ORDINANCE NO. 2020-0-20-12
AN ORDINANCE AMENDING CHAPTERI5, MORALS AND CONDUCT, OF THE
MUNICIPAL CODE TO REGULATE NOISE GENERATED BY POWERED
LANDSCAPING EQUIPMENT
WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant
to the provisions of Article VII, Section 6 of the Illinois Constitution; and
WHEREAS, pursuant to Section 15-16 of "The Municipal Code of the Village of
Deerfield, Illinois, 1975", as amended ( "Village Code'), the Village regulates nuisances caused
by loud, raucous, or jarring noises (`2Voise Regulations'); and
WHEREAS, the Village Board desires to amend the Noise Regulations pursuant to
this Ordinance to limit nuisance noises generated by the use of powered landscaping
equipment by establishing time restrictions and related limitations on the use of such
powered equipment; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interests of the Village and its residents to amend the Noise Regulations pursuant to this
Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: LANDSCAPE NOISE REGULATIONS. Section 15-16, entitled
"Noise," of Article 1, entitled "Offenses Against Public Peace, Safety, and Order," of Chapter
15, titled "Morals and Conduct," of the Village Code is hereby amended to add a new
Subsection 15-16(b)(18), to read as follows:
"15-16 Noise
(b) The following acts, among others, are hereby declared to be loud, raucous,
jarring noises and a nuisance in violation of this section, but said enumeration
shall not be deemed to be exclusive, namely:

SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish
this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and
effect ten days after its passage, approval, and publication in the manner provided by law.
