AN ORDINANCE AMENDING SECTIONS 6.01-C AND 9.02-C OF "THE
DEERFIELD ZONING ORDINANCE OF 1978," AS AMENDED, TO PERMIT A
PRIVATE PRESCHOOL AS A SPECIAL USE AND SIGNS FOR PRIVATE
PRESCHOOL USES IN THE I-1 OFFICE, RESEARCH, AND RESTRICTED
INDUSTRIAL DISTRICT
WHEREAS, the Village is a home rule municipal corporation in accordance with
Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and
WHEREAS, Higher Ground Education, Inc., a Delaware corporation ("Applicant's
is the lessee of that certain property located at the address commonly known as 1085 Lake
Cook Road, Deerfield, Cook County, Illinois ("Property's; and
WHEREAS, the Applicant desires to: (i) renovate and use the existing building on the
Property for a private preschool; and (ii) construct signage for a private preschool on the
Property (collectively, the "Proposed Development'; and
WHEREAS, the Property is located in the I-1 Office, Research, and Restricted
Industrial District ("I-1 District'; and
WHEREAS, private preschools are not permitted uses in the I-1 District; and
WHEREAS, signs associated with private preschools are not permitted in the I-1
District; and
WHEREAS, the Applicant submitted an application to the Village seeking approval
of, among other things, amendments to the "Deerfield Zoning Ordinance 1978," as amended
("Zoning Ordinance's to: (i) make private preschools an allowed use in the I-1 District upon
the issuance of a special use permit; and (ii) permit monument and wayfinding signs
associated with private preschools in the 1-1 District (collectively, the "Proposed
Amendments'; and
WHEREAS, a public hearing by the Plan Commission to consider the Proposed
Amendments to the Zoning Ordinance was duly advertised on November 21, 2019 in the
Deerfield Review, and was held on December 12, 2019; and
WHEREAS, on December 12, 2019, the Plan Commission approved findings of fact in
support of the Proposed Amendments, in accordance with and pursuant to Section 13.10 of
the Zoning Ordinance, and voted to recommend approval of the Proposed Amendments by
the Village Board; and
WHEREAS, the Village Board has considered the standards for amendments set
forth in Section 13.10 of the Zoning Ordinance; and
WHEREAS, the Village Board has determined that it will serve and be in the best

interest of the Village to adopt of the Proposed Amendments, as set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: AMENDMENTS TO SECTION 6.01-C. Section 6.01-C, titled
"Special Uses," of Article 6, titled "Industrial Districts," of the Zoning Ordinance is hereby
amended to read as follows:
"6.01-C Special Uses
The following special uses are permitted in the I-1 Office, Research, Restricted
Industrial District when authorized in accordance with the procedures for
Special Uses as set forth in Article 13, Administration and Enforcement.

A private preschool provided such use is developed as
part of Planned Unit Development the parcel upon
which the use is developed shall include a minimum of
4.5 acres, and such Planned Unit Development is located
adjacent to Interstate Highway 94 (also known as the
Edens Spur)."
SECTION THREE: AMENDMENTS TO SECTION 9.02-C PUD. Section 9.02-C
PUD, titled 1-1 Office, Research, Restricted Industrial Districts, Planned Unit
Development," of Article 9, titled "Signs," of the Zoning Ordinance is hereby amended to read
as follows:
"9.02-C PUD I-1 Office, Research, Restricted Industrial Districts
Planned Unit Development
Because of the unique nature of Planned Unit Developments in the I-1 District,
including location within the Village, the tendency toward larger developments
and their special needs, the Village recognizes that exceptions to the strict
application of the following signage provisions may be necessary and desirable
to best serve the interests of the Village. Therefore, upon the recommendation
of the Plan Commission or the Board of Zoning Appeals, the Village Board of
Trustees may authorize such exceptions to the strict application of the
following provisions as they deem appropriate considering the signs in relation
to all aspects of the Planned Unit Development. In all I-1 Planned Unit
Developments only the following signs
are permitted and then only if accessory and incidental to a Permitted and
Special Use in such district.

Not more than two wall signs shall be
permitted for a private preschool. Wall signs
shall only contain the name and logo of the
school.

Not more than one on-site around sign shall
be permitted for a private preschool.
Ground signs shall only contain the name,
logo, and address of the school.
b. Area
01 Wall Sign
The maximum surface area of each wall sign
shall not exceed 21 square feet in area.
Ground Sian
The maximum surface area of each ground
sign shall not exceed 33 square feet in area.
C. Location

of the principle building that fronts on a
private road or on a wall with an
entranceway to the private preschool.

SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law.
