AN ORDINANCE AMENDING THE MUNICIPAL CODE OF
THE VILLAGE OF DEERFIELD (AN ORDINANCE REGULATING
AND LICENSING TAXICABS AND TAXICAB DRIVERS AND
PROVIDING PENALTIES FOR THE VIOLATION THEREOF
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Article VIII of Chapter 17 of the Municipal Code
ONE: of Deerfield of 1963, as amended, be and the same is
hereby further amended by striking said Article VIII
in its entirety and substituting in lieu thereof the following:
ARTICLE VIII: TAXICABS
SUB - ARTICLE I: CERTIFICATES OF PUBLIC CONVENIENCE
AND NECESSITY
SECTION 17.801.1: Definitions. The following words.and phrases
when used in this Sub - Article have the meanings as set out herein.
(a) Call box stand means a place alongside a street, or elsewhere
where the Village has authorized a holder of a certificate.of public con-
venience and necessity to install a telephone or call box for the taking
of calls and the dispatching of taxicabs.
(b) Certificate means a certificate-of public convenience and
necessity issued by the Village authorizing the holder thereof to conduct
a taxicab business in the Village of Deerfield.
(c) Cruising means the driving of a taxicab 6n the streets.,, alleys,
or public places of the Village of Deerfield in-search of, or soliciting : -'r
prospective passengers for hire.
(d) Driver's License means the permission granted by the Village
to "a person to drive a taxicab upon the.streets of the Village of Deer-
field.
(e) Holder: -means a person to whom a certificate of public con-
venience and necessity has been issued.
(f) Manifest means a daily record prepared by a taxicab driver
of all trips made by said driver showing time and place of origin, destin-
ation, number of passengers, and the amount of fare of each trip.-
(g) Open stand means a public place alongside the curb of a street
or elsewhere, in the Village of Deerfie -l'd, which has been designated by
the Village as reserved exclusively for the use of taxicabs.
(h) Person means an individual, a corporation or other legal entity,
a partnership,-and any unincorporated association.
(i) Rate card means a card issued by the Village for display in
each taxicab[ -which contains the rates of fare then in force.
(j) Taxicab means a

(1) Waiting time shall include the time when the taxicab is not

called, or the time consumed while standing because of conditions beyond
the control of the operator, but no charge shall be made for time lost
for inefficiency of the taxicab or its operator, or time consumed by
premature response to a call.
SECTION 17.801.2: Certificate-of Public Convenience and Necessity Required.
No person shall operate or permit a taxicab owned or controlled by him to be oper-
ated as a vehicle for hire upon the streets of the Village without navi;hgnfirst
obtained a certificate of public convenience and necessity issued by the Board
of Trustees. ,
SECTION 17.801.3 Application for Certificate. An.application for a
certificate shall be filed with the Village Manager upon forms provided by the
Village, and.said application shall be verified under oath and shall furnish the
following information:
(a) The name. and address of the applicant.
(b) The financial status of the applicant, including the amounts of all
unpaid judgments against -the applicant and the nature-of the transaction or acts
giving rise to said judgments.
(c) The experience of the applicant in the-transportation of passengers.
(d) Any facts which the applicant believes tend to prove that public con-
venience and necessity require the granting of a certificate.
(e) The number of vehicles to be operated or controlled by the applicant
and the location of proposed depots and terminaat;.
(f) .The color scheme or insignia to be used to designate the vehicle or
vehicles of the applicant:
(g) Such further information as the Manager of the Village may require.
SECTION.17.801.4: Public Hearing. Upon'the filing of an application, the
Village Manager shall submit same to the Board of Trustees and the Board of
.Trustees shall fix a time and place for a public hearing thereon. Notice of such
hearing shall be given to the applicant and to all persons to whom certificates
of public convenience and necessity have been theretofore issued. Due notice
shall also be given the general public by posting a notice of such hearing.in the
Village Hall. Any interested person may file with the Village Manager a memorandum
in support of or opposition to the issuance of a certificate.
