ORDINANCE NO. 2018- 0-18-49
AN ORDINANCE AMENDING SECTIONS 6.01-C AND 14.02 OF
"THE DEERFIELD ZONING ORDINANCE 1978", AS AMENDED, TO MAKE
CONSTRUCTION AND ENGINEERING INNOVATION LAB
A SPECIAL USE IN THE I-1 DISTRICT
WHEREAS, the City is a home rule municipal corporation in accordance with
Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and
WHEREAS, Oracle America, Inc., a Delaware corporation ("Applicant's, desires to
use a portion of the property located at 1405 Lake Cook Road, in Deerfield, Illinois
("Property's as a construction and engineering innovation lab; and
WHEREAS, the Property is located in the 1-1 Office, Research, Restricted Industrial
Zoning District ("I-1 District'; and
WHEREAS, construction and engineering innovation labs are not an authorized use
in the I-1 District; and
WHEREAS, the Applicant submitted an application to the Village seeking approval
of, among other things, amendments to the "Deerfield Zoning Ordinance 1978," as amended
("Zoning Ordinance's to make construction and engineering innovation labs a permitted
use in the 1-1 District upon the issuance of a special use permit ("Proposed Amendment';
and
WHEREAS, a public hearing by the Plan Commission to consider the Proposed
Amendment to the Zoning Ordinance was duly advertised on October 4, 2018 in the
Deerfield Review, and was held on October 25, 2018; and
WHEREAS, on October 25, 2018, the Plan Commission approved findings of fact in
support of the Proposed Amendment, in accordance with and pursuant to Section 13.10 of
the Zoning Ordinance, and voted to recommend approval of the Proposed Amendment by
the Village Board; and
WHEREAS, the Village Board has considered the standards for amendments set
forth in Section 13.10 of the Zoning Ordinance; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interest of the Village to adopt of the Proposed Amendment, as set forth in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: CONSTRUCTION AND ENGINEERING INNOVATION
LAB. Section 6.01-C, titled "Special Uses," of Article 6, titled "Industrial Districts," of the
Zoning Ordinance is hereby amended to read as follows:
"6.01-C Special Uses
The following uses are permitted in the I-1 Office, Research, Restricted
Industrial District when authorized in accordance with the procedures for
Special Uses as set forth in Article 13, Administration and Enforcement:
24. Construction and Eny-ineerine Innovation Labs. provided such use is
(i) developed as part of a Planned Unit Development: (ii) the parcel on
which the use is located shall be a minimum of 10 acres in size and the
Planned Unit Development on which the use is to be developed is located
adjacent to Interstate Highway 94 (also known as the Eden's Spur)."
SECTION THREE: DEFINITIONS. Section 14.02, titled "Definitions," of Article
14, titled "Rules and Definitions," of the Zoning Ordinance is hereby amended to add the
following definition in alphabetical order:
"Construction and Engineering Innovation Lab: A facility used for
the purpose of showcasing of construction and engineerin_
innovations and products which may include activities such as
product demonstrations, seminars, workshops, and meetings."
SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law.
