AN ORDINANCE APPROVING AN AMENDED SPECIAL USE
FOR THE SACHS RECREATION CENTER SOUTH ENTRY
IMPROVEMENTS AS AN AMENDMENT TO THE DEERFIELD
PARK PLAZA PLANNED UNIT DEVELOPMENT
WHEREAS, the Deerfield Park District (the "Applicant") is the owner of the Sachs
Recreation Center on the property legally described on Exhibit A attached hereto (the "Subject
Property") located at 455 Lake Cook Road, Deerfield, Illinois; and
WHEREAS, the Deerfield Park District was granted a Special Use pursuant to
Ordinance No. 0-08-07 to operate the Sachs Recreation Center as a Special Use of the Subject
Property in the Deerfield Park Plaza Planned Unit Development in the C-2 Outlying Commercial
District; and
WHEREAS, the Applicant has petitioned the Village of Deerfield to approve an
amendment to the Special Use granted pursuant to Ordinance 0-08-07 to permit certain changes
to the south entry to the Sachs Recreation Center as an amendment to the Deerfield Park Plaza
Planned Unit Development in the C-2 Outlying Commercial District; and
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
June 13, 2013 to consider said application for approval of the requested changes to the south
entry to the Sachs Recreation Center as an amendment to the Special Use for the Subject
Property pursuant to Article 5.02-C, Paragraph 3, and Article 13.11 of the Zoning Ordinance of
the Village of Deerfield, and as an amendment to the Commercial Planned Unit Development for
the Deerfield Park Plaza in the C-2 Outlying Commercial District; and
WHEREAS, said hearing was held pursuant to public notice duly given in the time and
manner provided by law and conforming in all respects, in both manner and form, with the
Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
testimony, documentary evidence and supporting materials offered at said public hearing, filed its
report with the President and Board of Trustees containing its written findings of fact and
recommendation that Applicant's request for an amendment to the Special Use authorized by
Ordinance 0-08-07 be authorized pursuant to Article 5.02-C, Paragraph 3, and Article 13.11 of
the Zoning Ordinance of the Village of Deerfield to permit the Sachs Recreation Center South
Entry Improvements as more fully described herein as a Special Use of the Subject Property and
as an amendment to the Deerfield Park Plaza Planned Unit Development in the C-2 Outlying
Commercial District; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that the best interests of the Village will be served by the authorization and approval
of the Sachs Recreation Center South Entry Improvements as an amended Special Use of the
Subject Property and as an amendment to the Deerfield Park Plaza Commercial Planned Unit
Development in the C-2 Outlying Commercial District, all to the extent as specifically provided
herein;

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby affirmatively find that
the approval of the Sachs Recreation Center South Entry Improvements, as more fully described
in Exhibit B attached hereto, as an amendment to the Special Use authorized by Ordinance No.
0-08-07 fully complies with the requirements and standards for special uses set forth in Article
5.02-C, Paragraph 3, and Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board of Trustees do hereby authorize and approve
the South Entry Improvements to the Sachs Recreation Center as an amended Special Use of the
Subject Property in the Deerfield Park Plaza Commercial Planned Unit Development in the C-2
Outlying Commercial District, subject to the conditions, regulations and restrictions set forth in
Section 3 of this Ordinance.
SECTION 3: That the approval and authorization of the Sachs Recreation Center South
Entry Improvements as an amended Special Use of the Subject Property, and as an amendment to
the Deerfield Park Plaza Commercial Planned Unit Development in the C-2 Outlying
Commercial District, is hereby granted subject to the following conditions, regulations and
restrictions: (i) the establishment, development, maintenance and use of the Subject Property for
said amended Special Use shall be in strict conformance with the plans and supporting materials
attached hereto and made a part of this Ordinance as Exhibit B hereof, and with all
representations made and submitted by the Applicant to the Plan Commission and to the
President and Board of Trustees of the Village of Deerfield; (ii) compliance with the

recommendations of the Appearance Review Commission; (iii) continued compliance with the
requirements of Ordinance No. 0-08-07 authorizing a Special Use recreation facility on the
Subject Property, as amended by this Ordinance; (iv) continued compliance with the
requirements of the Deerfield Park Plaza Planned Unit Development; and (v) compliance with
the terms and conditions of this Ordinance and with all other applicable provisions of the Zoning
Ordinance of the Village of Deerfield.
SECTION 4: That the amendment to Special Use as hereby authorized shall be binding
upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees
and assigns, and any violation of the conditions herein set forth by the Applicant or its
successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as
hereby authorized.
SECTION 5: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds
of Cook County, Illinois, at Applicant's expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non -preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non -preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.

SECTION 7: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.

Re: Sachs Recreation Center South Entry Improvements
Changes to Special Use Permit 0-08-07
The Deerfield Park District requests changes to the Special Use Permit 0-08-07 for the Lake Cook Plaza
Planned Unit Development for the South Entry to Sachs Recreation Center. These changes shall include
the realignment of the existing entry walk, the addition of a small play area, the addition of an outdoor
exercise area and the addition of ornamental planting and shade trees. Program capacities of the Sachs
Recreation Center will not change due to these additions.
The Deerfield Park District intends to remove the wooden deck and the existing concrete walk. The
awning will retrain in place. The two existing light poles will be slightly relocated. The entry door will
function as it does today.
The Park District will add a small playground of about 2,100 square feet. This play structure is intended
for use by the existing Kinder Club, a before and after school kindergarten enrichment program. The
surfacing will be an artificial turf with appropriate padding. The play structure will target ages 2-8. A
shade sail will be included as part of the structure. Per DCFS, the play area will be fully enclosed with a
4' high fence and will be an ornamental iron picket fence.
A 900 square foot exercise area will be added. The surfacing for this space will be rubber tiles. A 12 x 12
shade structure may be placed over this area. This area will be fenced as well and used as part of the play
area when not in use as an exercise area.
A new concrete walkway will wind from the door to the parking lot. Along the path there will be a picnic
table and bike rack. A bench will be placed near the entry for waiting users. The two 16' tail pedestrian
lights will be relocated along the new path much in the same position as the current lights.
The entire pathway will be fully landscaped with a variety of ornamental plants, ornamental trees and
shade trees. The goal of the planting is to provide year round interest, shade for users and to reduce the
huge scale of the buildings surrounding the entry.

forward to moving ahead with this very important project.
