AN ORDINANCE GRANTING A VARIATION FROM
THE PROVISIONS OF THE ZONING ORD11NANCE
WITH RESPECT TO THE PROPERTY COMMONLY
KNOWN AS 705 -741 WAUKEGAN ROAD, DEERFIELD
WHEREAS, RAYMOND T. MEYER has petitioned for a variation from the
strict provisions of Paragraph 7.q of Section XVI of the Zoning Ordinance
of the,Village of Deerfield, passed May 4,.1953, as amended, to permit
the construction on the premises commonly known as 705 -741 Waukegan Road,
Deerfield, of a retail store having 13,700 square feet of first floor
and:Zbasement sales.area with provision for 120 off - street parking spaces;
and
WHEREAS, pursuant to notice duly published as regb,i) red by A•tatute, a
public hearing was held and conducted by the Zoning-Board of.Appeals of
the Village of Deerfield; and
WHEREAS, the Zoning Board,of Appeals has filed with the President
and Board of Trustees its written findings of fact and recommendation.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of.fact of the Zoning Board of Appeals
ONE: are hereby concurred in and adopted as the findings of
'fact of the President and Board of Trustees..
SECTION That there are practical difficulties and particular
TWO: haedship in the way of carrying out the strict letter
of the provisions of the Zoning Ordinance of the Village
of Deerfield as applied to petitioner's property which is legally described
as follows:
That part of Lot 8 in the "Owner's First Addition to Deerfield ",:
being a subdivision of part of the North Half of Section 33,,.Town-
ship 43 North, Range.12, East of the Third Principal Meridian,
according to the plat thereof recorded September 25, 1915, as Docu-
ment No. 161061, in Book "J" of Plats, pages 46 and 47, described as
follows,, to -wit: Commencing at the Northeast cornerof said Lot.8
and running thence South 30 East on the East line.of said lot, 88.5
feet; thence South 69 West 364:67 .feet to the center of Lincoln
Avenue; thence North 310 10" West along the centerline of said Avenue
129.62 feet to the Northwesterly corner of said Lot 8 and thence
Northeasterly to the placw of beginning (except therefrom that part
thereof falling within the limits of Lot'] of "Lynn's Whi tt,i,er Avenue
Subdivision "); also Lot 9 (excepting therefrom the Easterly 50 feet
thereof measured along a line drawn at right angles to the East line
of said.Lot 9) in aforementioned "Owner's First.Addition ", all being.

SECTION That a variation from the strict provisions of Paragraph
THREE: 7.q of Section XVI of the Zoning Ordinance of the Vil:bage
0 of Deerfield, passed May 4, 1953,.as amended, with respect
to the property hereinabove described is hereby granted so as to permit the'
construction and use of a building having no more than113,700 square feet,
of first floor and basement sales area and no second floor sales area, and
to provide in connection therewith not less than 120 off - street parking
spaces in accordance with the site plan attached hereto,

That the variation hereby granted is5

that there be compliance by
the petitioner with
