AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
ESTABLISHMENT OF A MEDICAL OFFICE
(730 Waukegan Road)
WHEREAS, One Medical Group, Inc., a California corporation ("Applicant"), is the
lessee of that certain property located at 730 Waukegan Road, Unit, in Deerfield, Illinois, and
legally described in Exhibit A attached and, by this reference, made a part of this Ordinance
("Property'); and
WHEREAS, Kirby Limited Partnership ("Owner's, is the record owner of the
Property; and
WHEREAS, the Property is located entirely within the Deerfield Square Commercial
Planned Unit Development ("Deerfield Square PUD'); and
WHEREAS, the Deerfield Square PUD is located within the C-1 Village Center
District of the Village ("C-1 District'; and
WHEREAS, on August 3, 1998, the Village Board adopted Ordinance No. 0-98-34
approving a final development plan ("Final Development Plan's for the development and
maintenance of a Commercial Planned Unit Development for the Deerfield Square PUD,
which Final Development Plan has been amended from time to time; and
WHEREAS, the Applicant desires to develop and operate a medical office ("Proposed
Medical Office's on the Property; and
WHEREAS, pursuant to Section 5.01-C of the "Deerfield Zoning Ordinance 1978," as
amended ("Zoning Ordinance'), medical offices may be operated on the ground floor level
in the C-1 District only upon the issuance of a Class A special use permit; and
WHEREAS, pursuant to Section 13.11 of the Zoning Ordinance, the Applicant, with
the consent of the owner, has filed an application with the Village for a Class A special use
permit ("Special Use Permit') to operate the Proposed Medical Office on the ground floor of
the Property ("Application's; and
WHEREAS, a public hearing of the Plan Commission of the Village of Deerfield to
consider the Application was duly advertised in the Deerfield Review on October 22, 2020 and
held on November 12, 2020; and
WHEREAS, on November 12, 2020, the Plan Commission considered the Application
at its meeting and adopted findings, recommending approval of the Application; and
WHEREAS, the Village Board has determined that the Special Use Permit complies
with the required standards for special use permits as set forth in Article 13 of the Zoning
Ordinance; and

WHEREAS, consistent with the Plan Commission recommendation, the Village
Board has determined that it will serve and be in the best interests of the Village and its
residents to approve the Special Use Permit, in accordance with, and subject to, the
conditions, restrictions, and provisions of this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as the findings of the Village Board.
SECTION TWO: APPROVAL OF SPECIAL USE PERMIT. Subject to, and
contingent upon, the conditions, restrictions, and provisions set forth in Section Three of this
Ordinance, the Village Board hereby approves the Special Use Permit for the Property to
allow for the Proposed Medical Office, in accordance with, and pursuant to, Article 13 of the
Zoning Ordinance and the home rule powers of the Village.
SECTION THREE: CONDITIONS. Notwithstanding any use or development right
that may be applicable or available pursuant to the provisions of the Village Code or the
Zoning Ordinance, or any other rights the Applicant may have, the approvals granted in
Section Two of this Ordinance is hereby expressly subject to and contingent upon the
development, use, and maintenance of the Property in compliance with each and all of the
following conditions:
A. Compliance with Plans. Proposed Plans. The development, use, operation,
and maintenance of the Property must comply with the plans in Exhibit B
attached to and, by this reference, made a part of this Ordinance ("Plans',
except for minor changes and site work approved by the Village Principal
Planner in accordance with all applicable Village standards.
B. Compliance with Regulations. The development, use, operation, and
maintenance of the Property must comply with all applicable Village codes and
ordinances, as the same have been or may be amended from time to time,
except to the extent specifically provided otherwise in this Ordinance.
C. Compliance With Recommendations of the Appearance Review Commission.
Notwithstanding anything to the contrary in the plans set forth in Section 6.A
of this Ordinance, the development, use, operation, and maintenance of the
Property must be consistent with any Appearance Review Commission
Certificate of Approval.
SECTION FOUR: RECORDATION, BINDING EFFECT. A copy of this
Ordinance shall be recorded in the Office of the Lake County Recorder of Deeds against the
Property. This Ordinance and the privileges, obligations, and provisions contained herein
run with the Property and inure to the benefit of, and are binding upon, the Applicant and
its personal representatives, successors, and permitted assigns.
SECTION FIVE: FAILURE TO COMPLY WITH CONDITIONS. Upon the
failure or refusal of the Applicant to comply with any or all of the conditions, restrictions, or

