VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-17-21 AN ORDINANCE AUTHORIZING A FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE COUNTY OF LAKE AND THE VILLAGE OF DEERFIELD FOR THE JURISDICTIONAL TRANSFER OF DEERFIELD ROAD IN THE VILLAGE OF DEERFIELD AND THE COSTS ASSOCIATED WITH THE IMPROVEMENTS TO DEERFIELD ROAD WHEREAS, the County of Lake ("County") and the Village of Deerfield ("Village") entered into an Agreement dated October 13, 2015 (the "Jurisdictional Transfer Agreement") setting forth terms and conditions for the improvement and jurisdictional transfer of Deerfield Road (also known as County Highway 11) from the Village to the County, and also for the designation of a further section of Deerfield Road as a municipal extension of County Highway 11 within the corporate limits of the Village; and WHEREAS, the improvement of Deerfield Road pursuant to the Jurisdictional Transfer Agreement has been substantially completed; and WHEREAS, in cooperation with the Illinois Department of Transportation ("IDOT"), the County and the Village have determined that it is in their mutual best interests that the limits of the jurisdictional transfer of Deerfield Road from the Village to the County shall be amended to be from the west edge of through pavement of Robert York Avenue east to the east corporate limits of the Village, and that the limits of Deerfield Road be further designated as a municipal extension of County Highway 11 from Wilmot Road east to the west edge of through pavement of Robert York Avenue, as required by [DOT to provide a logical terminus for the east end of the municipal extension of this County Highway 11 segment; and WHEREAS, the Village and the County desire to amend the Jurisdictional transfer Agreement as provided in the "First Amendment to the Agreement between the County of Lake and the Village of Deerfield for the Jurisdictional Transfer of Deerfield Road in the Village of Deerfield and the Costs Associated with the Improvements to Deerfield Road from the Metra Milwaukee District North Line Viaduct in the Village of Deerfield to the East Abutment of the East Skokie Ditch Bridge in Highland Park" (the "First Amendment'), a copy of which is attached hereto and made a part of this Ordinance; and WHEREAS, the corporate authorities of the Village of Deerfield have determined that it is in the public interest of the Village of Deerfield and its citizens to authorize and enter into the said First Amendment, a copy of which is attached to and made a part of this Ordinance; WHEREAS, Deerfield Road between the west edge of through pavement of Robert York Avenue east to the east corporate limits of the Village will be removed from the Village of Deerfield municipal street system and added to the Lake County Highway system. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: The recitals to this Ordinance are incorporated into and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the First Amendment between the County of Lake and the Village of Deerfield, a copy of which is attached hereto and made a part of this Ordinance. SECTION 3: That the Mayor (Village President) and Village Clerk of the Village of Deerfield be and they are hereby authorized and directed to respectively execute and attest the First Amendment in substantially the form attached hereto for and on behalf of the Village of Deerfield. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. PASSED this 2nd day of October , 2017.
