O-20-16VILLAGE OF DEERFIELD ORDINANCE NO. 2020- 0-20-16 AN ORDINANCE AMENDING "THE DEERFIELD ZONING ORDINANCE OF 1978," AS AMENDED, TO PERMIT ANIMAL HOSPITALS AS A CLASS B SPECIAL USE IN THE C-1 VILLAGE CENTER DISTRICT WHEREAS, the Village is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs; and WHEREAS, Nordstrom & Associates, P.C., an Illinois Professional Corporation dib/a River Trails Animal Hospital ("Applicant"), is the lessee of that certain parcel of real property located at 711 Waukegan Road, Deerfield, Illinois ("Property's; and WHEREAS, the Property is located in the Deerfield Centre Commercial Planned Unit Development, within the C-1 Village Center District of the Village ("C-1 Distri.ct'�; and WHEREAS, the Applicant desires to operate an animal hospital on the Property; and WHEREAS, animal hospitals are not allowed in the C-1 District as either permitted or special uses; and WHEREAS, the Applicant submitted an application to the Village seeking approval of, among other things, an amendment to the "Deerfield Zoning Ordinance 1978," as amended ("Zoning Ordi-nance'� to make animal hospitals an allowed use in the C-1 District upon the issuance of a special use permit ('Proposed Amendment'; and WHEREAS, a public hearing of the Plan Commission of the Village of Deerfield to consider the Proposed Amendment was duly advertised in the Deerfield Reuiew on July 2, 2020 and held on July 23, 2020; and WHEREAS, on July 23, 2020, the Plan Commission considered the Proposed Amendment at its meeting and adopted findings, recommending approval of the Proposed Amendment; and WHEREAS, the Village Board has considered the standards for amendments set forth in Section 13.10 of the Zoning Ordinance; and WHh7Rh.AS, the Village Board has determined that it will serve and be in the best interest of the Village to adopt of the Proposed Amendment, as set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: { 007.16679.2 } NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as the findings of the Village Board. SECTION TWO: ANIMAL HOSPITALS. Section 5.01-C, titled "Special Uses," of Article 5, titled "Commercial Districts," of the Zoning Ordinance is hereby amended to read as follows: "5.01-C Special Uses 2. Special Uses — Class B permitted only as a Special Use in all locations in the C-1 Village Center District subject to the provisions of Article 13.11 and if in addition to meeting the standards set forth in Article 13.11-D, the applicant can demonstrate that the establishment of the Special Use will not be injurious to the character of the C-1 Village Center District as a retail center for the Village. b. Service Uses. (1) Automobile Service Stations. (2) Banks, Savings and Loan Associations and other Financial Institutions, with or without drive-in facilities. (3) Drive-through automatic teller machine operated in connection with a Bank, Savings and Loan or other Financial Institution. (4) Drive-thru car wash facility providing adequate vehicle stacking space when part of a C-1 Village Center District PUD of more than five acres in size. (5) Mail and parcel packaging, shipping and receiving, and business service store. (6) Nail salons providing manicures and pedicures, which may include ancillary service such as massage and waxing services. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