SECTION 17.801.5: Issuance of Certificates If the Board of Trustees finds
that further taxicab service in the Village of Deerfield is required by the public
convenience and necessity and that the applicant is fit, wil.ling, and able to
perform such public transportation and to conform to the provisions of this
Ordinance, then the Board of Trustees shall direct the Village Manager, upon com-
pliance by applicant with the .prov.isions of this Ordinance, to issue a certificate
stating the name and address of the applicant, the number of vehicles authorized
under said certificate and the date of issuance, otherwise the application shall
be denied.
If the. Board of Trustees finds from the investigation and hearing that the
public convenience and necessity justify the issuance of a certificate, it shall
notify the applicant of its finding and within sixty days thereafter, the applicant
shall comply with the further provisions of this Ordinance for'the- issuance of a
certificate and the issuance of licenses for the vehicles to be operated.
If the Board of Trustees finds from such investigation and-hearing that the
public convenience and necessity do not justify the issuance of a certificate,
it shall forthwith notify the applicant of such finding.
SECTION 17.801.6: Indemnity Bond or°Liability Insurance Required. No
certificate of public convenience.and necessity shall be issued or continued in
operation unless the applicant has complied with all the provisions of this
Ordbnance and with all the provisions of the State law requiring proof of financial
responsibility of operators of motor vehicles used for the transportation of
passengers for hire (Chapter 95 -1/2, Section 8 -101 et seq. Illinois Revised.
Statutes (1965) and as hereafter amended). Before a certificate of public con-
venience and necessity is issued, the applicant shall submit to the Village Manager
a certificate of the Secretary of State of the State of Illinois for each motor
vehicle to be operated or controlled by the applicant evidencing that proof of
financial responsibility for each of said motor Vehicles has been submitted to the
Secretary of State and that the applicant has otherwise complied with the pro -
visions of sbi:d;-.State law.

Said license fees shall be for the calendar year and shall. be applied for on or
before January 1 of each year; provided that i:n case of licenses issued on
or after July 1 of each year the applicant shall be required to pay only 1/2
of the fee specified above.
Said fee shall be in addition to any other license or vehicle fee
established by ordinance.
SECTION 17.801.8: Transfer of Certificates. No certificate of public
convenience and necessity may be sold, assigned, mortgaged or otherwise
transferred without the consent of the Board of Trustees.
SECTION 17.801.9: Suspension and Revocation of Certificates. A cert-
ificate�issued under the, provisions of this Ordinance may be revoked or sus-
pended by the Board of..Trustees if the holder thereof has (a) violated any
of the provisions,of this Ordinance, (b) discontinued operations for more than
10 days, (c) has violated any ordinances of the Village of Deerfield, or the
laws of the United States or the State of Illinois, the violations of which
reflect unfavorably on the fitness of the holder to offer public transportation.
Prior to suspension or revocation, the holder shall be given 5 days
notice of the proposed action to be taken and shall have an opportunity.to
be heard.
SUB - ARTICLE 2: VEHICLES -- EQUIPMENT AND - MAINTENANCE,
SECTION 17.802.1: Vehicles Must be Licensed. Prior to the issuance
of a certificate of public convenience and necessity and prior to the use
and operation of any vehicle under the provisions of th1s Ordinance, said
vehicle shall be thoroughly examined and inspected by the Chief of Police
or a member of the Police Department duly authorized by the Chief of Police
and found to comply with the provisions of this Ordinance and such reason-
able rules and regulations as may be prescribed by.the Board of Trustees.
These rules and regulations shall be promulgated to provide safe transporta-
thiion and shall specify such requipment and regulatory devices as the Board
of Trustees shall deem necessary therefore.
When the Chief of Police finds that a vehicle has met the standards
established by the Board of Trustees, and the license fee paid, he shall
issue a license to that effect, which license shall be displayed on the
vehicle in such manner as the•Chief 6f Police shall direct.
SECTION 17.802.2: Inspection of Vehicles Generally; Semi - Annual Report.
The Chief of Police shall,rmbintain constant vigilance over all taxicabs and
see that they are kept in a condition of continued fitness for public use.
