ORDINANCE NO. 0-21-18
AN ORDINANCE AMENDING "THE DEERFIELD ZONING ORDINANCE 1978,"
AS AMENDED, TO CLARIFY THE VILLAGE'S PROHIBITION ON
SHORT-TERM RENTALS
WHEREAS, the Village of Deerfield is a home rule municipal corporation in
accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970;
and
WHEREAS, short-term rentals of residential property for less than 30 days ("Short -
Term Rentals' are not currently permitted in the Village under "The Deerfield Zoning
Ordinance 1978," as amended ("Zoning Code'; and
WHEREAS, to protect and secure the public health, safety, and welfare, and to
eliminate the negative impacts that Short -Term Rentals can have on the residential areas of
the Village, the Village Board of Trustees desires to update the Zoning Code to: (i) make more
explicit the Village's general prohibition of Short -Term Rentals; and (ii) clarify the types of
rentals that are prohibited (collectively, "Amendment'; and
WHEREAS, a public hearing of the Plan Commission of the Village of Deerfield to
consider the Amendment was duly advertised in the Deerfield Review on March 11, 2021,
and held on April 8, 2021; and
WHEREAS, on April 8, 2021, the Plan Commission voted to recommend approval of
the Amendment, in accordance with Section 13.10-C of the Zoning Code; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interests of the Village to approve the Amendment to the Zoning Code;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as the findings of the Village Board.
SECTION TWO: APPROVAL OF AMENDMENT. Section 14.02, titled
"Definitions," of Article 14, titled "Rules and Definitions," of the Zoning Code is hereby
amended to read as follows and add the following definition in alphabetical order:
"14.02 Definitions
SHORT-TERM RENTAL_ Part or all of a dwelling or dwelling unit that
is rented for transient occupancy by guests for a period shorter than
30 consecutive days The term "short-term rental" does not include:

it hotels or motels as defined in this Section: (ii) dwelline units i
xwlti-unit buildings owned or rented by a business and used fQr
transient occ ancv by that business's employees: or Iiii) the rental of
a dwelline or dwelling unit pursuant to a rental agreement executed
in coniunction with a contract to sell 4e dwelline unit.
SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law.