provisions of this Ordinance, in addition to all other remedies available to the Village, the
approvals granted in Section Two of this Ordinance ("Approvals' may, at the sole discretion
of the Village Board, by ordinance duly adopted, be revoked and become null and void;
provided, however, that the Village Board may not so revoke the Approvals unless it first
provides the Applicant with two months advance written notice of the reasons for revocation
and an opportunity to be heard at a regular meeting of the Village Board. In the event of
such revocation, the Village Manager and Village Attorney are hereby authorized and
directed to bring such zoning enforcement action as may be appropriate under the
circumstances. Notwithstanding the foregoing or anything else contained in this Ordinance,
neither the Applicant's failure to comply with this Ordinance, nor anything else contained
herein, shall affect or restrict Applicant's rights to use the Property as otherwise permitted
by the Zoning Ordinance.
SECTION SIX: AMENDMENTS. Any amendment to any provision of this
Ordinance may be granted only pursuant to the procedures, and subject to the standards and
limitations, provided in the Zoning Ordinance for the granting of special use permits and
planned unit developments.
SECTION SEVEN: EFFECTIVE DATE.
A. This Ordinance will be effective only upon the occurrence of all of the following
events:
Passage by the Village Board by a majority vote in the manner required
by law;
2. Publication in pamphlet form in the manner required by law;
The filing by the Applicant and Owner with the Village Clerk of a fully
executed Unconditional Agreement and Consent, in the form of
Exhibit C attached to and, by this reference, made a part of this
Ordinance, to accept and abide by each and all of the terms, conditions,
and limitations set forth in this Ordinance and to indemnify the Village
for any claims that may arise in connection with the approval of this
Ordinance; and
Recordation of this Ordinance, together with such exhibits as the
Village Clerk deems appropriate for recordation, with the office of the
Recorder of Lake County.
B. In the event that the Applicant does not deliver fully executed copies of the
Unconditional Agreement and Consent within 30 days after the date of final
passage of this Ordinance by the Village Board, as required by Section 7.A.3
of this Ordinance, the Mayor and Board of Trustees will have the right, in their
sole discretion, to declare this Ordinance null and void and of no force or effect.

SUBJECT: Parking Evaluation
Deerfield Square Shopping Center
Deerfield, Illinois
This memorandum summarizes the results of a parking evaluation prepared by Kenig, Lindgren,
O'Hara, Aboona, Inc. (KLOA, Inc.) for the Shops at Deerfield Square commercial development
located within Deerfield Square in Deerfield, Illinois. The parking evaluation evaluates the
adequacy of the parking supply within Deerfield Square in accommodating the parking projected
to be generated by the proposed One Medical primary care medical office building and cryotherapy
center well as additional parking demand that will be generated by the full occupancy of the retail
center.
Existing Parking Demand
In order to determine the existing parking demand at Deerfield Square, KLOA, Inc. conducted
parking occupancy surveys conducted on Thursday, October 29, 2020 from 10:00 A.M. to 8:00
P.M. The results of the surveys are summarized in Table 1. Figure 1 shows the parking fields that
were surveyed within Deerfield Square. It should be noted that parking surveys were not conducted
on Saturday since the proposed use will not be open on weekends.
As can be seen, the peak parking demand at Deerfield Square was 333 spaces (38 percent
occupancy) occurring at 12:00 P.M. Furthermore, the peak parking demand drops after 12:00 Noon
with the demand considerably lower during the evening hours. This is primarily due to the large
amount of office space at Deerfield Square which has a parking demand that peaks middays on
Monday through Friday and decreases substantially in the evenings, allowing other retail and
restaurant uses to share this excess space. It should be noted that at the time the parking occupancy
surveys were conducted, there was approximately 26,989 square feet of vacant retail space.
Due to the on-going Covid-19 pandemic, the results of the parking occupancy survey were
compared to previous counts conducted in 2008, 2010, 2011, 2013, and 2016 which indicated that
the shopping center had a peak parking demand of 70 to 78 percent. However, taking into
consideration the increase in vacant retail space and changes to the shopping center (approximately
20,000 s.f. more than in 2016), the existing parking occupancy surveys are expected to be
approximately 75 percent less than they would in a pre-Covid condition.