To this end, the Chief of Police shall inspect or cause to be inspected all
taxicabs, from time to time, or on the complaint of any person, or as often
as may be necessary. At least twice in each year the Chief of Police shall
make a written report of all such inspections to the Board of Trustees.
SECTIION 17.802.3: Vehicles Must Be Kept in a Clean and Sanitary
Condition. Every vehicle operating under this Ordinance shall be.kept in
a clean and sanitary condition according to rules and regulations pro -.
mulgated by the Board of Trustees. ,
SECTION 17.802.4: Designation of Taxicabs. Each taxicab shall bear
on the outside of each rear door the name of the owner; and, in addition,
may bear an identifying design approved by the Board of Trustees. No vehicd!d
covered by the terms of this Ordinance shall be licensed whose color scheme,
identifying design, monogram, or insignia to be used thereon shall, in the
opinion of the Board of Trustees conflict with or imitate any color scheme,
identifying design, monogram or insignia used on a vehicle or vehicles already
operating under the Ordinance, in such a manner as to be misleading or tend
to deceive or-defraud the pub'li•c•; and provided further, that if, after a
license has been issued fora taxicab hereunder, the color scheme,. identifying
design, monogram or insignia thereof is changed so as to be, in the opinion
of the Board of Trustees, in conflict with or imitate -zany color scheme,

identifying design, monogram, or insignia used by any other person, owner or
operator, in such a manner as to be'misleading or tend to deceive the public,
the license of or certificate covering such taxicab or taxicabs shall be sus-
pended or revoked.
SUB - ARTICLE 3: FARES
SECTION 17.803.1: Rates of Fare - Rate Card Required. No owner or driver
of a raxicab shall charge a greater sum for the.use of a taxicab than in accord-
ance with the following rates:
For the first 3/4 mile or fraction thereof,
for one person ............... 55C

provided, that notwithstanding the foregoing rates per mile or fraction thereof,
no owner or driver. of a taxicab shall charge a greater sum for the use of a
taxicab between the designated points of travel set forth on the schedule of
flat rates which is attached hereto and made a part of this Ordinance, than the
flat rate set opposite such designated points of.travel on said attached schedule.
Waiting time shall.include the time when the taxicab is not in motion,
be with the arrival at the place to which it had been called, or the
time consumed while standing at the direction of the passenger, but no charge
shall be made for time .lost,for inefficiency of the taxicab or its dperator, or
time consumed by premature response to a call.
SECTION 17.803..2: Rate Schedule Required. The driver of every taxicab
operated under this Ordinance shall have available at all times while operating
a taxicab and shall display, upon request by a passenger, a copy of the flat •
rates of fare between designated points of travel established by this Ordinance
and a copy of which schedule is attached hereto and made a part hereof.
SECTION 17.803.3: Receipts. The driver of any taxicab shall upon demand
by the passenger render to such passenger a receipt for the amount charged,
either by a mechanically printed receipt or by a specially prepared receipt on which
shall be the name of the owner, license number or motor number, amount of meter
reading or charges and date of transaction.
SECTION 17.803.4: Refusal of Passenger to Pay Legal Fare. It shall be
unlawful for any person to refuse to pay the legal fare of any of the vehicles
established herein after having fired the same, and i•t shall be unlawful for
any person to hire any vehicle herein defined with intent to defraud the person
from whom it is hired of the value of such service.
SECTION 17.803.5: Additional Passengers. No driver shall permit any other
person to occupy or ride in said taxicab, unless the person or persons first
employing the taxicab shall consent to the acceptance of additional passenger or
passengers. No charge other than 10� shall be made for an additional passenger
-except when the additional passenger rides beyond the previous passenger's
'destination and then only for the additional distance so travelled, provided that
a flat rate may be charged additional passengers if such rate has been approved
by the Board of Trustees.
SUB- ARTICLE 4: SERVICE -- RECORDS
SECTION 17.804.1: Taxicab Service. All persons engaged in the taxicab
business in the Village of Deerfield operating under the provisions of this
Ordinance shall render an overall service to the public desiring to use taxicabs.
