O-66-23ORDINANCE NO. 0- 66-.23 AN ORDINANCE PROVIDING FOR REIMBURSEMENT OF COST OF WILMOT ROAD SANITARY SEWER WHEREAS, VALENTI BUILDERS, INC., a, corporation organized under the'laws of the State of Illinois., which is or was the owner or party interested in the property described as follows: Valenti's C,lavinia Subdivision Unit Three, being a.Subdivisioli of part of the East half of the North East quarter of Section 31, Township 43 North, Range 12, East of the Third Prinetpal Meridian, in Lake County, Illinois, and is willing to undertake the construction by pri>vate contract and pay the cost of underground improvements, consisting in whole or in part of sanitary sewer extensions along the West side of .Wilmot Road from the above - described subdivision to Deerfield Road, in the Village of Deerfield, Illinois, all in accordance with certain plans and speci- fications heretofore submitted; and WHEREAS, said improvements when constructed may be made available to and will be of benefit to certain properties fronting on the East side of Wilmot Road and lying between the center line of Central Avenue and a point 821.23 feet North thereof, and upon acceptance' and approval by this Village will become public improvements; and WHEREAS, the construction of said improvements by private contract will result in a substantial saving in cost to persons or property owners having present or future use thereof, as compared with the cost of the construction of such improvements by special assessment; and' WHEREAS, the said VALENTI BUILDERS, INC., a corporation, proposes to construct said improvements by private contract upon the condition that the Village of Deerfield be not charged with any part of. the cost thereof, and with the understanding that the Village require that the owners of the benefitted property hereinabove described and not a part of the portions of said subdivision owned by said VALENTI BUILDERS; INC. desiring to connect to and utilize said improvements, reimburse VALENTI BUILDERS, INC., a corporation, for such property owners' proportionate.. share of the cost of the construction thereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT -AND BOARD OF TRUSTEES OF THE-VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That upon completion of the construction of said . ONE: improvements and acceptance and Approval thereof by the Village,ati'tl`e r to said_ improvements and­all rights appurtenant thereto shall be in the Village, and said improve- ments shall become a part of the Village sewer system and thereafter shall be maintained by the Village in the same manner as all other public improvements. SECTION That upon completion of said improvements and. TWO: acceptance and ppproval by the Village and for a period of ten (10) year's thereafter, no person;' firm or corporation, excepting VALENTI BUILDERS, INC., shall connect to said improvements for the purpose of providing 'service to any property fronting on the East side of Wilmot Road between the center line of Central Avenue and a point 821.23 feet'North thereof, without first obtaining a permit therefor. No such -permit shall be issued by the Village unless the applicant shall, submit evidence of payment to VALENTI BUILDERS, INC., a corporation, it its successors and assigns, of a sum equal to TWO and 93.100ths ($2.93) DOLLARsSper lineal foot of the Wid:mot Road frontage of the property to be served by and utilizing said improvements. Such payment to.VALENTI i I. BUILDERS, INC. shall be in addition to the usual charges and fees established by ordinance end payable to the Village for the issuance of such .permits. SECTION That this Ordinance shall be-in full force and THREE: effect from and after its passage, approval and publ i cati.on, as provided by law.
