AN ORDINANCE AMENDING "THE MUNICIPAL CODE OF THE VILLAGE OF
DEERFIELD, ILLINOIS, 1975," AS AMENDED TO ADOPT THE 2018 EDITIONS OF
THE INTERNATIONAL BUILDING CODE, INTERNATIONAL RESIDENTIAL
CODE, INTERNATIONAL MECHANICAL CODE, INTERNATIONAL FUEL GAS
CODE, INTERNATIONAL PROPERTY MAINTENANCE CODE, INTERNATIONAL
FIRE CODE AND INTERNATIONAL POOL AND SPA CODE
WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant
to the provisions of Article VII, Section 6 of the Illinois Constitution and the City has the
authority to adopt ordinances and to promulgate rules and regulations that pertain to its
government and affairs and that protect the public health, safety, and welfare of its citizens;
and
WHEREAS, the Village has previously adopted, and has amended from time to time,
the 2012 editions of the International Building Code, International Residential Code,
International Mechanical Code, International Fuel Gas Code, International Property
Maintenance Code, International Fire Code, and International Pool and Spa Code, as
published by the International Code Council, Inc. (collectively, "Codes'; and
WHEREAS, the Village desires to amend "The Municipal Code of the Village of
Deerfield, Illinois, 1975," as amended ("Village Code', to adopt the 2018 editions of the
Codes (collectively, "2018 Codes' and remove duplicative provisions; and
WHEREAS, pursuant to Section 1-3-2 of the Illinois Municipal Code, 65 ILCS 5/1-3-
2, three copies each of the 2018 Codes have been on file in the office of the Village Clerk for
more 30 days, and will remain on file for public use, examination, and inspection; and
WHEREAS, pursuant to 65 ILCS 5/1-3-1 et seq. and the Village's home rule powers,
the Village Board has determined that it will serve and be in the best interests of the Village
and its residents to amend the Village Code to adopt the 2018 Codes with amendments, as
set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: ADOPTION OF BUILDING CODES AND
MODIFICATIONS. Section 6-2, titled "Adoption of Building Codes and Modifications," of
Article 1, titled "In General," of Chapter 6, titled "Building," of the Village Code is hereby
amended to read as follows:
"Sec. 6-2. Adoption of Building Codes and Modifieations,
International Buildiny- Codes:
The erection, repair or alteration of all structures not regulated or excepted by
other provisions of this Chapter shall be in compliance with the provisions of
the following codes, which are adopted by reference and incorporated as if fully
set forth herein, with the modifications provided herein:
(a) The 2011 Q18 Edition of the International Building Code, as published
by the International Code Council, Inc., with the following
modifications:
(1) Section 101.1. Insert: Village of Deerfield.

(d) The 24"2018 Edition of the International Mechanical Code, as
published by the International Code Council, Inc., with the following
modifications:
(1) Section 101.1. Insert: vVillage of Deerfield.
(2) Section 108.4. Insert: Any person violating any provision of this
code shall be fined not less than fifty dollars ($50.00) nor more
than one thousand dollars ($1,000.00) for each offense. A
separate offense shall be deemed committed each day during or
on which a violation occurs or continues.
(3) Section 108.5. Insert: Any person continuing to work in violation
of a stop work order shall be fined not less than one hundred
dollars ($100.00) nor more than one thousand dollars ($1,000.00)
for each offense. A separate offense shall be deemed committed
each day during or on which such person works or continues to
work in violation of a stop work order.
(4) Section 1 in its entirety.
(e) The 29-�-22018 Edition of the International Fuel Gas Code, as published
by the International Code Council, Inc., with the following
modifications:
(1) Section 101.1, Insert: The vyillage of Deerfield.
(2) Section 106.5.2. Insert: As specified in the Deerfield municipal code.
(3) Section 108.4. Insert: Any person violating any provision of this code
shall be fined not less than fifty dollars ($50.00) nor more than one

the International Code Council, Inc., with the following modifications:

(23) Section 409.3. 110.4 is amended to read as follows: Any person
violating any provision of this code shall be fined not less than
fifty dollars ($50.00) nor more than one thousand dollars

