AN ORDINANCE APPROVING AN AMENDMENT TO A SPECIAL USE PERMIT
FOR AN ELECTRIC SUBSTATION, A SPECIAL USE PERMIT FOR AN
ESSENTIAL SERVICES ANTENNA SUPPORT STRUCTURE, AND
A VARIATION FROM SECTION 5.02-F.3.a OF THE
"DEERFIELD ZONING ORDINANCE 1978," AS AMENDED
(525 Lake Cook Road)
WHEREAS, Commonwealth Edison Co. ("Owner's is the record title owner of the
property commonly known as 525 Lake Cook Road, Deerfield, Illinois ("Property's, which
Property is legally described in Exhibit A attached and, by this reference, made a part of
this Ordinance; and
WHEREAS, the Property is located within the C-2 Outlying Commercial District of
the Village ("C-2 District's; and
WHEREAS, on April 1, 1968, pursuant to Ordinance 0-68-13, the Village granted
the Owner a conditional use permit to allow the Property to be used for a public utility
facility ("Utility Special Use Permit'; and
WHEREAS, as part of the Owner's "smart -grid" initiative, the Owner desires to
construct on the Property: (1) an approximately 104 foot tall antenna support structure
("Essential Services Antenna Support Structure'; (ii) three utility fiber enclosures;
(Ili) a utility enclosure for batteries (`Battery Enclosure'; and (iv) new fencing
(collectively, "Improvements'; and
WHEREAS, pursuant to Section 5.02-C of the "Deerfield Zoning Ordinance 1978,"
as amended ("Zoning Ordinance'), Essential Services Antenna Support Structures may
be constructed in the C-2 District only upon the issuance of a special use permit; and
WHEREAS, pursuant to Section 5.02-F.3.a of the "Deerfield Zoning Ordinance
1978" ("Zoning Ordinance', properties in the C-2 District are required to have a
minimum front yard of not less than 50 feet ("Required Front Yard'); and
WHEREAS, the Owner desires to allow the existing Control Building and the
Battery Enclosure to encroach 34 feet and 29 feet respectively, into the Required Front
Yard, in violation of Section 5.02-F.3.a of the Zoning Ordinance; and
WHEREAS, the Owner has filed an application ("Application') with the Village
for: (i) an amendment to the Utility Special Use Permit allow the Improvements ("Special
Use Amendment'; (ii) a special use permit for the Essential Services Antenna Support
Structure ("Support Structure Special Use Permit'; and (Ili) a variation from Section
5.02-F.3.a of the Zoning Ordinance to allow the existing Control Building to remain
approximately 16 feet from the front property line and to construct the Battery Enclosure
approximately 21 feet from the front lot line of the Property (`Requested Variation'; and

WHEREAS, a public hearing of the Plan Commission of the Village of Deerfield to
consider the Application was duly advertised in the Deerfield Review on April 1, 2021 and
held on April 22, 2021; and
WHEREAS, on April 22, 2021, the Plan Commission adopted Findings of Fact,
recommending that the Village Board approve the Special Use Amendment and Support
Structure Special Use Permit; and
WHEREAS, a public hearing of the Board of Zoning Appeals of the Village of
Deerfield (`BZA') to consider the approval of the Requested Variation was duly advertised
in the Deerfield Review on April 1, 2021, and held on May 4, 2021; and
WHEREAS, on May 4, 2021, the BZA voted to recommend approval of the
Requested Variation, in accordance with Section 13.07-E of the Zoning Code; and
WHEREAS, the Village Board has determined that: (i) the Special Use Amendment
and Support Structure Special Use Permit complies with the required standards for special
use permits set forth in Articles 13 of the Zoning Ordinance; and (ii) the Requested
Variation complies with the required standards for variations set forth in Section 13.07 of
the Zoning Ordinance; and
WHEREAS, consistent with the Plan Commission and BZA recommendations, the
Village Board has determined that it will serve and be in the best interests of the Village
and its residents to approve the Special Use Amendment, Support Structure Special Use
Permit, and Requested Variation for the Property, in accordance with, and subject to, the
conditions, restrictions, and provisions of this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as the findings of the Village Board.
SECTION TWO: APPROVAL OF AMENDMENT TO SPECIAL USE
PERMIT. Subject to, and contingent upon, the conditions, restrictions, and provisions set
forth in Section Five of this Ordinance, the Village Board hereby approves the Special Use
Amendment for the Property to allow for the installation of the Improvements, in
accordance with, and pursuant to, Article 13 of the Zoning Ordinance and the home rule
powers of the Village.
SECTION THREE: APPROVAL OF SPECIAL USE PERMIT. Subject to, and
contingent upon, the conditions, restrictions, and provisions set forth in Section Five of this
Ordinance, the Village Board hereby approves the Special Use Permit for the Property to
allow for the installation of the Essential Services Antenna Support Structure, in
accordance with, and pursuant to, Article 13 of the Zoning Ordinance and the home rule
powers of the Village.
SECTION FOUR: APPROVAL OF REQUESTED VARIATION. Subject to,
and contingent upon, the conditions, restrictions, and provisions set forth in Section Five of