Holders of certificates of public convenience and necessity shall maintain a
central place of business and.keep the same open twenty -four hours a day for
the purpose of receiving calls and dispatching cabs. They shall answer all calls
received by them for service inside the corporate limits of the Village as soon
as they can do so and if said services cannot be rendered within a reasonable
time they shall then notify the prospective passengers how long it will be before
the said call can be answered and give the reason therefor. Any holder who shall
refuse to accept a call anywhere in the corporate limits of the Village
_at any time when such holder has available cabs; or who shall fail or
refuse to give overall-service,•shall be deemed in violation of this
Ordinance and the certificate granted to such holder shall be revoked at
the discretion of the Board of Trustees.
SECTION 17.804.2: Manifests. Every driver shall maintain a daily
manifest upon which are recorded all trips made each day,•showing time
and place of origin and destination of each trip'and amount of fare and
all such completed manifests shall be returned to the holder by the driver
at the conclusion of his tour of duty. The forms for each manifest shall
be furnished to the driver by the- holder and shall be of a character
approved by the Board of Trustees:
Every holder of a certificate of •publ i•c -conveni•ence and necessity
shall retain and preserve all drivers' manifests in a safe place for at
least the calendar,year•next•preceding the current calendar year, and said
manifests shall be available to the Police Department.
SUB - ARTICLE 5: DRIVEV S LICENSE
SECTION 17.805.1: Taxicab Driver's License. No person shall operate
a taxicab for hire upon the streets of the Village of Deerfield, and no
person who owns or controls a taxicab shall permit it to be so•driven, and
no taxicab licensed by the Village of Deerfield shall be.so dH-ven at any time
for hire, unless the driver of said taxicab shall have first obtained and
shall huiive then in force a taxicab driver's license.issued under the pro-
visions of this Ordinance.
SECTION 17.805.2: Qualifications of Applicant. Each applicant for
a driver's 1_cpnse must:
(a) Be of the age of twenty -one years or over. -
(b) Be of sould physique with good eyesight, and not subject to any
disease or infirmity of body or mind which might render him
unfit for the safe operation of a taxicab:
(c) Be able to read, write and speak the English language.
(d) Be clean in�dress and person and not be addicted to the use
of drugs or intoxicating 1- iquors.
(e) Shall not have been convicted of -a felony.
(f) Possess a valid Class A Chauffeur's License issued by the
State of 1 l 1 i no i s.
SECTION 17.805.3: Application for Driver's License. An application
for a taxicab dirver's license shall be filed with the Village Clerk on
forms provided by the Village Clerk; and such application shall be verified
under oath and shall contain the following information:
(a) The names and addresses of four reputable person's who have
known the applicant for a period of 2 years and who will vouch
for the sobriety, honesty, and general good character of the
applicant.
(b) ' The experience of the applicant in the transportation of
passengers.
(c) The educational background of the applicant.
(d) A concise history of his employment.
Each application shall be accompanied by a certificate from a
licensed physician certifying that, in his opinion, the applicant is not
inflicted with any disease or infirmity which might made him an unsafe -
or unsatisfactory driver.
SECTION 17.805.4: Examination of Applicant -- Current State Motor
Vehicle Operator's Permit Required. Before any appli- cation is finally passed
upon by the Board of Trustees, the applicant shall be required to pass a
satisftictory examination as to his knowledge of the Village and of traffic
regulations. Each applicant must demonstrate and show that he has a current
motor vehicle operator's permit issued by the State of Illinois. The Chief
of Police shall examine each applicant and no license shall be issued unless
the Chief of Police shall certifiy to the applicant's competency to operate
a motor vehicle.
SECTION 17.805.5: Police I'•nvestigation of Applicant -- Traffic and Police
Record. The Police Department shall-conduct an investigation of each applicant
for a-taxicab driver's, license and a'report of such investigation and a copy of
the traffic and police record of the applicant, if any,.shall be attached to the
application for the consideration of the Board of Trustees.
SECTION 17.805.6: Consideration of Application. The Board of Trustees shall
upon consideration of the application and the reports °,and the certificate required
to be attached thereto approve or reject the applicant.