(34) Section 444-4-112.4 is amended to read as follows: Any person
continuing to work in violation of a stop work order shall be fined

person works or continues to work in violation of a stop work
order.
(4§) Section 3204.3.1.1. (limits in which the storage of flammable
cryogenic fluids in stationary containers is prohibited): within
the corporate limits of the village, with the following exceptions:
(1) In the office, research and restricted industrial district
when authorized by the director of community
development;
(ii) In the limited industrial district when authorized by the
director of community development.
(56) Section 3404.2.9.5.2. (limits in which the storage of class I and
class II liquids in above -ground tanks outside of buildings is
prohibited): within the corporate limits of the village.
(97) Section 3406.2.4.4. (limits in which the storage of class I and
class II liquids in above -ground tanks is prohibited): within the
corporate limits of the village.
(7$) Section 3804.2. (limits in which the storage of liquefied
petroleum gas is restricted for the protection of heavily
populated or congested areas): within the corporate limits of the
village.
(g) The 20122018 Edition of the International Pool and Spa Code, as
published by the International Code Council, Inc.. with the following
modifications:
(1) Section 101.1. Insert: The Village of Deerfield.

(2) Section 108.2 shall be deleted in its entirety."
SECTION THREE: PERMIT REQUIRED; COMPLIANCE. Section 6-47, titled
"Permit Required; Compliance," of Article 7, titled "Swimming Pools," of Chapter 6, titled
"Buildings," of the Village Code is hereby amended as follows:
"Sec. 6-47. Permit Required; Compliance:
a) No person shall proceed with the construction, installation, enlargement or
alteration of any peFmanent sna, swimming pool and appurtenances
thereto within the village unless a permit therefor shall first have been
obtained from the director of building and zoning. A_ PPermit
application shall be submitted together with plans as set forth in
subsection (c) of this section.
SECTION FOUR: SWIMMING POOLS - REPEALED. The following sections of
Article 7, titled "Swimming Pools," of Chapter 6, titled "Buildings" of the Village Code are
hereby repealed and reserved for future use:
A. Section 6-48, titled "Fences and Gates";
B. Section 6-49, titled "Water Supply";
C. Section 6-50, titled "Electrical Requirements"; and
D. Section 6-51, titled "Permit Fees."
SECTION FIVE: RULES AND REGULATIONS ADOPTED. Section 8-2, titled
"Rules and Regulations Adopted," of Article 1, titled "In General," of Chapter 8, titled
"Electricity," of the Village Code is hereby amended as follows:
"Sec. 8-2. Rules And Regulations Adopted:
(a) Pursuant to the recommendations of the electrical commission there are
hereby adopted as safe and practical standards for the installation,
alteration and use of electrical equipment in the village the following:
(1) The 2005 edition of the adoDted nNational eElectrical eCode
(NFPA 70), as published by the National Fire Protection
Association and approved by the American National Standards
Institute (ANSI), shall govern the installation and use of all

electrical equipment in the village except as otherwise provided
in this chapter.
SECTION SIX: ADOPTION OF FIRE PROTECTION CODE;
EXCEPTIONS. Section 10-1, titled "Adoption of Fire Protection Code; exceptions," of Article
1, titled "In General," of Chapter 10, titled "Fire Prevention," of the Village Code is hereby
amended as follows:
"Sec. 10-1. Adoption of Fire Prevention International Fire Code;
exceptions.
(a) The regulations contained in the 19932018 Edition of the BOCA

except such portions as are deleted, modified or amended in this
Chapter, are hereby adopted and by this reference made a part of this
Chapter with the same force and effect as though set out in full herein.