this Ordinance, and pursuant to Section 13.07-G of the Zoning Code and the home rule
powers of the Village, the Village Board hereby grants the Requested Variation from
Section 5.02-F.3.a of the Zoning Ordinance to permit the installation of the Battery
Enclosure and to allow the existing Control Building to remain in its current location.
SECTION FIVE: CONDITIONS. Notwithstanding any use or development
right that may be applicable or available pursuant to the provisions of the Village Code or
the Zoning Ordinance, or any other rights the Owner may have, the approvals granted in
Sections Two, Three, and Four of this Ordinance are hereby expressly subject to and
contingent upon the redevelopment, use, and maintenance of the Property in compliance
with each and all of the following conditions:
A. Com liance with Regulations. The redevelopment, use, operation, and
maintenance of the Property must comply with all applicable Village codes
and ordinances, as the same have been or may be amended from time to time,
except to the extent specifically provided otherwise in this Ordinance.
B. Compliance with Plans. The redevelopment, use, operation, and maintenance
of the Property must comply with the plans in Exhibit B attached to and, by
this reference, made a part of this Ordinance, except for minor changes and
site work approved by the Village Principal Planner in accordance with all
applicable Village standards.
C. Reimbursement of Village Costs. In addition to any other costs, payments,
fees, charges, contributions, or dedications required under applicable Village
codes, ordinances, resolutions, rules, or regulations, the Owner must pay to
the Village, promptly upon presentation of a written demand or demands
therefor, all legal fees, costs, and expenses incurred or accrued in connection
with the review, negotiation, preparation, consideration, and review of this
Ordinance. Payment of all such fees, costs, and expenses for which demand
has been made must be made by a certified or cashier's check. Further, the
Owner will be liable for, and must pay upon demand, all costs incurred by the
Village for publications and recordings required in connection with the
aforesaid matters.
SECTION SIX: RECORDATION• BINDING EFFECT. A copy of this
Ordinance shall be recorded in the Office of the Cook County Recorder of Deeds against the
Property. This Ordinance and the privileges, obligations, and provisions contained herein
run with the Property and inure to the benefit of, and are binding upon, the Owner and its
personal representatives, successors, and permitted assigns.
SECTION SEVEN: FAILURE TO COMPLY WITH CONDITIONS. Upon the
failure or refusal of the Owner to comply with any or all of the conditions, restrictions, or
provisions of this Ordinance, in addition to all other remedies available to the Village, the
approvals granted in Sections Two, Three, and Four of this Ordinance ("Approval') may,
at the sole discretion of the Village Board, by ordinance duly adopted, be revoked and
become null and void; provided, however, that the Village Board may not so revoke the
Approval unless it first provides the Owner with two months advance written notice of the
reasons for revocation and an opportunity to be heard at a regular meeting of the Village

Board. In the event of such revocation, the Village Manager and Village Attorney are
hereby authorized and directed to bring such zoning enforcement action as may be
appropriate under the circumstances. Notwithstanding the foregoing or anything else
contained in this Ordinance, neither the Owner's failure to comply with this Ordinance, nor
anything else contained herein, shall affect or restrict the Owner's rights to use the
Property as otherwise permitted by the Zoning Ordinance.
SECTION EIGHT: AMENDMENTS. Any amendment to any provision of this
Ordinance may be granted only pursuant to the procedures, and subject to the standards
and limitations, provided in the Zoning Ordinance for the granting of special use permits or
variations, as may be applicable.
SECTION NINE:
EFFECTIVE DATE.
A. This Ordinance will be effective only upon the occurrence of all of the
following events:
1. Passage by the Village Board by a majority vote in the manner
required by law;
2. Publication in pamphlet form in the manner required by law;
3. The filing by the Owner with the Village Clerk of a fully executed
Unconditional Agreement and Consent, in the form of Exhibit C
attached to and, by this reference, made a part of this Ordinance, to
accept and abide by each and all of the terms, conditions, and
limitations set forth in this Ordinance and to indemnify the Village
for any claims that may arise in connection with the approval of this
Ordinance; and
4. Recordation of this Ordinance, together with such exhibits as the
Village Clerk deems appropriate for recordation, with the office of the
Recorder of Cook County.
B. In the event that the Owner does not file fully executed copies of the
Unconditional Agreement and Consent, as required by Section 9.A.3 of this
Ordinance, within 30 days after the date of final passage of this Ordinance,
the Village Board will have the right, in its sole discretion, to declare this
Ordinance null and void and of no force or effect.

