O-20-11VILLAGE OF DEERFIELD ORDINANCE NO. 2020- 0-20-11 AN ORDINANCE AMENDING SECTIONS 3-8 and 3-9 OF THE VILLAGE CODE TO CREATE A CLASS D-3 LIQUOR LICENSE CLASSIFICATION TO ALLOW SERVICE OF ALCOHOLIC BEVERAGES IN PRIVATE DINING FACILITIES LOCATED WITHIN INSTITUTIONAL RESIDENTIAL FACILITIES WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, pursuant to Chapter 3 of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("[Tillage Code'), the Village regulates and licenses the sale and service of alcoholic beverages within the Village ('Alcoholic Beverage Regulations'); and WHEREAS, the Village Board desires to amend the Alcoholic Beverage Regulations pursuant to this Ordinance to create a new Class D-3 license classification to authorize the sale and service of alcoholic liquor to residents of institutional residential facilities and their guests who are dining in private dining areas within those facilities ("Class D-3 License"), and to revise the Annual Fee Resolution to establish the license fee for the new Class D-3 License; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: CLASS D-3 ALCOHOLIC BEVERAGE LICENSE. Section 3-8, entitled "Classes of Licenses," of Article 1, entitled "Licensing and Regulations," of Chapter 3, titled "Alcoholic Beverages," of the Village Code is hereby amended to add a new Class D- 3 License classification, to be inserted in alphabetical order within Section 3-8, to read as follows: "3-8= Classes of Licenses. Every person, firm or corporation engaged in the retail sale of alcoholic liquor in the Village shall possess a license of one of the following classes: Claim D-3 which shall authorize the retail sale of alcoholic liquor in a private mine facility located in an institutional residential_ facility, including without limitation nursing homes elderly and/or handicapped haleseent homes residential care facilities or similar institutional residential facilitia- my where such retail sale is with and incidental to the preparation and service of meals to residents of the institutional residential facility and their invited guests " 100113570.11 Additions are bold and doubl and rT�; deletions aFe struel- thraagh. SECTION THREE: NUMBER OF CLASS D-3 ALCOHOLIC BEVERAGE LICENSES. Section 3-9, entitled "Number of Licenses," of Article 1, entitled "Licensing and Regulations," of Chapter 3, titled "Alcoholic Beverages," of the Village Code is hereby amended to add the following in alphabetical order within Section 3-9, to read as follows: "3-9: Number of Licenses. There shall be issued in the Village no more than: Class D-3 0 SECTION FOUR: CLASS D-3 LICENSE FEE. Exhibit A of the Annual Fee Resolution is hereby amended to add a license fee for the Class D-3 License in correct alphabetical order as follows: CLASSIFICATION MUNICIPAL CODE REFERENCE DESCRIPTION FEE FOR CY 19 (A) ALCOHOLIC$ BEVERAGES Class D-3 - annual 2.500.00 SECTION FIVE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION SIX: EFFECTIVE DATE. This Ordinance will be in full force and effect ten days after its passage, approval, and publication in the manner provided by law.