SECTION SEVEN: ESTABLISHMENT OF BUREAU OF FIRE PREVENTION.
Section 10-2, titled "Establishment of Bureau of Fire Prevention," of Article 1, titled "In
General," of Chapter 10, titled "Fire Prevention," of the Village Code is hereby amended as
follows:
Sec. 10-2. Establishment of Bureau of Fire Prevention.
The Bureau of Fire Prevention shall consist of the Fire Code Official, also
referred to herein as the Fire Marshal and such other persons as may be
appointed by the Village President with the advice and consent of the Board of
Trustees. The Fire Code Official shall be deemed to be the Code

SECTION EIGHT: DISTRICTS IN WHICH STORAGE OF FLAMMABLE
LIQUIDS IN OUTSIDE ABOVE GROUND TANKS AND BULK STORAGE OF
LIQUEFIED PETROLEUM GASES ARE PROHIBITED OR RESTRICTED -
REPEALED. Section 10-9, titled "Districts in Which Storage of Flammable Liquids in
Outside Above Ground Tanks and Bulk Storage of Liquefied Petroleum Gases are Prohibited
or Restricted," of Article 1, titled "In General," of Chapter 10, titled "Fire Prevention," of the
Village Code is hereby repealed in its entirety and reserved for future use.
SECTION NINE: PUBLIC BUILDINGS - REPEALED. The following sections
of Article 2, titled "Public Buildings," of Chapter 10, titled "Fire Prevention," of the Village
Code are hereby repealed and reserved for future use:
A. Section 10-1, titled "Responsibility for Maintenance and Safety of Premises,
Equipment, and Apparatus";

C. Section 10-14, titled "Fire Drills in Schools";
D. Section 10-16, titled "Doors of Public Buildings to Open Outward"; and

SECTION TEN: PUBLIC GATHERINGS - REPEALED. Article 3, titled
"Public Gatherings," of Chapter 10, titled "Fire Prevention," of the Village Code is hereby
repealed and reserved for future use.
SECTION ELEVEN: PROPERTY MAINTENANCE CODE. Section 13-1, titled
"Property Maintenance Code," of Article 1, titled "In General," of Chapter 13, titled
"Housing," of the Village Code is hereby amended to read as follows:
"Sec. 13-1. Property Maintenance Code:
The 20122018 Edition of the International Property Maintenance Code, as
published by the International Code Council, Inc., is hereby adopted by
reference and incorporated as if fully set forth herein, with the following
modifications:

Section 111.1 (Application For Appeal) is amended to read as follows:
Any person directly affected by a decision of the code official or a notice
or order issued under this code, or under section 6-25 of the Deerfield
municipal code, as amended, shall have the right to appeal to the board
of appeals, provided that a written application for appeal is filed within
twenty (20) days after the day the decision, notice or order was served.
An application for appeal shall be based on a claim that the true intent
of this code, or of sections 6-23 through 6-25A of the Deerfield municipal
code, or the rules legally adopted thereunder have been incorrectly
interpreted, the provisions of this code or such sections do not fully
apply, or the requirements of this code or such sections are adequately
satisfied by other means.

SECTION TWELVE: HEATING REQUIREMENTS FOR RESIDENTIAL
RENTAL DWELLINGS - REPEALED. Article 2, titled "Heating Requirements for
Residential Rental Dwellings," of Chapter 13, titled "Housing," of the Village Code is hereby
repealed in its entirety and reserved for future use.
SECTION THIRTEEN: PLUMBING CODE ADOPTED — REPEALED AND
REPLACED. Section 16-2, titled "Plumbing Code Adopted," of Article 2, titled "In General,"
of Chapter 16, titled "Plumbing and Sewers," of the Village Code is hereby repealed and
replaced in its entirety as follows:
"Sec. 16-2. Adoption of the Illinois Plumbing Code:
The Village acknowledges and affirms that the Illinois pPlumbing ILicense
law, 225 Illinois Compiled Statutes 320/0.01 et seq., and the Illinois
pPlumbing eCode adopted thereunder, 77 Illinois administrative code 890.110
et seq., govern all plumbing work performed within the Village. The Illinois
plumbing code is hereby adopted and incorporated as if fully set forth herein."
SECTION FOURTEEN: EFFECTIVE DATE. This Ordinance shall be in full
force and effect after its passage, approval and publication in pamphlet form as required by
law on October 1, 2019.
