WHEREAS, MAVER ROSSET is the owner and party in-
terested in the property hereinafter referred to as Rosset's
property, described as follows:
That part of the South West quarter of the
South East quarter of Section 33, Township
43 North, Range 12, East of the 3rd P.M.,
described as follows: Beginning at a
point in the center line of Waukegan Road,
903.21 feet North Westerly from its inter-
section with the South line of said South
West quarter of the South East quarter of
Section 33 and running thence North Westerly
along the center line of Waukegan Road,
146 Feet; thence South Westerly at right
angles to said center line 250 feet; thence
South Easterly parallel with the center
line of Waukegan Road, 146 feet and thence
North Easterly 250 feet to the place of
beginning, in Lake County, Illinois,
and is willing to undertake the construction by private con-
tract and pay the cost of underground improvements, consisting
in whole of a sanitary sewer extension in the right -of -way of
Waukegan Road in the Village of Deerfield, a distance of a
length of approximately 625 feet from the existing sanitary
sewer, which is located approximately 360 feet North of County
Line Road)to the North line of Rosset's property, all in ac-
cordance with certain plans and specifications heretofor sub-
mitted; and
WHEREAS, said improvements when constructed may be
made available to and will be a benefit to certain properties
presently owned by Mallin, Callaghan, Marshall, Ullman and
Rosset, and fronting on the East and West sides of Waukegan
Road, both North and South of the Rosset property and as fur-
ther outlined on Exhibit "A" attached, hereto, and made a part
hereof and upon acceptance and approval of the Village will
become public improvements; and
WHEREAS, the construction of said improvements by
private contractor will result in substantial savings to persons
or property owners having present or future use thereof, as
compared with.the costs of the construction of such improve-
ments by special assessment; and
WHEREAS, the said MAVER ROSSET proposes to con -
struct said improvements by private contract upon the condi-
tion that the Village of Deerfield be not charged with any
part of the cost thereof, and with the understanding that
the Village requires the owners of the benefited property
desiring to connect to and utilize said improvements reim-
burse MAVER ROSSET for such property owner's proportionate
share of the cost of the construction thereof.
NOW, THEREFORE, BE IT"ORDAINED BY THE PRESIDENT
AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE
AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That upon completion of the construction
ONE: of said improvements and upon acceptance
and approval thereof by the Village,
title to said improvements and all rights appurtenant thereto
shall be in the Village, and said improvements shall become
a part of the Village sewer system and thereafter shall be
maintained by the Village in the same manner as all other
public improvements.
SECTION That upon completion of said improvements
TWO: and acceptance and approval thereof by the
Village and for a period of ten (10) years
thereafter, no person, firm or corporation, excepting MAVER
ROSSET shall connect to said improvements for the purpose of
providing service to the certain properties presently owned by
Mallin, Callaghan, Marshall, Ullman and Rosset, and fronting
on the East and West sides of Waukegan Road, both North and
South of the Rosset property, and as further outlined on
Exhibit "A" attached, hereto, and made a part hereof, without
first obtaining a permit therefor. No such permit shall be
issued by the Village unless the applicant shall,submit evi-
dence of payment to MAVER ROSSET, or his successors and
assigns, of a sum equal to the following connection fee:
