John Glorioso, shall
contribute and pay to the public benefit fund of the Village of
Deerfield the sum of FOUR THOUSAND ($4,000.00) DOLLARS for
each street intersection constructed and installed through a
special assessment proceedings.
SECTION That the approval of said planned
THREE: development is hereby given with
the understanding that in the event
all of the owners of property fronting
on the street or portion thereof described in Paragraph 4 of
Section Two hereof do not contribute their proportionate bhare of
the cost of street improvements or make other provision with
respect thereto acceptable to the developer, the Village of
Deerfield will undertake to construct and install said street
improvements by special assessment proceedings, and with the
further understanding that in the event the owners of any lots
refuse to dedicate that portion of their properties required for
street right -of -way as indicated in the attached plan and pre-
liminary plat of resubdivision, the Village of Deerfield will
institute eminent domain proceedings to acquire said portion
of said lot for street purposes.
° SECTION That the approval of the planned development
FOUR: hereby given is subject to the further con-
dition fthat the developer, John Glorioso,
submit for approval a final plat of re-

subdivision of the real estate described in Section One hereof
and except as otherwise provided in this Ordinance comply with.
all requirements of the Village Code of the Village of Deerfield
necessary for the approval of said final plat.
SECTION That this Ordinance shall be in full force

approval, as provided by law.