SECTION 17:805.7: Issuance of License -- Duration Annual Fee. Upon
approval of an application for a taxicab driver's license the Village Clerk, upon
payment of a fee of $5.00, shall issue a.license to the applicant which shall
bear the name, address, age, signature and photograph of the applicant.
Such license shall be in effect for the remainder of the calendar year. A.
license for every calendar year thereafter shall issue upon the payment of $5.00
unless the license for the preceding year has been revoked.
SECTION 17.805.8: Display of License. Every driver licensed under this
.Ordinance shall post his dri-ver's license in such-a place as to be in full view
of all passengers while such driver is operating a taxicab.
SECTION 17.805.9: Suspension and Revocation of License. The Board of
Trustees may 'suspend or revoke any driver's license for-failure to comply with
the provisions of thie Ordinance.'
The Chief of Police shall be authorized to temporarily suspend any driver's
license for failure to comply with the provisions of th,i:s Ordinance pending Board
of Trustees' action.
SECTION 17.805.10: Failure to Comply with Village, State and Federal Laws.
Every driver licensed under this Ordinance shall comply with all applicable Village
ordinances „and State and F.ede'ral Laws. Violation of-any such ordinance or-laws
shall justify the Board of Trustees in suspending or revoking a license.
SUB - ARTICLE 6: MISCELLANEOUS
SECTION 17.806.1: Advertising. Subject to rules and regulations of the
Board of Trustees, it shall.be lawful for any person owning or operating a taxicab
or motor vehicle for hire to permit advertising matter to be affixed to the exterior
of such taxicabs or motor vehicles for hire.
SECTION 17.806.2: Police Department -- Duty to Enforce Ordinance. The Police
Department of the Village of Deerfield shall enforce the provisions of this Ordinance.
SECTION 17.806.3: Penalty. Any person violating any of the provisions of
this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof
shall be.fined, not exceeding $500.00.
.SECTION 17.806.4:. Severabi l,i.ty.. Each of the provisions of thie Ordinance are
severable, and if any provision shall be declared to be invalid, the remaining pro-
visions shall not be affected but shall remain in full force and effect.
SECTION 17.806.5: Repealing Provision.. All ordinances or parts of ordinances
in conflict with this Ordinance are hereby repealed.

sand that the applicant is fit, willing, and able to perform such
public transportation and to conform to the provisions of this
Ordinance; then the Board of Trustees shall direct the Village
Manager, upon compliance by applicant with the provisions of
this Ordinance, to issue a certificate stating the name and
address of the applicant, the number of vehi -cles authorized
under said certificate and the date of issuance; otherwise, the
application shall be denied.
If the Board of Trustees finds from the investigation
and hearing that the public convenience and necessity justify
the issuance of a certificate, it shall notify the applicant of
its finding and within sixty days thereafter, the applicant shall
comply with the further provisions of this Ordinance for the
issuance of a certificate and the issuance of licenses for the
vehicles to be operated.
If the Board of Trustees finds from such investigation
and hearing that the public convenience and necessity do not
justify the issuance of a certificate, it shall forthwith notify
the applicant of such finding.
SECTION 17.801.6: Indemnity Bond or Liability Insurance
Required. No certificate of public convenience and necessity shall
be-issued or continued in operation unless the applicant has
complied with all the provisions of this Ordinance and with all
the provisions of the State law requiring proof of financial
responsibility of operators of motor vehicles used for the trans-
portation of passengers for hire (Chapter 95 -1/2, Section 8 -101
et-seq. Illinois Revised Statutes (1965) and as hereafter amended).
Before a certificate of public convenience and necessity is issued,
the applicant shall submit to the Village Manager a certificate
of the Secretary of State of the State of Illinois for each motor.
vehicle to be operated or controlled by the applicant evidencing
that proof of financial responsibility for each of said motor
vehicles has been submitted to the Secretary of State and that the
applicant has otherwise complied with the provisions of said
State law.
SECTION 17.801.7: License Fees: No certificate shall be
issued or continued in operation unless applicant or the holder
thereof has paid an annual license fee in accordance with the
following schedule of fees:
$40.00 per taxicab
Said license fees shall be for the calendar year-and shall be

applied for on or before January 1 of each year; provided that
in case of licenses iss -aeu on or- after-July. 1 of each year
the applicant shall be required `to pay only 1/2--of the fee
specified above.