One Medical Operations and Projected Parking Demand
As proposed, One Medical will occupy 5,000 square -feet of the approximately 26,989 square -feet
of vacant space within Deerfield Square. The medical office will occupy vacant space located at
730 Waukegan Road that was previously occupied by Dao Sushi. The clinic will be open between
8:00 A.M. and 6:00 P.M. Monday Through Friday and site visits are made by appointment only.
There will be up to nine providers at any given time each occupying their own consultant room,
two staff members utilizing the large consultant room, two to three general admins/staff at
any given time. Furthermore, each consultant room can accommodate one patient, except for the
large room which can accommodate two patients, for a total of approximately 11 patients at any
given time.
Based on the Village of Deerfield's Zoning ordinance, medical offices are required to provide four
patient parking spaces for each staff doctor, two spaces for every three employees and one space
for each doctor. This results in 49 required parking spaces for One Medical. The 49 required
parking spaces will be utilized as the estimated peak parking demand of One Medical in order to
provide a conservative analysis. However, it should be noted that with wait times averaging less
than two minutes, it is anticipated that there will be minimal parking overlap for patients and as
such, it is anticipated that the peak parking demand for One Medical would be much less, ranging
from 25 to 30 spaces.
The half-hourly distribution for One Medical (based on the 49 required parking spaces) was based
on information published in the Urban Land Institute's (ULI) Shared Parking manual, 3rd Edition
and took into consideration the proposed hours of operation. Table 2 summarizes the half-hourly
distribution of parking demand for One Medical.

Vacant Space Parking Demands
At the time the parking occupancy surveys were conducted, there was approximately 26,989
square -feet of vacant retail space. However, as previously indicated, approximately 5,000 square -
feet will be occupied by One Medical.
Furthermore, approximately 8,593 square feet of the vacant space located on the west side of
Robert York Avenue as well as the existing Rhapsody Cafe is proposed to be redeveloped with a
five -story luxury apartment building containing 40 units and 90 parking spaces, of which, 61
parking spaces will be available for use by patrons of Deerfield Square.
As a result, there is a total of approximately 13,396 square -feet of vacant retail space within the
shopping center and there will be a net loss of approximately three parking spaces.
Based on the Village of Deerfield's Zoning Ordinance, the parking requirements for the above
uses are as follows:
Existing Vacant Retail (13,396 s.f.): one space per 200 square feet = 67 spaces
Proposed Luxury Apartments (20 one -bedrooms, 20 two -bedrooms): one and one-half spaces
per one -bedroom unit and two spaces per two-bedroom units = 70 spaces
Table 3 show the hourly distribution of parking demand for each of the previously described uses.
The hourly distribution was based on the Urban Land Institute's (ULI) Shared Parking manual.
As can be seen from Table 3 the peak weekday occupancy will be 74 spaces occurring between
7:00 P.M. and 8:00 P.M.