1. SITE PREPARATION AND EARTHWORK WILL INCLUDE STRIPPING, PROOF -ROLLING,
EXCAVATION, TRENCHING, DEWATERING, FILLING, AND BACKFILLING OPERATIONS. ANY
TOPSOIL, UNCONTROLLED FILL, PEAT OR OTHER DELETERIOUS MATERIALS SHOULD BE
STRIPPED FROM AREAS TO BE OCCUPIED BY ANY STRUCTURES AND FROM AREAS TO BE
FILLED.
2. THE CLEARING AND GRUBBING OF ALL TREES, SNAGS, LOGS, BRUSH, STUMPS, SHRUBS,
RUBBISH AND SIMILAR MATERIALS SHALL BE CLEARED FROM WITHIN THE LIMITS OF THE
DESIGNATED AREAS. UNLESS OTHERWISE SPECIFIED, ALL STUMPS,ROOTS AND ROOT CLUSTERS
THAT HAVE A DIAMETER OF 1 INCH OR LARGER SHALL BE GRUBBED OUT TO A DEPTH OF AT
LEAST 2 FEET BELOW SUBGRADE FOR CONCRETE STRUCTURES AND 1 FOOT BELOW THE GROUND
SURFACE AT EMBANKMENT SITES AND OTHER DESIGNATED AREAS.
3. FOLLOWING SITE CLEARING AND EXCAVATION, THE EXPOSED SUBGRADE SHOULD BE
EXAMINED TO EVALUATE WHETHER SCARIFICATION AND RE -COMPACTION IS REQUIRED. AT A
MINIMUM, THE EXPOSED SUBGRADE IN AREAS THAT WILL NOT RECEIVE NEW FILL SHOULD BE
ROLLED WITH A SMOOTH -DRUM ROLLER TO PROVIDE A UNIFORM SURFACE. SURFACES TO
RECEIVE STRUCTURAL FILL SHOULD BE SCARIFIED TO A DEPTH OF 6 INCHES AND RE -
COMPACTED.
4. THE DISPOSAL OF ALL MATERIALS CLEARED AND GRUBBED FROM THE DESIGNATED AREAS
SHALL BE DISPOSED OF AT LOCATIONS AS DETERMINED BY COMED. THE CONTRACTOR IS
RESPONSIBLE FOR COMPLYING WITH ALL LOCAL RULES AND REGULATIONS AND THE PAYMENT
OF ANY AND ALL FEES THAT MAY RESULT FROM DISPOSAL AT LOCATIONS AWAY FROM THE
PROJECT SITE.
5. ALL UNSUITABLE OR SURPLUS EXCAVATED MATERIAL SHALL BE DISPOSED OF AT A

BE COMPLETED AND MAINTAINED IN A SAFE AND STABLE CONDITION THROUGHOUT THE TOTAL
CONSTRUCTION PHASE. STRUCTURE AND TRENCH EXCAVATIONS SHALL BE COMPLETED TO THE
SPECIFIED ELEVATIONS AND TO THE LENGTH AND WIDTH REQUIRED TO SAFELY INSTALL,
ADJUST AND REMOVE ANY FORMS, BRACING, OR SUPPORTS NECESSARY FOR THE INSTALLATION
OF THE WORK. EXCAVATIONS OUTSIDE THE LINES AND LIMITS SHOWN ON THE DRAWINGS OR
SPECIFIED HEREIN REQUIRED TO MEET SAFETY REQUIREMENTS SHALL BE THE
RESPONSIBILITY OF THE CONTRACTOR IN CONSTRUCTING AND MAINTAINING A SAFE AND

1. Contractor shall refer to ComEd SESC Process Document EN-CE-P942.

the commencement of upland disturbance. Soil disturbance must be phased or
enacted in such a manner as to minimize erosion soil stabilization measures must
consider the Into of vear, site conditions and the use of temporary andlor
permanent measures.
3. Unless otherwise indicated, all vegetative and structural erosion and sediment
control practices Wit be installed at minimum accoding to the standards and
specifications in the Ilknois Urban Manual, revised to atest version as amended,.
A copy of the approved soil erosion and sediment control (SESC) plan must be
maintained on the site at all tunes.
4. The erosion and sediment controls shown on the plans are the minimum
requirements.. Additional measures may be required as directed by ComEd, or
their authorized representative. All additional measures must be in place within 3
days of disturbance and any emergency SESC measures must be installed
immediately.

