AN ORDINANCE AMENDING THE ZONING ORDINANCE
AND THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Section XXII 'of the Zoning Ordinance of the
ONE:: Village of Deerfield, Illinois, passed May 4, 1953,,
as amended, be" and.-the same is hereby further- amended.
by striking Subsecti ons A.. B. and C -thereof and susti tuti ng. i n lieu
thereof the following:
"A. Board of Zoning Appeals Established
There is hereby established a Board of Zoning.Appeals. Said
Board shall consist of seven (7) members appointed by the
President of the Village by and with 'the advice and consento6f
the Board of Trustees'. The- members'of• said board, firs't appointed,
shall serve respectively for the following terms:
One (1) for one (1) year.
One (1) for two (2) years.
One (1) for three (3) years
One (1)• for• four• (4) years.
One (1) for five (5) years.
One (1) for six (6) years.
One (1) for seven (7) years.'
The successor of each member.-so appointed shall serve for a term
of five (5) years. Vacancles shall be filled•by the President .
by and with the advice.and consent of the Board of Trustees for.
the unexpired term. Members•maylbe removed.by the President for
cause after written charges.-have, been fi led• and after a public •
hearing.
One of the mebers'so appointed 'shall -at the time of his.appoint-
ment be named as Chairman by the :President with the advice and'
consent.of the Board of Trustees. The Chairman, or in•his absence
the acting Chairman,.may administer oath and compel the attendance
of witnesses..
The Board may select one member as Secretary or nay employ a'
secretary ,to'keep.imi,hutes and maintain the- records of the Board'
of Zoning-Appeals of Zoning.-Appeals. whose• du•l y i t sha 1 1 : be to
keep a full and detailed record-of all its proceedings. Every
rule or regulation, every amendment or repeal thereof, and
every order, requirement, decision.-and determination of the Board
shall be filed - immediately in the office of the-Board and shall
be of public record.
B.. Meetings
All meetings of the Board of Zoning Appeals and all hearings
shall be open to the public. Meetings shall be held at the call
of the Chairman and at-such other times as the.Board.may determine.
Meetings may be called at the request of three (3) members of the
Board. The Board shall keep-minutes of its proceedi!hgs showing
the vote of each member upon every question decided by it, or if
any member is absent, or fails to vote, indicating such fact and
also keep records of its hearings and other official action.
Findings of.fact made by the Board and the reasons for its decision
shall be included in the minutes with respect to each matter heard
or considered by the Board.
The Board shall adopt its own rules of procedure not in conflict
with the provisions of thfs Ordinance or the applicable State
statutes, a copy of which and all amendments thereto to be filed
in the office of the Village Clerk.
C. Jurisdiction
The Board of Zoning Appeals shall hear and decide appeals from, and
review any order, requirement, decision, or determination, made by
the administrative official charged with the enforcement of this
Ordinance.
The Board of Zoning Appeals shall hear all applications for variations
to the provisions of the Zoning'Ordinance and'shall',submit to the
Village Board of Trustees its recommendations accompanied by findi,ngs
of fact specifying the reason or reasons therefor.
The.Board of Zoning Appeals shall also hear and decide all matters
referred to it or upon which it is required to'pass under the terms
of this Ordinance.
The concurring vote of four (4),members of the Board shall be necessary
to reverse any order, requirement, decision, or determination of the
officer from whom an appeal is taken or to decide in favor of the
applicant any matter wupon which it is required "to pass under this
.Ordinance; or-to recommend any variation or.modification in the
ordinance-to the corporate authorities." . •

SECTION That Article X of Chapter 8 of the Municipal

amended, be and the.same is hereby further
amended by striking said article in its entirety.
SECTION That all ordinances or parts of ordinances
THREE: in conflict with this Ordinance are, to the
extent of such conf lict,hereby repealed.
SECTION That this Ordinance shall be in full force
FOUR: and effect from and after its passage and
approval, as provided by law.