Said fee shall be in addition to any other license or
vehicle fee established by ordinance.
SECTION 17.801.8: Transfer 'of Certificates. No certificate
of public convenience and necessity may be sold, assigned,
mortgaged or otherwise transferred without the consent of the
Board of Trustees.
SECTION 17.801.9: Suspension and Revocation of Certificates.
A certificate issued under the provisions of this Ordinance may
be revoked or suspended by the.Board of Trustees if the holder
thereof has (a) violated any of the provisions of this Ordinance,
(b) discontinues operations for more than 10 days, (c) has
violated any ordinances of the Village of Deerfield, or the
laws of the United States or the State of Illinois, the violations
of which reflect unfavorably on the fitness of the holder to
offer public transportation.
Prior to suspension or revocation, the holder shall be
given 5 days notice of the proposed action to be taken and shall
have an opportunity to be heard.
SUB - ARTICLE 2: VEHICLES -- EQUIPMENT AND MAINTENANCE
SECTION 17.802.1: Vehicles Must be Licensed. Prior to
the issuance of a certificate of public convenience and
necessity and prior to the use and operation of any vehicle
under the provisions of this Ordinance, said vehicle shall be
thoroughly examined and inspected by the Chief of Police or
a member of the Police Department duly authorized by the
Chief of Police and found to comply with the provisions of
this Ordinance and such reasonable rules and regulations as
may be prescribed by the Board of Trustees. These rules and
regulations shall be promulgated to provide safe transportation
and shall specify such equipment and regulatory.devices as
the Board of Trustees shall deem necessary therefore.
When the Chief of Police finds that a vehicle has met
the standards established by the Board of Trustees, and the
license fee paid, he shall issue a license to that effect,
which license shall be displayed on the vehicle in such manner
as the Chief of Police shall direct.

SECTION 17.802.2: Inspection of Vehicles Generally;
Semi- annual Report. The Chief of Police shall maintain con-
stant vigilance over all taxicabs and see that they are kept
in a condition of continued fitness for public use. To this
end, the Chief of Police shall inspect or cause to be inspected
all taxicabs, from time to time, or on the complaint of any
person, or as often as may be necessary. At least twice in
each year the Chief of Police.shall make a written report of
all such inspections to the Board of Trustees.
SECTION 17.802.3: Vehicles Must Be Kept in a Clean and
Sanitary Condition. Every vehicle operating under this Ordi-
nance shall be kept in a clean and sanitary condition according
to rules and regulations promulgated by the Board of Trustees.
SECTION 17.802.4: Designation of Taxicabs. Each taxicab
shall bear on the outside of each rear door the name of the owner;
and, in addition, may bear an identifying design approved by the
Board of Trustees. No vehicle covered by the terms of this Ordi-
nance shall be licensed whose color scheme, identifying design,
monogram, or insignia to be used thereon shall, in the opinion
of the Board of Trustees conflict with or imitate any color
scheme, identifying design, monogram or insignia used on a
vehicle or vehicles already operating under the Ordinance, in
such a manner as to be misleading or tend to deceive or defraud
the public; and provided further, that if, after a license has
been issued for a taxicab hereunder, the color scheme, identifying
design, monogram, or insignia thereof is changed so as to be, in
the opinion of the Board of Trustees, in conflict with or imitate
any color scheme, identifying design, monogram, or insignia used
by any other person, owner or operator, in such a manner as to
be misleading or tend to deceive the public, the license of or
certificate covering such taxicab or taxicabs shall be suspended
or revoked.
SUB - ARTICLE 3: FARES
SECTION 17.803.1: Rates of Fare - Rate Card Required.
No owner or driver of a taxicab shall charge a greater sum for
the use of a taxicab than in accordance with the following rates:
For the first 3/4 mile or fraction thereof,

provided, that notwithstanding the foregoing rates per mile or
fraction thereof, no owner or driver of a taxicab shall charge
a greater sum for the use of a taxicab between the designated
points of travel set forth on the schedule of flat rates which
is attached hereto and made a part of this Ordinance, than the
flat rate set opposite such designated points of travel on said
attached schedule.