SOIL EROSION / SEDIMENT CONTROL GENERAL NOTES

watering operations as necessary. Dewatering sediment laden water directly into
field tiles, storm water structures. or 'Waters of the US' is prohibited. De -watering

Products. The Contractor shall be responsible for the choice of the product(s) and
equipment as well as `means and methods' for the 52e Dewatering Work to be performed
subject to the review of ComEd Environmental. All products and 'means and methods'
selected shall be adequate for the intended usetapplcation and in conformance with the
requirements of the Illinois Urban Manual. ComEd's review, does not relieve the Contractor
from compliance with the requirements of this specal provision 11 is the Contractor's
responsibility to obtain approvals from ComEd Environmental arld the Illinois Environmental
Protection Agency (IEPA) for discharge of any chemrals such as drilling polymers used
during pumping operations.
Submittals. The Contractor shall submit to ComEd Environmental for review a description
of dewatering techniques and equipment to be used, together with detail drawings showing
lengths of discharge piping and point(s) of discharge including sediment and erosion control
procedures using BMPs. The checklist shall be completed and submitted by the Contractor
(CPESC or equivalent) at least 2 weeks prior to anticipated dewalering.
Responsibility. The Contractor shall be solely responsible for the choice of product(s) and
equipment', for the design, installation, and operation; as well as 'means and methods' in the
performance of the Work. The contractor Is responsible for the subsequent removal of
dewatering systems and their safety and conformity wrh local codes, regulations and these
Specifications. All product(s), equipment and 'means and methods` selected shall be
adequate for the intended uselapplication. Review byComEdEnvironmental does not relieve
Contractor from compliance with the requirements specified herein

UNCONDITIONAL AGREEMENT AND CONSENT
TO: The Village of Deerfield, Illinois ("Village'):
WHEREAS, Commonwealth Edison Co. ("Owner') is the record title owner of the
property commonly known as 525 Lake Cook Road, Deerfield, Illinois ("Property'), which
Property is legally described in Exhibit A attached and, by this reference, made a part
hereof, and
WHEREAS, the Property is located within the C-2 Outlying Commercial District of
the Village ("C-2 District'); and
WHEREAS, on April 1, 1968, pursuant to Ordinance 0-68-13, the Village granted
the Owner a conditional use permit to allow the Property to be used for a public utility
facility ("Utility Special Use Permit'; and
WHEREAS, as part of the Owner's "smart -grid" initiative, the Owner desires to
construct on the Property: (i) an approximately 104 foot tall antenna support structure
("Essential Services Antenna Support Structure'); (ii) a utility enclosure; (iii) a utility
enclosure for batteries (`Battery Enclosure'; and (iv) new fencing (collectively,
"Improvements'; and
WHEREAS, the Owner has filed an application ("Application's with the Village
for: (i) an amendment to the Utility Special Use Permit allow the Improvements ("Special
Use Amendment'; (ii) a special use permit for the Essential Services Antenna Support
Structure ("Support Structure Special Use Permit'; and (iii) a variation from Section
5.02-F.3.a of the Zoning Ordinance to allow the existing Control Building to remain
approximately 16 feet from the front property line and to construct the Battery Enclosure
approximately 21 feet from the front lot line of the Property ("Requested Variation'; and
WHEREAS, Ordinance No. 0-21-21 , adopted by the Village Board on Tuly6 ,
2021 ("Ordinance's, grants the Special Use Amendment, Support Structure Special Use,
and Requested Variation (collectively, "Relief); and
WHEREAS, Section 9.A.3 of the Ordinance provides, among other things, that the
Ordinance will be of no force or effect unless and until the Owner has filed, within 30 days
following the passage of the Ordinance, its unconditional agreement and consent to accept
and abide by each and all of the terms, conditions, and limitations set forth in the
Ordinance;
NOW, THEREFORE, the Owner does hereby agree and covenant as follows:
1. The Owner hereby unconditionally agrees to, accept, consent to, and will
abide by each and all of the terms, conditions, limitations, restrictions, and provisions of the
Ordinance.
2. The Owner acknowledges that public notices and hearings have been
properly given and held with respect to the adoption of the Ordinance, has considered the
possibility of the revocation provided for in the Ordinance, and agrees not to challenge any
such revocation on the grounds of any procedural infirmity or a denial of any procedural
right.
3. The Owner acknowledges and agrees that the Village is not and will not be,
in any way, liable for any damages or injuries that may be sustained as a result of the
Village's granting the Relief or adoption of the Ordinance, and that the Village's approval of
the Relief does not, and will not, in any way, be deemed to insure the Owner against
damage or injury of any kind and at any time.
4. The Owner hereby agrees to hold harmless and indemnify the Village, the
Village's corporate authorities, and all Village elected and appointed officials, officers,
employees, agents, representatives, and attorneys, from any and all claims that may, at any
time, be asserted against any of such parties in connection with the Village's adoption of the
Ordinance granting the relief.
