RESOLUTION NO. 2021- R-21-25
A RESOLUTION APPROVING A PLAT OF EASEMENT FOR UTILITIES
(237 Landis Lane)
WHEREAS, Brett Sterling ("Owner") is the record title owner of that certain real
property consisting of approximately 47,313 square feet and commonly known as 237
Landis Lane ("Property's; and
WHEREAS, the Owner has identified the need to install a water main within a
portion of the Property; and
WHEREAS, the Owner desires to grant to the Village a 10'-wide utility easement
over, across, upon, and under a 10 foot wide portion of the Property, as depicted and
described in the plat of easement attached to this Resolution as Exhibit A ("Plat of
Easement'; and
WHEREAS, the Village Board has determined that approval of the Plat of
Easement will serve and be in the best interests of the Village and its residents;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION 1: RECITALS. The Village Board hereby adopts the foregoing recitals
as its findings, as if fully set forth herein.
SECTION 2: APPROVAL OF PLAT OF EASEMENT. The Village Board hereby
approves the Plat of Easement, substantially in the form attached to this Resolution as
Exhibit A, and in a final form to be approved by the Village Manager and the Village
Attorney.
SECTION 3: EXECUTION OF THE PLAT. The Village Engineer and the Village
Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, the
Plat of Easement and all necessary documentation related thereto.
SECTION 4: EFFECTIVE DATE. This Resolution shall be in full force and effect
from and after its passage and approval according to law.

APPURTENANCES THERETO AS DELINEATED HEREON SHALL BE THAT OF THE
OWNER. HOMEOWNERS ASSOCIATION OR ITS SUCCESSORS AND ASSIGNS HOLDING
TITLE TO THE INDIVIDUAL PARCELS.
AN EASEMENT IS HEREBY RESERVED FOR AND GRANTED TO THE VILLAGE OF
DEERFIELD AND ASSIGNS FOR THE PERPETUAL RIGHT, PRIVILEGE AND AUTHORITY
TO CONSTRUCT, RECONSTRUCT, REPAIR, REMOVE, INSPECT, MAINTAIN AND OPERATE
VARIOUS WATER LINES AND APPURTENCES AS MAY BE DEEMED NECESSARY BY