Waiting time shall include the time when the taxicab is
not in motion, beginning with the arrival at the place to which
it had been called, or the time consumed while standing at the
direction of the passenger, but no charge shall be made for time
lost for inefficiency of the taxicab or its operator, or time
consumed by premature response to a call.
SECTION 17.803.2: Rate Schedule Required. The driver of
every taxicab operated under this Ordinance shall have available
at all times while operating a taxicab and shall display, upon
request by a passenger, a copy of the flat rates of fare between
designated points of travel established by this Ordinance and a
copy of which schedule is attached hereto and made a part hereof.

SECTION 17.803.3: Receipts. The driver of any taxicab
shall upon demand by the passenger render to such passenger a
receipt for the amount charged, either by a mechanically
printed receipt or by a specially prepared receipt on which
shall be the name of the owner, license number or motor
number,.amount of meter reading or-charges and date of trans-
action.
SECTION 17.803.4: Refusal of'Passenger to Pay Legal Fare.
It shall be unlawful for any person to refuse to pay the legal
fare of any of - the vehicles established herein after having
hired the same, and it shall be unlawful for any person to
hire any vehicle herein defined with intent to defraud the
person from whom it is hired of the value of such service.
SECTION 17.803.5::Additional Passengers. No driver shall
permit any other person to occupy or ride in said taxicab,
unless the person or-persons first employing the taxicab shall
consent to the acceptance of additional passenger or passengers.
No charge other than 10J shall be made for an additional
passenger except when the additional passenger rides beyond
the previous passenger'''s destination and then only for the
additional distance so travelled, provided that .a flat rate
may be charged additional passengers if such rate has been
approved by the Board of Trustees.
SUB ARTICLE 4: SERVICE -- RECORDS
.SECTION 17.804.1: Taxicab-Service. All persons engaged in
the taxicab business in the Village tsf Deerfield operating
under the provisions of this Ordinance shall render an overall
service to the public desiring to use taxicabs. Holders of
certificates of public convenience and necessity shall maintain
a central place of business andkkeep the same open twenty -four
hours a day for the purpose of receiving calls and dispatching
cabs. They shall answer all calls received by them for services
inside the corporate limits of the Village as soon as they can
do so and if said services cannot be rendered within a reasonable
time they shall then notify the prospective passengers how long
it will be before the said call can be answered and give the
reason therefor. Any holder who shall refuse to accept a call
anywhere in the corporate limits of the Village at any time
when such holder has available cabs; or who shall fail or refuse
to give overall service, shall be deemed in violation of this
Ordinance and the certificate granted to such holder shall be
revoked at the discretion of. the Board of Trustees.
SECTION 17:804.2: Manifests. Every driver shall maintain a
daily manifest upon which are recorded all trips made each day,
showing time and place of origin and destination of each trip
and amount of fare and all such completed manifests shall be
returned to the holder by the driver at the conclusion of his
tour of duty. The forms for each manifest shall be furnished
to the driver by the holder and shall be of a character approved
by the Board of Trustees.
Every holder of a certificate of public convenience
and necessity shall retain and preserve all drivers' manifests
in a safe place for at least the calendar year next preceding
the current calendar year, and said manifests shall be available
to the Police Department.
SUB - ARTICLE 5 DRIVER'S LICENSE
SECTION 17 :805.1: Taxicab Driver's License. No person
shall operate a taxicab for hire upon the streets of the Village
of Deerfield, and no person who owns or controls a taxicab
shall permit it to be so driven, and no taxicab licensed by
the Village of Deerfield shall be so driven at.any time for
hire, unless the driver of said taxicab shall have first
obtained and shall have then in force a taxicab driver's license
issued under the provisions of this Ordinance.
SECTION 17.805.2::Qualifications of Applicant. Each
applicant for a drivers license must:
(a) Be of the age of twenty -one years or over.