Table 4 shows the hourly distribution of the parking demand for Deerfield Square, taking into
consideration the existing demand as determined from the parking counts, adjustments to the
existing parking demand to account for normal (non-Covid) conditions, as well as the demand of
the existing vacant retail space within the shopping center and the proposed One Medical office.
As can be seen from Table 4, the peak occupancy on Thursday is projected to be 674 spaces (78
percent occupancy) occurring at 12:00 P.M. Therefore, the parking supply within Deerfield Square
on a weekday will be adequate in accommodating the future parking demand of the existing center
as well as the proposed developments and tenants within Deerfield Square.
However, it should be noted that even if the existing parking occupancy survey is increased by
100 percent (versus the assumed 75 percent), the total projected peak parking occupancy for the
shopping center would not exceed 90 percent.
Coll C1Usion
Based on the preceding parking evaluation, the following conclusions have been made:
{ The results of the parking occupancy surveys indicated that the peak parking demand at
Deerfield Square did not exceed 38 percent of the available parking. When compared to
previously conducted parking occupancy surveys and taking into consideration the increase
in vacant retail space and changes to the shopping center, it is anticipated that existing peak
parking demand is approximately 75 percent less than they would in a pre-Covid condition.
The peak parking demand drops after 12:00 Noon with the demand considerably lower
during the evening hours. This is primarily due to the large amount of office space at
Deerfield Square.
Based on the Village of Deerfield's Zoning ordinance, One Medical is required to provide
49 parking spaces.
The parking supply of Deerfield Square will be adequate in accommodating the total
projected parking demand taking into consideration the existing parking demand adjusted
to reflect pre-Covid conditions, the additional parking demand that will be generated by
the full occupancy of the center and the parking projected to be generated by One Medical.
Even if the findings of the existing parking occupancy survey are increased by 100 percent.
The total projected peak parking demand taking into consideration the vacant retail space
and the proposed One Medical office would not exceed 90 percent.

UNCONDITIONAL AGREEMENT AND CONSENT

WHEREAS, On, Medical Group Inc., a California corporation ("Applicant"), is the J
lessee of that certain property located at 730 Waukegan Road, in Deerfield, Illinois, and
legally described in Exhibit A attached and, by this reference, made a part of this Agreement
("Property's; and
WHEREAS, Kirby Limited Partnership ("Owner's, is the record owner of the
Property; and
WHEREAS, the Deerfield Square PUD is located within the C-1 Village Center
District of the Village ("C-1 District's; and
WHEREAS, the Applicant desires to develop and operate a medical office ("Proposed
Medical Office' on the Property; and
WHEREAS, pursuant to Section 5.01-C of the "Deerfield Zoning Ordinance 1978," as
amended ("Zoning Ordina.nce'�, medical offices may be operated on the ground floor level
in the C-1 District only upon the issuance of a class A special use permit; and
WHEREAS, pursuant to Section 13.11 of the Zoning Ordinance, the Applicant, with
the consent of the owner, filed an application with the Village for a Class A special use permit
("Special Use Permit') to operate the Proposed Medical Office on the ground floor of the
Property; and
WHEREAS, Ordinance No. D- 21- x , adopted by the Village Board on i a
2021 ("Ordinance's, grants the Special Use Permit; and
WHEREAS, Section 7.A.3 of the Ordinance provides, among other things, that the
Ordinance will be of no force or effect unless and until the Applicant has filed, within 30 days
following the passage of the Ordinance, its unconditional agreement and consent to accept
and abide by each and all of the terms, conditions, and limitations set forth in the Ordinance;
NOW, THEREFORE, the Applicant and Owner do hereby agree and covenant as
follows:
1. The Applicant and Owner hereby unconditionally agree to, accept, consent to,
and will abide by each and all of the terms, conditions, limitations, restrictions, and
provisions of the Ordinance.
2. The Applicant and Owner acknowledge that public notices and hearings have
been properly given and held with respect to the adoption of the Ordinance, has considered
the possibility of the revocation provided for in the Ordinance, and agree not to challenge any
such revocation on the grounds of any procedural infirmity or a denial of any procedural right.
3. The Applicant and Owner acknowledge and agrees that the Village is not and

will not be, in any way, liable for any damages or injuries that may be sustained as a result
of the Village's granting the Special Use Permit or adoption of the Ordinance, and that the

insure the Applicant or Owner against damage or injury of any kind and at any time.
4. The Applicant and Owner hereby agree to hold harmless and indemnify the
Village, the Village's corporate authorities, and all Village elected and appointed officials,
officers, employees, agents, representatives, and attorneys, from any and all claims that may,
at any time, be asserted against any of such parties in connection with the Village's adoption
of the Ordinance granting the Requested Relief.