(b) Be of sound physique with good eyesight, and not
subject to any disease or infirmity of body or mind
which might render him unfit for the safe operation of
a taxicab.
(c) Be able to read, write and speak the English language.
(d) Be clean in dress and person and not be addicted to
the use of drugs or intoxicating liquors.
(e) Shall not have been convicted of a felony.
(f) Possess a valid Class A Chauffeur,'s License issued
by the State of Illinois.
SECTION 17.805.3: Application for Driver's License. An
application for a taxicab driver "s license shall be filed with the
Village Clerk on forms provided by the Village Clerk; and such
application shall be verified under oath and shall contain the
following information:
(a) The names and addresses of four reputable persons
.who have known the applicant for a period of 2 years and
who will vouch for the sobriety, honesty, and general
good character of the applicant.
(b) The experience of the applicant in the transpor-
tation of passengers.
(c) The educational background of the applicant.
(d)'A concise history of his employment.
Each application shall be accompanied by a certificate
from a licensed physician certifying that, in his opinion,
the applicant is not u'licted with any disease or infirmity
which might make him an unsafe or unsatisfactory driver.
SECTION_17.805. 4.:,Ex'amination of Applicant -- Current
State Motor Vehicle' Operato ,s Permit R'equir'ed. Before any
application is finally passed upon by the Board of Trustees,
the applicant shall be required to pass a satisfactory exam-
ination as to his knowledge of the Village and of traffic reg-
ulations. Each applicant must demonstrate his skill and
ability to safely drive-a vehicle and show that he has a
current motor vehicle operator, 's permit issued by the State of
Illinois. The Chief of Police .shall examine each applicant
no license shall be issued unless the Chief of'Police shall
certify to the applicantscompetency to operate a motor vehicle.
SECTION 17.805.5:. Police Investigation of Applicant
Tr'affic and Police Record. The Police Department shall conduct
an investigation of each applicant for a taxicab driver's
license and a report of such investigation and a copy of the
traffic and police record of the applicant, if any, shall be
attached to the application for the consideration of the Board
of Trustees.
SECTION 17.805.6: Consideration of Application. The
Board of Trustees shall upon consideration of the application
and the reports and the certificate required to be attached
thereto approve or reject the applicant.
Section 17.805.7: Issuance of License -- Duration -- Annual
Fee. Upon approval of an application for a taxicab driver ".s
license the Village Clerk/.shall/issue a license to the applicant
,upon payment of a fee of $5.00,

which shall bear the name, address, age, signature and
photograph of the applicant.
Such license shall be in effect for the remainder of
the calendar year. A license for every calendar year there-
after shall issue upon the payment of $5.00 unless the license
for the preceding year has been revoked.
SECTION 17.805.8: Display of License. Every driver licensed
under this Ordinance shall post his driver's license in such
a place as to be in full view of all passengers while such
driver is operating a taxicab.
SECTION 17.805.9: Suspension and Revocation of License.
The Board of Trustees may suspend or revoke any driver's license
for failure to comply with the provisions of this Ordinance.
The Chief of Police shall be authorized to temporarily
suspend any driver's license for failure to comply with the
provisions of this Ordinance pending Board of Trustees' action.

SUB - ARTICLE 6: MISCELLANEOUS
SECTION 17.806.1: Advertising. Subject to rules and
regulations of the Board of Trustees, it shall be lawful for
any person owning or operating a taxicab or motor vehicle for
hire to permit advertising matter to be affixed to the exterior
of such taxicabs or motor vehicles for hire.
SECTION 17.806.2: Police Department -- Duty to Enforce
Ordinance. The Police Department of the Village of Deerfield
shall enforce the provisions of this Ordinance.
SECTION 17.806.3: Penalty. Any person violating any of
the provisions of this Ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be fined not
exceeding $500.00.
SECTION 17.806.4: Severabil..ity. Each of the provisions
of this Ordinance are severable, and if any provision shall be
declared to be invalid, the remaining provisions shall not
be affected but shall remain in full force and effect.
SECTION 17.806.5: Repealing Provision. All ordinances or
parts of ordinances in conflict with this Ordinance are
hereby repealed.
